These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("you," "your," "User") and Strategia-X ("we," "us," "our," "Company") governing your access to and use of the DeviceLab Audiophile mobile application ("DeviceLab Audiophile," "the App," "the Service"), including all features, audio analysis tools, measurement capabilities, and services provided through the App.
By downloading, installing, accessing, or using DeviceLab Audiophile, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the App.

IMPORTANT AUDIO MEASUREMENT NOTICE: All acoustic and audio measurements produced by DeviceLab Audiophile are APPROXIMATE. Results depend on the quality, sensitivity, and frequency response of your device's built-in or connected microphone and audio hardware. DeviceLab Audiophile is NOT a substitute for certified, calibrated professional measurement instruments such as Type 1 or Type 2 sound level meters (IEC 61672) or professional audio analyzers. Do NOT rely on these measurements for safety compliance, occupational health assessments, regulatory submissions, or any other safety-critical or legally significant purpose. See Section 12 for the full disclaimer.
1. Acceptance of Terms
1.1 Agreement to Terms
By downloading DeviceLab Audiophile from the Google Play Store, installing it on your device, launching it for the first time, or using any feature of the App, you expressly agree to be legally bound by these Terms, our Privacy Policy, and any additional guidelines, policies, or rules referenced herein, all of which are incorporated into this Agreement by reference.
If you do not agree to all of the Terms, you are not permitted to access or use the App. Your continued use of the App after any modification to these Terms constitutes binding acceptance of the revised Terms. These Terms apply to all users of the App regardless of whether access occurs through the Google Play Store, a direct APK installation, or any other distribution channel authorized by Strategia-X.
1.2 Capacity to Contract
You represent and warrant that you have the legal capacity to enter into this Agreement. If you are using the App on behalf of an organization, employer, or business entity, you represent and warrant that you are authorized to bind that entity to these Terms, and references to "you" in these Terms shall include that entity.
1.3 Electronic Agreement
You acknowledge that these Terms constitute an electronic agreement and that your acceptance is as legally binding as a handwritten signature. No physical signature is required. The act of installing, launching, or using the App constitutes your electronic signature and acceptance of this Agreement.
1.4 Supersession
These Terms supersede any prior agreements, understandings, representations, or warranties between you and Strategia-X relating to the App, whether oral or written. Nothing in these Terms is intended to limit any rights you may have under applicable mandatory consumer protection laws in your jurisdiction that cannot be waived by contract.
2. Eligibility
2.1 Minimum Age — General
DeviceLab Audiophile is intended for users who are at least 13 years of age. By using the App, you represent and warrant that you are 13 years of age or older. If you are under 13, you are not permitted to download, install, or use the App under any circumstances, and any such use is a material breach of these Terms. If we discover that we have inadvertently collected personal information from a child under 13, we will take immediate steps to delete that information.
2.2 Parental or Guardian Consent — Ages 13 to 15 (GDPR Article 8)
If you are at least 13 but under 16 years of age and are located in a Member State of the European Economic Area ("EEA"), the United Kingdom, or another jurisdiction that requires parental or guardian consent for digital services under applicable data protection law (including GDPR Article 8), you must obtain verifiable consent from a parent or legal guardian before using the App. By using the App, you represent either that you are 16 or older, or that your parent or legal guardian has reviewed and agreed to these Terms on your behalf and has provided the consent required by applicable law.
2.3 Legal Capacity
You represent that you have the legal capacity to enter into a binding contract in your jurisdiction. If you are using the App on behalf of an organization, you represent and warrant that you are authorized to bind that organization to these Terms.
2.4 Jurisdiction Compliance
You represent and warrant that your use of the App complies with all applicable local, state, national, and international laws and regulations. If access to or use of the App is prohibited by law in your jurisdiction, you are not authorized to use the App.
2.5 Google Play Store Requirements
Your eligibility to download and install the App is also subject to the Google Play Store Terms of Service. DeviceLab Audiophile is rated for audiences aged 13 and older on the Google Play Store in accordance with applicable content rating guidelines.
3. Description of Service
3.1 Overview
DeviceLab Audiophile is a professional audio analysis toolkit for Android, built with Kotlin and Jetpack Compose. It is designed for audio engineers, audiophiles, musicians, home-theater enthusiasts, acoustic researchers, and professionals who need real-time acoustic and audio-system measurement tools on a mobile platform. All audio analysis is performed entirely on-device in real time; no audio is ever recorded to storage, transmitted over a network, or processed on remote servers.
3.2 Audio Analysis and Measurement Tools
The following professional audio analysis features are provided within the App. Each tool utilizes your Android device's built-in hardware and produces approximate, informational readings only. See Section 12 for the full measurement accuracy disclaimer.
- SPL Meter (Decibel Meter) — Real-time sound pressure level measurement with A-, C-, and Z-frequency weighting. Microphone input is processed in real time; no audio is recorded, stored, or transmitted.
- Spectrum Analyzer — Frequency-domain visualization of live audio input across the full audible spectrum.
- Real-Time Analyzer (RTA) — Continuous, high-resolution spectral analysis with configurable averaging, resolution, and display options.
