These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("you," "your," "User") and Strategia-X ("we," "us," "our," "Company") governing your access to and use of the DeviceLab Monitor mobile application ("DeviceLab Monitor," "the App," "the Service"), including all features, content, and services provided through the App.
By downloading, installing, accessing, or using DeviceLab Monitor, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the App.

1. Acceptance of Terms
1.1 Agreement to Terms
By downloading DeviceLab Monitor from the Google Play Store, launching the App, using any monitoring or optimization feature, or otherwise interacting with any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. These Terms apply whether or not you have read them.
1.2 Amendments
We reserve the right to modify these Terms at any time. Changes will be effective when the updated Terms are posted within the App or on our website at www.strategia-x.com. If we make material changes, we will endeavor to notify you through the App or via a notice on the Google Play Store listing. Your continued use of DeviceLab Monitor after any changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, you must stop using the App and uninstall it.
1.3 Additional Terms
Your use of DeviceLab Monitor is also subject to Google Play's Terms of Service, which govern your download and installation of the App. In the event of a conflict between these Terms and Google Play's Terms of Service, Google Play's Terms of Service shall control with respect to the specific matter they govern (e.g., distribution, refunds). These Terms control all other aspects of your use of DeviceLab Monitor.
1.4 Language
These Terms are written in English. If these Terms are translated into other languages, the English version shall control in the event of any conflict or inconsistency.
2. Eligibility
2.1 Age Requirements
DeviceLab Monitor is intended for a general audience. By downloading and using the App, you represent and warrant that:
- You are at least 13 years of age. If you are under 13, you may not use the App under any circumstances.
- If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you have reviewed these Terms with a parent or legal guardian, and your parent or guardian consents to your use of the App and agrees to be bound by these Terms on your behalf.
- If you are located in the European Economic Area (EEA) and are under 16 years of age, you must have obtained verifiable parental or guardian consent to use the App, in accordance with Article 8 of the General Data Protection Regulation (GDPR). Parental consent is required for the processing of personal data (including advertising identifiers by Google AdMob) for users under 16 in the EEA.
2.2 Parental Responsibility
Parents and guardians who permit minors to use DeviceLab Monitor are solely responsible for:
- Supervising the minor's use of the App and reviewing its features
- Managing device-level advertising and privacy controls, including disabling personalized advertising on the child's device through Android Settings
- Ensuring the minor's use complies with these Terms and all applicable laws
- Understanding that Google AdMob may display advertisements and collect advertising identifiers unless parental controls or opt-out settings are configured
2.3 Geographic Restrictions
The App is available globally through the Google Play Store, subject to any geographic restrictions imposed by Google Play. You are responsible for ensuring that your use of DeviceLab Monitor complies with all local, state, national, and international laws and regulations applicable in your jurisdiction.
2.4 Compliance with Laws
You represent that your use of DeviceLab Monitor does not violate any applicable law or regulation, including laws governing privacy, data protection, consumer protection, and the export of technology. You may not use the App if you are located in a jurisdiction where such use is prohibited by law or regulation.
3. Description of Service
3.1 What DeviceLab Monitor Is
DeviceLab Monitor is a professional Android system monitoring and device optimization application built with Kotlin and Jetpack Compose. The App provides comprehensive real-time insight into your device's hardware performance, storage health, and system resource utilization, along with a suite of optimization tools to improve device efficiency. All core monitoring functionality operates locally on your device.
3.2 Core Monitoring Features
DeviceLab Monitor provides the following monitoring and diagnostic capabilities:
- Real-Time System Monitoring — Live dashboards displaying CPU usage, memory (RAM) utilization, storage capacity and usage, battery level, device temperature, and system uptime, updated continuously.
- Live Monitor — A dedicated real-time performance monitoring screen providing continuous live readouts of all key system metrics as they change.
- Analytics Dashboard — Historical performance analytics powered by a local Room database, allowing you to review system snapshot trends, usage patterns, and performance metrics over time.
- Charts Dashboard — Visual data representations of historical system performance metrics rendered as interactive charts for easy trend identification and analysis.
- Performance Analytics — Detailed performance profiling including CPU load history, memory pressure analysis, and thermal event tracking.