- Spectrogram — Time-frequency representation displaying spectral energy content over time.
- Oscilloscope — Time-domain waveform display of live audio signals for waveform shape and amplitude analysis.
- THD Measurement — Total Harmonic Distortion analysis to evaluate audio equipment performance and nonlinear distortion characteristics.
- SNR Measurement — Signal-to-Noise Ratio testing to assess dynamic range and noise floor characteristics of audio systems.
- Frequency Response Testing — Sweep-based analysis of speaker, microphone, and audio system frequency response.
- Impulse Response Capture — Measurement of acoustic impulse responses for room and system analysis.
- Room Acoustics Analysis — Reverberation time (RT60), early decay time (EDT), clarity (C50/C80), definition, and related acoustic parameters.
- Waterfall / CSD Display — Cumulative Spectral Decay visualization for evaluating resonance and decay behavior of audio systems and room modes.
- Speaker Testing — Automated and manual test sequences for loudspeaker characterization and evaluation.
- Microphone Testing — Sensitivity, frequency response, and noise floor evaluation of connected microphones.
- Bluetooth Audio Latency Testing — Round-trip latency measurement for Bluetooth audio devices and profiles.
- USB Audio Latency Testing — Latency measurement for USB audio interfaces and DACs connected to the device.
- Multi-Channel Testing — Analysis across multiple audio output channels simultaneously.
- Channel Balance Testing — Left/right and multi-channel level balance verification.
- Frequency Generator — Sine wave generation at user-defined frequencies for stimulus and sweep testing.
- Noise Generator — Configurable noise generation including white, pink, brown, blue, and violet noise for acoustic testing and loudspeaker burn-in.
- Calibration Tools — Microphone sensitivity calibration and reference-level calibration workflows to improve measurement accuracy.
- PDF and CSV Report Export — Generation of formatted measurement reports in PDF and CSV formats for documentation, archiving, and sharing.
3.3 Critical Audio Data Handling Disclosure
Audio captured via the microphone exists solely in volatile (RAM) memory during active measurement and is permanently discarded when the measurement session ends or the App is closed. No audio is ever recorded to non-volatile storage, transmitted over any network connection, or processed on remote servers. See Section 14 for a complete explanation of our audio data handling practices.
We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice, and without liability to you, subject to applicable law.
4. Accounts and Registration
4.1 No Account Required
DeviceLab Audiophile does not require you to create a user account, register with Strategia-X, or provide any personal credentials in order to use the App. All core functionality is available immediately upon installation without registration.
4.2 No Account-Level Data
Because no accounts exist, there are no passwords to manage, no login credentials to protect, and no account-level data associated with your identity on our servers. Data generated by the App — including calibration profiles, measurement results, exported reports, and user preferences — is stored locally on your device and is subject to your device's own security controls.
4.3 Device Security Responsibility
You are solely responsible for maintaining the physical and logical security of your device and for any data stored on it. Strategia-X is not responsible for unauthorized access to locally stored App data resulting from loss, theft, or compromise of your device.
5. Subscriptions and Purchases
5.1 Free Application — No In-App Purchases
DeviceLab Audiophile is provided free of charge. The App does not offer, and you cannot make, any in-app purchases, premium upgrades, subscription plans, consumable items, or any other paid transactions through the App or through the Google Play billing system. All features described in Section 6 are available at no cost.
5.2 Revenue Model
The only revenue model currently employed by the App is advertising, as described in Section 7. Advertising revenue enables Strategia-X to offer the App at no cost to users.
5.3 Future Paid Features
If, in the future, Strategia-X introduces paid features or subscription offerings, you will be notified in advance, these Terms will be updated accordingly, and no charges will be made without your express affirmative consent.
6. Free Features
6.1 Complete Feature Access
All features of DeviceLab Audiophile are provided free of charge. Subject to these Terms and applicable law, you have access to the complete professional audio analysis toolkit described in Section 3, including:

6.2 Hardware-Dependent Features
Feature availability may vary depending on your device's hardware capabilities, Android version, installed audio drivers, and the presence of compatible external audio hardware such as USB audio interfaces or Bluetooth audio devices. We do not guarantee that all features will function identically across all supported devices.
7. Advertising
7.1 Google AdMob
DeviceLab Audiophile is supported by advertising served through Google AdMob, a mobile advertising platform operated by Google LLC. By using the App, you acknowledge that advertisements may be displayed to you during your use of the App. Advertising revenue enables us to offer the App at no cost to users.
7.2 Google User Messaging Platform (UMP)
We use the Google User Messaging Platform (UMP) to present consent dialogs required under the GDPR (for users in the EEA, UK, and Switzerland) and applicable U.S. state privacy laws. When you first launch the App, or when required by changes in applicable law or your location, you may be presented with a consent dialog that allows you to choose whether personalized advertising is served to you. Your consent choices are respected and stored in accordance with applicable law.
7.3 Personalized vs. Non-Personalized Advertising
- Personalized ads are served when you provide consent and involve Google using information about your interests and behavior (collected across Google's network) to deliver advertisements that may be relevant to you.