- Battery Analysis — In-depth battery monitoring covering charging state, battery health status, temperature, voltage, capacity estimates, and historical battery behavior trends.
3.3 Optimization and Management Features
DeviceLab Monitor provides the following device optimization and management tools:
- Storage Management — Comprehensive storage usage analysis showing file type distribution, category breakdowns, and storage consumption by application.
- Cache Cleaning — Detection and removal of cached application data to free up storage space. You control which caches are cleared.
- Duplicate File Detection — Scanning for and identification of duplicate files across your device's storage to help you reclaim space. File deletion is always user-initiated and confirmed.
- Photo Compression — On-device image compression tools to reduce the storage footprint of photos. Original files are not deleted without your explicit action.
- RAM Optimization — RAM booster functionality to identify and clear memory from background processes to improve device responsiveness.
- App Management — Listing of all installed applications with details including size, version, permissions, resource consumption (CPU and memory), and usage frequency to help you identify and manage resource-intensive apps.
- Performance Benchmarking — CPU and memory benchmark tests that assess and score your device's raw processing performance, with results stored locally for comparison over time.
3.4 Local-First Architecture
DeviceLab Monitor operates as a local-first application. All device monitoring data, system snapshots, performance history, benchmark results, and user preferences are stored exclusively on your device using a local Room database and Jetpack DataStore. The App does not transmit your device monitoring data to our servers or any third party. The INTERNET permission is used solely to load advertisements through Google AdMob. No device performance or usage data is ever sent over the network.
3.5 Service Availability
We strive to make DeviceLab Monitor available and functional at all times. However, we do not guarantee uninterrupted, error-free, or continuous access to the App or any of its features. The App may be temporarily unavailable or degraded due to:
- App updates, maintenance, or bug fixes
- Android OS updates or device incompatibilities
- Revocation of Android permissions by the user, which may disable related features
- Issues with third-party services, including Google AdMob
- Force majeure events beyond our reasonable control
3.6 Feature Changes
We may add, modify, suspend, or remove features of the App at any time without prior notice. We are not obligated to maintain any particular feature indefinitely. Changes to features do not entitle you to any refund or compensation.
4. Accounts and Registration
4.1 No Account Required
DeviceLab Monitor does not require you to create an account, register, or provide any personal information to use the App. You can download and use all features of the App immediately upon installation without creating a profile, entering an email address, setting a password, or authenticating in any way.
4.2 No User Profiles
The App does not have user profiles, social features, community systems, or any mechanism for identifying individual users. All data generated by the App is stored locally on your device and is associated solely with the App's installation on that device.
4.3 Device-Bound Data
Because DeviceLab Monitor operates without accounts or cloud synchronization, your performance history, analytics data, benchmark results, and preferences are tied to the specific device on which the App is installed. This data is not backed up to the cloud and is not accessible from other devices. If you clear the App's data, uninstall the App, or perform a factory reset of your device, all locally stored data will be permanently deleted.
4.4 Advertising Identity
While the App does not create user accounts, Google AdMob uses your device's Android Advertising ID (AAID) for the purpose of serving advertisements. This identifier is managed by Android and Google, not by Strategia-X. You can reset or opt out of the use of this identifier through your device's Settings. See Section 7 for full details on advertising and your choices.
5. Subscriptions and Purchases
5.1 Completely Free Application
DeviceLab Monitor is completely free to download and use. The App does not offer any paid subscriptions, premium tiers, in-app purchases, one-time purchase unlocks, paid upgrades, or any other form of paid content or feature gating. Every feature described in these Terms is available to all users at no cost.
5.2 No Payment Processing
Strategia-X does not collect, process, or store any payment information in connection with DeviceLab Monitor. No financial transactions of any kind are conducted within the App or through Strategia-X. There is no Google Play Billing integration, no in-app purchase flow, and no subscription management within the App.
5.3 Ad-Supported Model
DeviceLab Monitor is made available free of charge and is supported by revenue generated through advertising. Advertisements are served through Google AdMob and are displayed to all users of the free App. By using DeviceLab Monitor, you acknowledge and agree to the display of advertisements. See Section 7 for full details on how advertising works, your consent choices, and how to opt out of personalized advertising.