- Non-personalized ads are served when you do not consent to personalized advertising, or when required by law. These ads are based on contextual factors only (such as the App's content or general location) and do not involve cross-site or cross-app behavioral tracking for targeting purposes.
7.4 Opting Out of Personalized Advertising
You may update your consent preferences at any time through the App's settings menu or through your device's Google settings (Settings > Google > Ads). You may also opt out of interest-based advertising by visiting https://adssettings.google.com. Even if you opt out, you will continue to see advertisements; they will simply not be personalized based on your interests.
7.5 Google's Data Practices
Google's collection and use of data in connection with advertising is governed by Google's Privacy Policy, available at https://policies.google.com/privacy. Strategia-X does not control Google's data processing practices and is not responsible for Google's handling of your data.
7.6 Children and Advertising
If we detect or have actual knowledge that a user is under 13, we will configure AdMob to serve only non-personalized, COPPA- and GDPR-compliant advertising as required by applicable law. Advertising targeting based on behavioral data is never used in relation to users known to be under the applicable age threshold.
8. User Content and Intellectual Property
8.1 Your Measurement Data and Reports
Any measurement results, calibration profiles, and exported reports (PDF and CSV files) generated by your use of the App ("User Content") belong to you. Strategia-X does not claim any ownership interest in your User Content. Because your data is stored locally on your device and not transmitted to our servers, no license from you to us over your User Content is required or granted.
8.2 Strategia-X Intellectual Property
The App and all of its components — including but not limited to the source code, compiled binaries, user interface design, graphics, icons, audio processing algorithms, measurement methodologies, documentation, and the "DeviceLab Audiophile" name and logo — are the exclusive intellectual property of Strategia-X and are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws. All rights not expressly granted to you in these Terms are reserved by Strategia-X.
8.3 Feedback
If you submit feedback, suggestions, ideas, enhancement requests, or bug reports to us ("Feedback"), you grant Strategia-X a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, modify, and incorporate such Feedback into our products and services without any obligation, compensation, or attribution to you. You represent that you have the right to provide such Feedback free of third-party restrictions.
8.4 Third-Party Open Source
The App may incorporate open-source software components, each subject to their respective licenses. Nothing in these Terms restricts your rights under applicable open-source licenses. A list of open-source components and their licenses may be available within the App's "About" section or upon written request to Strategia-X.
9. License Grant to You
9.1 Scope of License
Subject to your compliance with these Terms, Strategia-X grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use DeviceLab Audiophile on Android devices that you own or control, solely for your personal or internal professional purposes, in accordance with these Terms and the Google Play Terms of Service.
9.2 License Restrictions
This license expressly does not permit you to:
- Copy, modify, adapt, translate, or create derivative works based upon the App or any portion thereof;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent expressly permitted by applicable law;
- Distribute, sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App or any component thereof;
- Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices from the App;
- Use the App to build a competing product or service, or to benchmark the App for competitive intelligence purposes without our written consent; or
- Use the App in any way that violates applicable law or these Terms.
9.3 Revocation
This license is automatically revoked if you breach any provision of these Terms. Upon revocation or termination, you must cease all use of the App and uninstall it from all your devices.
10. Acceptable Use
10.1 Permitted Uses
You agree to use DeviceLab Audiophile only for lawful purposes and in a manner consistent with these Terms. Permitted uses include:
- Personal audio system evaluation and optimization;
- Professional acoustic measurement and room treatment assessment;
- Speaker and headphone frequency response analysis;
- Home theater calibration and setup;
- Recording studio acoustic analysis;
- Educational and research purposes related to acoustics and audio engineering;
- Audio equipment quality control and testing in a professional context;
- Generating and exporting measurement reports for professional documentation.
10.2 Audio Measurement Accuracy Disclaimer
All measurements performed by DeviceLab Audiophile are dependent on the quality, sensitivity, frequency response, dynamic range, and calibration of your Android device's built-in or connected microphone. Consumer-grade device microphones vary significantly in accuracy across manufacturers and models. DeviceLab Audiophile is not a substitute for calibrated, laboratory-grade audio measurement systems such as those manufactured by Bruel & Kjaer, NTi Audio, Audio Precision, Rohde & Schwarz, or equivalent professional measurement instrument providers. Results obtained from the App should not be relied upon for safety-critical, compliance-critical, or high-stakes engineering decisions without independent verification using professional-grade equipment.
SPL readings from the App should not be used as the sole basis for occupational noise exposure assessments, hearing conservation programs, or regulatory compliance determinations under OSHA, EU Directive 2003/10/EC, or equivalent standards. Use calibrated sound level meters (Type 1 or Type 2 per IEC 61672) for such purposes. Measurement results may also be affected by ambient noise, microphone placement, device case acoustics, temperature, humidity, and other environmental variables.
10.3 Hearing Safety
Several features of DeviceLab Audiophile generate audio signals, including the Frequency Generator and Noise Generator. You acknowledge and agree that:
- Prolonged or excessive exposure to loud sounds (above approximately 85 dB SPL) can cause permanent, irreversible hearing damage;
- You are solely responsible for setting and monitoring output levels when using the App's signal generation features;
- You should never place headphones or earphones at high volume levels near your ears or the ears of others during speaker or driver testing; and
- Strategia-X is not liable for hearing damage resulting from your use of the App's signal generation or playback features.
11. Prohibited Conduct
You agree that you will not, and will not permit any third party to:
- Use the App in any manner that violates any applicable federal, state, local, or international law or regulation;
- Use the App to eavesdrop on, intercept, or monitor private conversations, communications, or audio content of third parties without their knowledge and consent, whether or not such activity would be detectable via the App's interface;
- Attempt to use the App's microphone access in ways not intended by its design, including attempting to record, capture, or extract persistent audio content beyond the App's disclosed real-time analysis functionality;
- Modify, hack, or tamper with the App to alter its data privacy behaviors, including attempting to intercept in-memory audio buffers for unauthorized recording;
- Use the App to generate audio signals intentionally designed to harm, damage, or interfere with audio equipment, hearing aids, or other sound-sensitive devices belonging to others without their consent;
- Circumvent, disable, or interfere with any security or consent features of the App, including the UMP consent dialog;
- Use the App in any way that could disrupt, damage, or impair the App or its servers, networks, or infrastructure;
- Use any automated script, bot, or data extraction tool to scrape, collect, or harvest data from the App or any connected Strategia-X service;
- Distribute modified versions of the App through any channel other than one explicitly authorized by Strategia-X in writing; or
- Infringe upon the intellectual property rights, privacy rights, or other legal rights of Strategia-X or any third party in connection with your use of the App.
12. Disclaimers and Limitation of Liability
12.1 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEVICESLAB AUDIOPHILE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. STRATEGIA-X EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
Without limiting the foregoing, Strategia-X does not warrant that:
- The App will meet your specific requirements or expectations;
- Measurement results will be accurate, precise, or suitable for any particular purpose;
- The App will be uninterrupted, error-free, or free from bugs or defects;
- The App will be compatible with all Android devices, firmware versions, or audio hardware configurations;
- Any errors or defects in the App will be corrected; or
- The App is free from viruses, malware, or other harmful components (though we take reasonable steps to ensure this).
12.2 Critical Disclaimer — Measurements Are Approximate
All acoustic and audio measurements produced by DeviceLab Audiophile are approximations. Measurement accuracy is inherently constrained by:
- The frequency response, sensitivity, and noise floor of the Android device's built-in microphone or connected external microphone;
- Analog-to-digital converter (ADC) quality, bit depth, and sample rate limitations of the device's audio hardware;
- Android audio HAL implementation variability across device manufacturers;
- Acoustic coupling between the microphone and the environment;
- Microphone calibration data, if applied; and
- Ambient noise floor and acoustic reflections in the measurement environment.
DeviceLab Audiophile is NOT a professional metrology instrument. It is NOT a replacement for Type 1 or Type 2 sound level meters, professional audio analyzers, or other certified measurement equipment. Results must not be used for safety compliance, occupational health assessments, regulatory submissions, or any application where measurement accuracy is legally or safety-critical.
12.3 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STRATEGIA-X, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS; LOSS OF DATA; LOSS OF GOODWILL; BUSINESS INTERRUPTION; PERSONAL INJURY; PROPERTY DAMAGE; HEARING DAMAGE OR LOSS RESULTING FROM USE OF AUDIO SIGNAL GENERATION FEATURES; INACCURATE MEASUREMENT RESULTS AND DECISIONS MADE BASED THEREON; OR COST OF SUBSTITUTE GOODS OR SERVICES; ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE APP, EVEN IF STRATEGIA-X HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the fullest extent permitted by applicable law, Strategia-X's total cumulative liability to you for all claims arising from or related to these Terms or your use of the App shall not exceed the greater of: (a) the total amount you paid to Strategia-X in the twelve (12) months preceding the claim (which, given the App is free, would be zero dollars), or (b) US $50.00.
Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent such laws apply to you, some or all of the above exclusions and limitations may not apply, and you may have additional rights.
13. Indemnification
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Strategia-X, its affiliates, licensors, and service providers, and each of their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms;
- Your use of the App in a manner not authorized by these Terms or applicable law;
- Any decisions you make, or actions you take, based on measurements or data obtained from the App;
- Your use of signal generation features resulting in damage to equipment, property, or harm to persons;
- Your infringement of any intellectual property or other rights of any third party; or
- Your violation of applicable laws, including privacy laws, wiretapping statutes, or audio surveillance laws.
Strategia-X reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate fully with Strategia-X in asserting any available defenses.
14. Privacy and Data Protection
Your privacy is fundamental to how we design and operate DeviceLab Audiophile. This section summarizes our data practices; our full Privacy Policy provides complete detail and governs in the event of any conflict.
14.1 Microphone Usage — Critical Disclosure
The RECORD_AUDIO permission is required by Android to access microphone input for any purpose, including real-time analysis. Our use of this permission is solely and strictly for real-time acoustic analysis as described herein. Specifically:
- YES — The microphone is used extensively for real-time acoustic analysis, including SPL measurement, spectrum analysis, RTA, spectrogram, impulse response capture, room acoustics measurement, THD, SNR, frequency response testing, and microphone testing.