5.4 Future Monetization
We may in the future introduce optional paid features, a premium tier, or in-app purchases. If we do, we will update these Terms accordingly and provide notice through the App or our website. Any such introduction will be clearly communicated and will not retroactively affect features that were previously available for free.
6. Free Features
6.1 All Features Included at No Cost
The following features are available to all DeviceLab Monitor users completely free of charge, with no purchase, subscription, or account required:
- Real-Time System Monitoring — Live CPU, RAM, storage, battery, temperature, and uptime dashboards with continuous updates.
- Live Monitor — Dedicated real-time performance screen with continuously updating system metric readouts.
- Analytics Dashboard — Historical system performance data, snapshots, and trend analysis powered by the local Room database.
- Charts Dashboard — Interactive visual charts of historical performance metrics for clear trend visualization.
- Performance Analytics — Detailed performance profiling including CPU load history, memory pressure, and thermal analysis.
- Battery Analysis — Full battery health monitoring including charging state, temperature, voltage, capacity, and historical battery trends.
- Storage Management — Comprehensive storage usage analysis with file type distribution and per-category breakdowns.
- Cache Cleaning — Detection and user-controlled removal of application cache data.
- Duplicate File Detection — Full-device scanning for duplicate files with user-controlled deletion.
- Photo Compression — On-device image compression to reduce storage usage, with user control over which images are compressed.
- RAM Optimization — RAM booster to free memory from background processes and improve device performance.
- App Management — Full installed application listing with size, version, permissions, CPU and memory usage, and usage frequency data.
- Performance Benchmarking — CPU and memory benchmark tests with local score storage for historical comparison.
- Threshold Notifications — Configurable local notifications for low battery, low storage, high device temperature, and other user-defined monitoring alerts.
6.2 No Feature Gating
DeviceLab Monitor does not lock, restrict, or limit any of the above features based on purchase status or usage tier. All features are fully accessible to every user from the moment of installation.
6.3 Background Monitoring
The App uses Android WorkManager to schedule periodic background monitoring tasks, enabling the Analytics Dashboard and Charts Dashboard to maintain historical performance records even when the App is not actively in the foreground. You may disable or adjust monitoring intervals within the App's settings.
7. Advertising
7.1 Google AdMob Integration
DeviceLab Monitor displays advertisements through Google AdMob, a third-party advertising platform operated by Google LLC. These advertisements support the free availability of the App. By using DeviceLab Monitor, you acknowledge and consent to the display of advertisements within the App.
7.2 Advertisement Formats
The following advertisement formats may appear within the App:
- Banner Advertisements — Rectangular display ads that appear at the bottom (or other designated area) of certain screens within the App. Banner ads are displayed continuously while the relevant screen is active.
- Interstitial Advertisements — Full-screen advertisements that appear at natural transition points within the App, such as between navigating between major sections or after completing certain actions. These ads are shown periodically and not on every interaction.
We do not display rewarded video advertisements in DeviceLab Monitor. All advertisements in this App are non-optional for free users.
7.3 Google User Messaging Platform (UMP) and Consent
We use the Google User Messaging Platform (UMP) to collect your informed consent regarding the use of your personal data for advertising purposes. When you first launch DeviceLab Monitor (and in accordance with applicable law and Google's requirements), a consent dialog will be presented to you. This dialog allows you to:
- Consent to personalized advertising — Allow Google AdMob and its advertising partners to use your advertising identifier and device data to serve advertisements tailored to your interests and inferred preferences.
- Choose non-personalized advertising — Receive advertisements that are not tailored to your individual interests. Ads will still be displayed, but they will be contextual or broadly targeted rather than individually personalized.
Your consent choice is stored locally on your device and communicated to Google AdMob to govern how advertising data is processed. The UMP consent dialog will be re-displayed as required by applicable law or by changes in Google's consent framework requirements.
7.4 Personalized vs. Non-Personalized Advertising
The distinction between personalized and non-personalized advertising in DeviceLab Monitor operates as follows:
- Personalized Advertising (with consent) — Google AdMob uses your Android Advertising ID (AAID), approximate location (inferred from IP address), device information, and ad interaction history to select advertisements that may be more relevant to you. Interest-based profiles may be built and used across apps.