- NO — Audio captured via the microphone is never recorded to storage — not to your device's internal storage, not to an SD card, and not to any remote server or cloud service.
- NO — Audio data is never transmitted over a network connection, Wi-Fi, Bluetooth data channel, or any other communication interface.
- NO — The App does not perform voice recognition, speech-to-text transcription, conversation monitoring, speaker identification, or any other form of linguistic or biometric processing of audio content.
- NO — Audio does not persist beyond the active measurement session. Audio data exists exclusively in volatile RAM during active measurement and is immediately and permanently discarded when the measurement ends, a new measurement begins, or the App is closed. No audio ever touches non-volatile storage.
14.2 Data Stored Locally on Your Device
The following categories of data may be stored locally on your device:
- Calibration Profiles — Microphone sensitivity and reference-level calibration data you configure within the App;
- Measurement Results — Saved SPL readings, spectrum captures, THD measurements, SNR measurements, frequency response curves, impulse responses, and room acoustics data that you explicitly choose to save;
- Exported Files — PDF and CSV reports generated at your request, saved to your device's accessible storage; and
- User Preferences — Application settings, UI preferences, measurement configuration, and display options.
This locally stored data is under your control. You may delete it at any time by clearing the App's data within Android Settings or by uninstalling the App.
14.3 Android Permissions Summary
- RECORD_AUDIO — Real-time microphone access for acoustic analysis (audio never recorded or stored).
- MODIFY_AUDIO_SETTINGS — Configure audio routing and sample rate for measurement accuracy.
- BLUETOOTH / BLUETOOTH_ADMIN / BLUETOOTH_CONNECT — Detect and connect to Bluetooth audio devices for latency and audio testing.
- READ_EXTERNAL_STORAGE / READ_MEDIA_AUDIO — Access user-selected audio files for playback-based testing; read calibration files.
- FOREGROUND_SERVICE / FOREGROUND_SERVICE_MEDIA_PLAYBACK — Maintain continuous measurement sessions and audio playback in foreground.
- POST_NOTIFICATIONS — Display foreground service notification required by Android 13+.
- VIBRATE — Optional haptic feedback for measurement events.
- INTERNET / ACCESS_NETWORK_STATE — Load advertising (Google AdMob); check network state for ad delivery.
14.4 Data Transmitted to Third Parties
The only data transmitted from your device to external parties is data transmitted to Google in connection with advertising and Google Play Services. This may include advertising identifiers, device identifiers, coarse location data, and interaction data as described in Google's Privacy Policy. No measurement data, audio data, calibration data, or User Content is transmitted to Strategia-X or any third party other than as described above.
15. GDPR Compliance
This section applies to users located in the European Economic Area (EEA), the United Kingdom, and Switzerland. DeviceLab Audiophile is committed to compliance with Regulation (EU) 2016/679 (the General Data Protection Regulation, "GDPR") and its UK equivalent (UK GDPR).
15.1 Data Controller
For the purposes of the GDPR, Strategia-X acts as the data controller for personal data processed in connection with your use of DeviceLab Audiophile. Contact details are provided in Section 25.
15.2 Legal Bases for Processing (Article 6)
We rely on the following legal bases under Article 6 GDPR for processing personal data in connection with the App:
- Article 6(1)(a) — Consent: For the serving of personalized advertising via Google AdMob, where you have provided consent through the UMP consent dialog. You may withdraw consent at any time without affecting the lawfulness of processing prior to withdrawal.
- Article 6(1)(b) — Performance of Contract: For processing necessary to provide you with the App's functionality pursuant to these Terms (e.g., local storage of measurement data you save, preferences). Audio data captured via the microphone is processed under this basis for the purpose of providing real-time measurement functionality. Because audio data exists only in volatile memory and is never stored or transmitted, the privacy impact of this processing is minimal.
- Article 6(1)(f) — Legitimate Interests: For serving non-personalized advertising (where you have not consented to personalized ads), for fraud prevention, and for security purposes, where our legitimate interests are not overridden by your rights and freedoms.
15.3 Children's Consent (Articles 7 and 8)
Where consent is the legal basis for processing, consent from children under 16 (or the applicable age threshold in your member state) must be provided or authorized by the child's parent or guardian. We rely on Google's UMP and age-gate mechanisms to facilitate this requirement. See Section 2.
15.4 Transparency and Information Rights (Articles 12–14)
We provide clear, concise, and accessible information about our data processing practices through these Terms and our Privacy Policy, in compliance with Articles 12–14 GDPR. Information is provided in plain language, free of charge, and without undue delay.
15.5 Your Rights (Articles 15–22)
Subject to applicable exceptions and limitations under the GDPR, you have the following rights with respect to your personal data:
- Article 15 — Right of Access: Request confirmation of whether we process your personal data and, if so, obtain a copy.
- Article 16 — Right to Rectification: Request correction of inaccurate personal data.
- Article 17 — Right to Erasure ("Right to be Forgotten"): Request deletion of your personal data where certain conditions apply.
- Article 18 — Right to Restriction of Processing: Request that we restrict processing of your personal data in certain circumstances.
- Article 20 — Right to Data Portability: Receive your personal data in a structured, commonly used, machine-readable format.
- Article 21 — Right to Object: Object to processing based on legitimate interests or for direct marketing purposes.
- Article 22 — Rights Related to Automated Decision-Making: Not to be subject to solely automated decisions that produce significant legal effects, where applicable. We do not engage in automated decision-making of this nature.
Because most personal data in the App is stored locally on your device and not on our servers, many of these rights can be exercised directly by clearing the App's data or uninstalling the App. For personal data processed by Google in connection with advertising, requests should be directed to Google. Contact us at the address in Section 25 for any GDPR rights requests.
15.6 Privacy by Design and Default (Article 25)
DeviceLab Audiophile is architected with data minimization as a core design principle. Audio processing is performed entirely on-device in real time; no audio is persisted or transmitted. We collect only data that is strictly necessary for the App's operation. Default settings are configured to minimize data collection.
15.7 International Data Transfers (Articles 44–49)
If your personal data is transferred outside the EEA (for example, to Google's servers in the United States in connection with advertising), such transfers are made in reliance on one or more of the following safeguards: (i) the European Commission's adequacy decisions; (ii) Standard Contractual Clauses (SCCs) adopted by the European Commission; or (iii) other appropriate safeguards under Articles 44–49 GDPR. Google's data transfers are governed by Google's own GDPR compliance framework and SCCs. No audio data or measurement data is transferred internationally by Strategia-X.
15.8 Right to Lodge a Complaint (Article 77)
Without prejudice to any other administrative or judicial remedy, you have the right under Article 77 GDPR to lodge a complaint with the supervisory authority of the EU member state of your habitual residence, place of work, or place of the alleged infringement. A list of EU supervisory authorities is available at https://edpb.europa.eu. UK users may contact the Information Commissioner's Office (ICO) at https://ico.org.uk.
16. CCPA/CPRA Compliance
This section applies to residents of the State of California, USA. DeviceLab Audiophile is committed to compliance with the California Consumer Privacy Act (Cal. Civ. Code §§ 1798.100–1798.199) as amended by the California Privacy Rights Act (CPRA), collectively the "CCPA/CPRA."
16.1 Personal Information We Collect
In the preceding 12 months, we have collected or may collect the following categories of personal information as defined under the CCPA/CPRA:
- Identifiers — Device identifiers and advertising identifiers (collected by Google AdMob/Google Play Services; not collected by Strategia-X directly).
- Internet or Other Electronic Network Activity — Ad interaction data (collected by Google AdMob; not collected by Strategia-X directly).
- Geolocation Data — Coarse location derived from IP address for non-personalized ad targeting and GDPR territory determination (processed by Google; not stored by Strategia-X).
Audio Data — Not Personal Information Under CCPA/CPRA. Audio captured by the App's microphone for acoustic measurement purposes is processed exclusively in real time in volatile memory and is immediately discarded. This audio is not a "communication" for purposes of the CCPA/CPRA, is not personal information under CCPA/CPRA § 1798.140, and is never sold, shared, stored, or disclosed. It does not fall within the category of "sensitive personal information" under CPRA, as it is not used to identify you personally and is not retained.
16.2 Your California Privacy Rights (§§ 1798.100–1798.125)
California residents have the following rights under CCPA/CPRA, subject to applicable exceptions:
- Right to Know (§ 1798.100, § 1798.110, § 1798.115): Request disclosure of the categories and specific pieces of personal information we have collected, the sources, the business purposes, and the categories of third parties with whom we share it.
- Right to Delete (§ 1798.105): Request deletion of personal information we have collected, subject to certain exceptions.
- Right to Correct (§ 1798.106, CPRA): Request correction of inaccurate personal information.
- Right to Opt-Out of Sale or Sharing (§ 1798.120, § 1798.135): We do not sell or share personal information in the traditional sense. However, sharing of identifiers with Google AdMob for personalized advertising may constitute "sharing" under CPRA. You may opt out through the App's consent settings or by visiting adssettings.google.com.
- Right to Limit Use of Sensitive Personal Information (§ 1798.121, CPRA): To the extent any sensitive personal information is processed, you have the right to limit its use to purposes specified by law.
- Right to Non-Discrimination (§ 1798.125): We will not discriminate against you for exercising any of your CCPA/CPRA rights.
16.3 Submitting a CCPA/CPRA Request
To exercise your CCPA/CPRA rights, contact us at the email address provided in Section 25 with the subject line "CCPA Privacy Request." We will respond within 45 days as required by law, with a possible extension of an additional 45 days where reasonably necessary with prior notice. We will verify your identity before fulfilling requests. Because we do not require accounts or collect identifying information directly, we may be limited in our ability to verify identity for some requests.
16.4 CalOPPA Compliance
In compliance with the California Online Privacy Protection Act (CalOPPA), we make our Privacy Policy conspicuously available, clearly identify the categories of personally identifiable information we collect, disclose whether third parties may collect PII through the App, and indicate how we respond to Do Not Track signals. We honor Do Not Track and Global Privacy Control (GPC) signals to the extent technically feasible.