- Non-Personalized Advertising (without consent or after opt-out) — Google AdMob serves contextual or broadly targeted advertisements. While some device information and IP-derived location may still be used for fraud prevention and ad serving, it is not used to build interest profiles or target you based on past behavior across apps.
Even with non-personalized advertising selected, advertisements will continue to appear in the App as they are integral to the free service model.
7.5 How to Opt Out of Personalized Advertising
You may opt out of personalized advertising at any time through the following methods:
- In-App Consent Settings — If available within the App's settings menu, access the advertising consent options to update your preference to non-personalized ads.
- Android Device Settings — Navigate to Settings > Google > Ads (exact path may vary by device manufacturer and Android version) and enable "Opt out of Ads Personalization" or "Delete advertising ID." On Android 12 and later, you can delete your Advertising ID entirely.
- Reset Your Advertising ID — In the same settings menu, you can reset your Android Advertising ID to generate a new, anonymous identifier, disassociating future ad interactions from your past activity.
- Google Ads Settings — Visit adssettings.google.com to manage your Google ad personalization preferences across all Google advertising products.
Opting out of personalized advertising does not remove advertisements from the App. It only changes the manner in which ads are selected and targeted.
7.6 Advertising Data Collection by Google AdMob
Google AdMob, as a third-party data controller, may collect the following types of data independently of Strategia-X:
- Android Advertising ID (AAID) — Used for ad personalization and measurement.
- Device information — Device model, screen size, operating system version, and hardware specifications for ad formatting and targeting.
- Approximate location — Country or region-level location inferred from your IP address. No GPS or precise location is collected.
- Ad interaction data — Ad impressions, clicks, and engagement metrics for ad performance measurement and billing.
- IP address — Used for geographic ad targeting, fraud detection, and general ad delivery.
Strategia-X does not have access to or control over the advertising data collected by Google AdMob. This data is governed entirely by Google's Privacy Policy.
7.7 Ad Content
Advertisement content displayed within DeviceLab Monitor is selected and served by Google AdMob and its advertising network partners. Strategia-X does not control, review, endorse, or guarantee the accuracy, appropriateness, or quality of any advertisement content. If you encounter an advertisement you consider inappropriate, you may report it using Google's ad reporting mechanism.
7.8 No Sale of Personal Information for Advertising
We do not sell your personal information. Strategia-X does not receive, hold, or transmit your personal data to advertising networks. The advertising relationship is solely between Google AdMob and your device. Any data collection for advertising purposes is performed by Google AdMob under its own privacy framework.
8. User Content and Intellectual Property
8.1 No User-Generated Content
DeviceLab Monitor is a system monitoring and optimization tool. The App does not provide mechanisms for creating, uploading, sharing, or publishing user-generated content such as artwork, posts, files, or media. You do not submit or contribute content to Strategia-X or any shared platform through use of the App.
8.2 Locally Generated Data
The App generates data records on your device, including system performance snapshots, benchmark results, analytics records, and user preferences. This data is created by the App's algorithms in response to your device's system state and remains stored locally on your device. Strategia-X does not have access to this data, does not claim ownership of it, and has no ability to use or disclose it. You have complete ownership and control over all data stored locally by DeviceLab Monitor.
8.3 Strategia-X Intellectual Property
DeviceLab Monitor and all of its original content, features, functionality, and visual design are and will remain the exclusive intellectual property of Strategia-X. This includes, without limitation:
- The DeviceLab Monitor name, logo, and brand identity
- The App's user interface design, screen layouts, and visual elements
- All monitoring algorithms, data processing logic, and optimization routines
- All source code, architecture, and technical implementation
- All icons, graphics, animations, and visual assets within the App
- All documentation, marketing materials, and associated creative works
These materials are protected by copyright, trademark, trade secret, and other applicable intellectual property laws of the United States and international jurisdictions.
8.4 Trademarks
"DeviceLab Monitor," "DeviceLab," "Strategia-X," and associated logos and marks are trademarks of Strategia-X. You may not use, reproduce, or display these trademarks without our prior written consent, except as reasonably necessary to refer to the App (e.g., stating that your device was analyzed using DeviceLab Monitor). Unauthorized use of our trademarks may constitute infringement and may subject you to legal liability.
8.5 Open Source Components
DeviceLab Monitor incorporates open source software components, including Jetpack Compose, Room, DataStore, Hilt, Kotlin Coroutines, Material Design 3, and WorkManager. These components are licensed under their respective open source licenses (including the Apache License 2.0), which may grant you additional rights with respect to those specific components. Nothing in these Terms restricts your rights under applicable open source licenses.
8.6 DMCA and Copyright Complaints
If you believe that any content accessible through DeviceLab Monitor infringes your copyright or other intellectual property rights, please contact us at:

Your notice should include: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the allegedly infringing material and its location within the App; (c) your contact information; (d) a statement of good-faith belief that the use is not authorized by the copyright owner; (e) a statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner; and (f) your physical or electronic signature.
9. License Grant to You
9.1 Grant of License
Subject to your compliance with these Terms, Strategia-X grants you a limited, non-exclusive, non-transferable, revocable, personal, royalty-free license to:
- Download, install, and use DeviceLab Monitor on Android devices that you personally own or control, for your personal, non-commercial use.
- Access and use all features of the App as described in these Terms and as made available within the App.
- View and interact with locally stored performance data, analytics, and benchmark results generated by the App on your device.
9.2 License Restrictions
The license granted in Section 9.1 does not permit you to, and you agree that you will not:
- Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App or any portion thereof.
- Create derivative works based on the App or any of its components, features, or visual elements.
- Remove, alter, obscure, or otherwise interfere with any copyright, trademark, patent, or other proprietary notices or labels contained in or on the App.
- Distribute, sublicense, sell, resell, transfer, assign, lease, rent, or lend the App or any portion thereof to any third party.
- Use the App or any knowledge gained from it to develop, design, or market any competing product, service, or application.
- Circumvent, disable, bypass, or otherwise interfere with any security features, license enforcement mechanisms, or digital rights management systems within or associated with the App.
- Use automated scripts, bots, macros, or other automated means to interact with the App or to extract data, assets, or code from the App.
- Extract, re-use, or repurpose any icons, graphics, visual assets, algorithms, or other App components outside of your authorized personal use of DeviceLab Monitor.
- Use the App for any commercial purpose, including providing device monitoring services to third parties using the App.
9.3 Scope of License
This license is granted solely for your personal use on your own devices. You may install and use DeviceLab Monitor on multiple Android devices that you personally own or control. This license does not grant you any ownership rights in or to the App. All rights not expressly granted in these Terms are reserved by Strategia-X.
9.4 License Termination
The license granted under this Section 9 terminates automatically if you breach any provision of these Terms. Upon termination, you must immediately cease all use of the App and delete all copies from your devices. Strategia-X reserves the right to revoke this license at any time for cause.
10. Acceptable Use
10.1 Permitted Uses
DeviceLab Monitor is designed to help you monitor, analyze, and optimize your own Android device. You agree to use the App only for these intended purposes and in a manner that is:
- Lawful — In compliance with all applicable local, state, national, and international laws and regulations.
- Authorized — On devices that you own or are otherwise authorized to monitor and optimize.
- Personal — For your own personal device management, not for commercial device monitoring services provided to third parties.
- Non-harmful — In a manner that does not harm, damage, or degrade the performance of your device, the App, or Strategia-X's systems.
10.2 Device Permissions
Certain features of DeviceLab Monitor require Android runtime permissions. By granting these permissions, you authorize the App to access the corresponding device capabilities for the specific purposes described in these Terms and the App's Privacy Policy. You understand that:
- Permissions are used exclusively for the disclosed App functionality. The PACKAGE_USAGE_STATS permission is used only to display your app usage data within the App. READ_EXTERNAL_STORAGE and scoped media permissions (READ_MEDIA_IMAGES, READ_MEDIA_VIDEO, READ_MEDIA_AUDIO) are used only for storage analysis, duplicate detection, and photo compression. The INTERNET permission is used only for loading AdMob advertisements.
- You may revoke any permission at any time through Android Settings, which will disable the corresponding feature but will not otherwise affect your use of the App.
- The App requests only the permissions necessary to deliver its advertised functionality, in accordance with Android's principle of least privilege.
10.3 Responsible Use of Optimization Tools
The cache cleaning, duplicate file detection, photo compression, and RAM optimization features of the App modify your device's data and system state. You acknowledge that:
- You are solely responsible for any data you choose to delete, compress, or modify using the App's optimization tools.
- You should review files flagged as duplicates before deleting them, as the duplicate detection algorithm may in rare cases identify files that are not true duplicates.
- Photo compression is irreversible — original image quality cannot be restored after compression. You should maintain backups of important images before using this feature.
- Cache clearing may temporarily slow down applications that must rebuild their caches. This is expected behavior and is not a malfunction.
11. Prohibited Conduct
11.1 Illegal Activities
You agree not to use DeviceLab Monitor for any purpose that is illegal or prohibited under applicable law, including but not limited to:
- Using the App to monitor a device you do not own or are not authorized to access
- Using the App's access to device data to facilitate unauthorized surveillance or privacy invasion
- Using the App in connection with any activity that violates applicable privacy laws or data protection regulations
- Using the App to facilitate any form of fraud, identity theft, or financial crime
11.2 Tampering with the App
You agree not to:
- Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to access the source code, underlying algorithms, or binary data of the App.
- Modify, patch, crack, or otherwise alter the App's code, functionality, or behavior, including attempts to remove or bypass advertising, modify performance data, or alter benchmark results.
- Use rooted device privileges to access, modify, or extract internal App data beyond what is accessible through standard Android APIs.
- Introduce malware, viruses, Trojans, ransomware, worms, or other malicious or harmful code into the App or devices on which it is installed.
11.3 Interference with the Service
You agree not to:
- Use automated tools, bots, scripts, crawlers, or other non-human means to interact with the App, generate false performance data, or stress-test the App in ways that degrade performance.
- Interfere with, damage, disable, overburden, or impair the App or any associated infrastructure, servers, or networks.
- Attempt to gain unauthorized access to Strategia-X's systems, servers, databases, or other infrastructure through any means, including through the App.
11.4 Misrepresentation
You agree not to:
- Misrepresent your identity, affiliation, or the nature of your device to obtain different or enhanced functionality within the App.
- Publicly misrepresent the capabilities, features, or performance metrics of DeviceLab Monitor in a manner that is false or misleading.
- Use the App's benchmark results or monitoring data in a misleading context or for deceptive commercial purposes.
11.5 Circumventing Advertising
DeviceLab Monitor is provided free of charge and is supported by advertising revenue. You agree not to use ad blockers, ad filtering applications, VPNs configured to block ads, hosts file modifications, or any other mechanism to prevent the display of advertisements within the App, or to modify the App to remove advertising functionality. Such circumvention undermines the free availability of the App and may constitute a breach of these Terms.
11.6 Consequences of Prohibited Conduct
Violation of any provision of this Section 11 may result in immediate termination of your license to use the App under Section 21, and may expose you to civil and criminal liability under applicable law. Strategia-X reserves the right to investigate and take appropriate legal action against anyone who, in our sole discretion, engages in prohibited conduct.
12. Disclaimers and Limitation of Liability
12.1 "As Is" and "As Available" Disclaimer
DEVICELAB MONITOR IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. YOUR USE OF THE APP IS AT YOUR SOLE RISK.
12.2 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STRATEGIA-X EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
- Accuracy warranties — We do not warrant that the system monitoring data, performance metrics, battery readings, storage analysis results, benchmark scores, or any other output of the App will be accurate, complete, current, or free from error. Monitoring data is derived from Android system APIs and may be subject to limitations of those APIs.
- Reliability warranties — We do not warrant that the App will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.
- Data preservation warranties — We do not warrant that your locally stored performance history, analytics data, or benchmark records will not be lost due to device failure, OS updates, App updates, hardware failure, bugs, or other causes.
- Optimization efficacy warranties — We do not warrant that the cache cleaning, RAM optimization, photo compression, or other optimization features will produce any specific improvement in device performance, battery life, or storage availability. Results vary by device, Android version, and system configuration.
- Compatibility warranties — We do not warrant that the App will be compatible with all Android devices, all Android OS versions within the supported range, all hardware configurations, or all device manufacturers' system customizations.
- Third-party service warranties — We do not warrant the availability, accuracy, or reliability of third-party services including Google AdMob and the Google User Messaging Platform.
12.3 Disclaimer Regarding Optimization Actions
STRATEGIA-X EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY ARISING FROM YOUR USE OF THE APP'S OPTIMIZATION FEATURES, INCLUDING CACHE CLEANING, DUPLICATE FILE DELETION, PHOTO COMPRESSION, AND RAM OPTIMIZATION. YOU ACKNOWLEDGE THAT THESE FEATURES MODIFY DEVICE DATA AND SYSTEM STATE AND THAT ANY DATA DELETED OR MODIFIED THROUGH THESE FEATURES MAY BE IRRETRIEVABLE. ALWAYS MAINTAIN INDEPENDENT BACKUPS OF IMPORTANT DATA BEFORE USING OPTIMIZATION TOOLS.
12.4 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STRATEGIA-X, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, exemplary, or punitive damages including but not limited to loss of data, loss of profits, loss of revenue, loss of goodwill, loss of use, or other intangible losses, arising out of or in connection with your use of or inability to use DeviceLab Monitor.
- Direct damages in excess of Ten US Dollars ($10.00). Because DeviceLab Monitor is provided free of charge, you have paid no amounts to Strategia-X, and the maximum liability cap reflects this.
12.5 Specific Liability Exclusions
WITHOUT LIMITING THE FOREGOING, STRATEGIA-X SHALL NOT BE LIABLE FOR DAMAGES ARISING FROM:
- Loss, corruption, or deletion of device data resulting from use of the App's optimization features
- Inaccurate performance metrics, battery readings, or storage analyses
- Device damage, degradation, or reduced performance attributed to use of the App
- Inability to access or use the App or any of its features
- Unauthorized access to your device or locally stored App data
- Bugs, errors, crashes, or other software defects
- Interruption, suspension, or discontinuation of the App or any of its features
- Actions or omissions of third-party service providers, including Google AdMob
- Changes to Android APIs that affect the accuracy or availability of monitoring data
- Battery drain or device heating attributable to the App's monitoring processes
12.6 Basis of the Bargain
THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION 12 APPLY REGARDLESS OF THE FORM OF ACTION (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF STRATEGIA-X HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THESE LIMITATIONS ARE AN ESSENTIAL ELEMENT OF THE AGREEMENT BETWEEN YOU AND STRATEGIA-X, REFLECTING THE FREE NATURE OF THE APP.
12.7 Jurisdictional Limitations
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES. IN SUCH JURISDICTIONS, THE ABOVE DISCLAIMERS AND LIMITATIONS SHALL APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FOR FRAUD OR FRAUDULENT MISREPRESENTATION, OR FOR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW.
13. Indemnification
13.1 Your Indemnification Obligations
You agree to indemnify, defend, and hold harmless Strategia-X, its officers, directors, employees, agents, contractors, licensors, service providers, and affiliates from and against any and all claims, actions, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:
- Your use or misuse of DeviceLab Monitor, including your use of optimization tools
- Your violation of any provision of these Terms
- Your violation of any applicable law, regulation, or third-party right
- Any data loss, file deletion, or device damage arising from your use of the App's optimization features
- Your unauthorized use of the App on devices you do not own or are not authorized to access
- Any claim that your use of DeviceLab Monitor caused harm to a third party
13.2 Indemnification Procedure
Strategia-X will provide you with prompt written notice of any claim subject to indemnification. You agree to cooperate with Strategia-X's defense of any such claim. Strategia-X reserves the right to assume exclusive control of the defense and settlement of any matter subject to indemnification by you, at your expense. You may not settle any indemnifiable claim without Strategia-X's prior written consent.
14. Privacy and Data Protection
14.1 Privacy Policy
Your privacy is fundamental to how we have designed DeviceLab Monitor. Our collection, use, storage, and disclosure of information in connection with the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you also agree to the practices described in our Privacy Policy.
14.2 Local Data Processing
DeviceLab Monitor processes your device's system information exclusively on your device. All performance snapshots, analytics records, benchmark results, app usage statistics, storage analysis data, and user preferences are stored in the App's private local storage (Room database and DataStore) and are never transmitted to Strategia-X's servers or any third-party server (except as described in Section 14.3). You have complete ownership and control over this locally stored data.
14.3 Third-Party Data Collection
Google AdMob and the Google User Messaging Platform collect certain data as described in Section 7 and our Privacy