17. Additional U.S. State Privacy Laws
Strategia-X respects the privacy rights of users across all U.S. states that have enacted comprehensive consumer data privacy legislation. To the extent DeviceLab Audiophile meets the applicability thresholds of these laws, we commit to honoring the rights described below. Across all applicable state laws, you generally have the right to:
- Know what personal data is collected about you;
- Access your personal data;
- Correct inaccurate personal data;
- Delete personal data provided by or obtained about you;
- Opt out of the sale of personal data;
- Opt out of targeted advertising based on personal data;
- Opt out of profiling for decisions with significant legal or similarly significant effects;
- Non-discrimination for exercising these rights; and
- Appeal a denial of your rights request (where required by law).
The following state laws and the rights they confer are acknowledged and respected:
- Virginia — Consumer Data Protection Act (VCDPA), Va. Code Ann. §§ 59.1-571 et seq. Includes right to appeal denial of rights requests within 60 days.
- Colorado — Colorado Privacy Act (CPA), C.R.S. §§ 6-1-1301 et seq. Includes Universal Opt-Out Mechanism (UOOM) support; includes right to appeal.
- Connecticut — Connecticut Data Privacy Act (CTDPA), Conn. Gen. Stat. §§ 42-515 et seq. Includes right to appeal within 60 days of denial.
- Utah — Utah Consumer Privacy Act (UCPA), Utah Code Ann. §§ 13-61-101 et seq. Applies to controllers meeting applicable revenue/data processing thresholds.
- Iowa — Iowa Consumer Data Protection Act (ICDPA), Iowa Code Ch. 715D. Effective January 1, 2025.
- Indiana — Indiana Consumer Data Protection Act (INCDPA), Ind. Code §§ 24-15-1-1 et seq. Effective January 1, 2026.
- Tennessee — Tennessee Information Protection Act (TIPA), Tenn. Code Ann. §§ 47-18-3201 et seq. Effective July 1, 2025.
- Montana — Montana Consumer Data Privacy Act (MCDPA), Mont. Code Ann. §§ 30-14-3401 et seq. Effective October 1, 2024.
- Texas — Texas Data Privacy and Security Act (TDPSA), Tex. Bus. & Com. Code §§ 541.001 et seq. Effective July 1, 2024.
- Oregon — Oregon Consumer Privacy Act (OCPA), ORS §§ 646A.570 et seq. Effective July 1, 2024.

- Nebraska — Nebraska Data Privacy Act (NDPA), Neb. Rev. Stat. §§ 87-401 et seq. Effective January 1, 2025.
- Maryland — Maryland Online Data Privacy Act (MODPA), Md. Code, Com. Law §§ 14-4601 et seq. Effective October 1, 2025. Notable for broader "sensitive data" definitions.
- Minnesota — Minnesota Consumer Data Privacy Act (MCDPA), Minn. Stat. §§ 325O.01 et seq. Effective July 31, 2025.
17.1 COPPA Compliance
The Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506, and the FTC's implementing regulations (16 C.F.R. Part 312) prohibit the collection of personal information from children under 13 without verifiable parental consent. DeviceLab Audiophile is not directed to children under 13. We do not knowingly collect personal information from children under 13. If we discover that we have inadvertently collected personal information from a child under 13, we will take immediate steps to delete that information. If you are a parent or guardian and believe we may have inadvertently collected information from a child under 13, please contact us immediately at the address in Section 25. We configure Google AdMob with appropriate child-directed treatment tags where required.
17.2 Exercising State Privacy Rights
To exercise privacy rights under any of the above state laws, contact us at the email address provided in Section 25 with the subject line "U.S. State Privacy Request — [Your State]." We will respond within the timeframe required by your state's applicable law. Where an appeal right exists and we deny your initial request, we will provide instructions for submitting an appeal.
18. International Users
DeviceLab Audiophile is developed and operated from the United States. These Terms and the App's operation are governed primarily by U.S. law. If you access or use the App from outside the United States, you do so on your own initiative and are responsible for compliance with applicable local laws.
In addition to the GDPR provisions addressed in Section 15, users in the following jurisdictions should be aware of the following:
- Brazil (LGPD): Users in Brazil have rights under the Lei Geral de Proteção de Dados (LGPD), Law No. 13,709/2018, including rights of access, correction, deletion, data portability, information about sharing, and the right to revoke consent. We process data in accordance with LGPD principles of purpose limitation, necessity, and data minimization.
- Canada (PIPEDA / Law 25): Users in Canada have rights under the Personal Information Protection and Electronic Documents Act (PIPEDA) and, for Quebec residents, Law 25 (An Act to modernize legislative provisions as regards the protection of personal information). You may request access to personal information we hold about you and challenge its accuracy.
- Australia (Privacy Act 1988): Australian users may have rights under the Australian Privacy Act 1988 and the Australian Privacy Principles (APPs). You may request access to and correction of personal information about you, and complain about suspected privacy breaches.
- Other Jurisdictions: Users in other jurisdictions may have additional rights under local data protection laws. We will endeavor to honor reasonable requests consistent with applicable law.
To the extent a conflict exists between these Terms and mandatory provisions of the law of the country in which you are located, the mandatory provisions of applicable local law shall govern to the extent required.
19. Third-Party Services
DeviceLab Audiophile integrates with the following third-party services. Your use of these services is subject to their respective terms of service and privacy policies, which we encourage you to review. Strategia-X is not responsible for the data practices of any third-party service provider.
19.1 Google AdMob
Mobile advertising platform providing banner, interstitial, and other ad formats. May collect advertising identifiers, device information, and interaction data for ad targeting and measurement. Governed by the Google Privacy Policy and AdMob GDPR Guidance.
19.2 Google User Messaging Platform (UMP)
Consent management platform used to present GDPR and U.S. state law consent dialogs. Stores and communicates your consent choices to Google's advertising infrastructure. Governed by the Google Privacy Policy.
19.3 Google Play Services
Core Android platform services provided by Google, including device integrity attestation, network connectivity, and update distribution. Google Play Services may collect device and usage data as described in the Google Privacy Policy.
Strategia-X enters into appropriate data processing agreements with third-party service providers as required by the GDPR and other applicable data protection laws. The App does not integrate any third-party analytics SDKs beyond those described above, and does not share your personal data with advertisers, data brokers, or other third parties for purposes beyond those described herein.
20. Updates and Modifications
20.1 App Updates
Strategia-X may release updates to DeviceLab Audiophile periodically through the Google Play Store. Updates may include new features, bug fixes, security patches, performance improvements, or removal of features. Some updates may be required to continue using the App. You are responsible for keeping the App updated to the current version. We are not responsible for issues arising from your use of an outdated version of the App.
20.2 Automatic Updates
If your device is configured to automatically update apps, DeviceLab Audiophile may update without specific notification to you. By enabling automatic updates, you agree that updated Terms (if any) take effect upon the update's installation.
20.3 Feature Changes
We reserve the right to modify, suspend, or discontinue any feature of the App at any time. We will endeavor to provide reasonable notice of significant changes, but are not obligated to do so for minor updates or where immediacy is required for security reasons.
20.4 Android Version Support
We may, at any time, raise the minimum supported Android version above the current minimum of Android 7.0 (API 24). If your device's Android version falls below the minimum requirement after such a change, you may continue to use the version of the App already installed but will not receive updates.
21. Termination
21.1 Termination by You
You may terminate your agreement with these Terms at any time by uninstalling DeviceLab Audiophile from all your devices and ceasing all use of the App. Because no account exists, no additional steps are required to deregister.
21.2 Termination by Strategia-X
Strategia-X reserves the right to suspend or terminate your access to the App, or to remove the App from the Google Play Store, at any time, with or without cause or notice, to the extent permitted by applicable law. Grounds for termination may include, without limitation: your material breach of these Terms; conduct that Strategia-X believes, in its sole discretion, is harmful to other users, third parties, or Strategia-X; or legal, regulatory, or technical requirements.
21.3 Effect of Termination
Upon termination of your right to use the App, the license granted to you under Section 9 is immediately revoked. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 8, 12, 13, 14, 15, 16, 17, 18, 22, and 23.
22. Governing Law and Dispute Resolution
22.1 Governing Law
These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
22.2 Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to contact Strategia-X at the address provided in Section 25 and provide written notice of your dispute. We will attempt in good faith to resolve the dispute within 30 days of receiving written notice.
22.3 Binding Arbitration
If the dispute is not resolved through informal negotiation within 30 days, any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as modified herein. The arbitration shall be conducted in English, seated in Delaware, USA. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
22.4 Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU WAIVE ANY RIGHT TO A JURY TRIAL.
22.5 Exceptions
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights, without first engaging in the informal resolution process. Nothing in this section shall prevent either party from filing a complaint with a consumer protection agency or data protection authority.
EU and UK Users: If you are located in the EU or UK, mandatory provisions of your local consumer protection law may supersede this arbitration clause and class action waiver, and you may retain the right to bring claims in your local courts.
23. Severability
If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable under applicable law, such provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted. Any modification or deletion of a provision under this section shall not affect the validity and enforceability of the remaining provisions of these Terms, which shall continue in full force and effect.
The invalidity or unenforceability of any provision in one jurisdiction shall not affect the validity or enforceability of that provision in any other jurisdiction.
24. Changes to These Terms
Strategia-X reserves the right to modify these Terms at any time. When we make material changes to these Terms, we will:
- Update the "Last Updated" date at the top of this document;
- Post the revised Terms at www.strategia-x.com/terms/devicelab-audiophile;
- Where feasible and required by law, provide in-App notification of material changes; and
- Where required by applicable law (e.g., for changes to how we process personal data under the GDPR), obtain your renewed consent.
Your continued use of the App following the posting of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the App and uninstall it from your device.
We encourage you to review these Terms periodically to remain informed of your rights and obligations. Non-material changes (such as typographical corrections, formatting adjustments, or clarifications that do not alter the substance of your rights or obligations) may be made at any time without notification.
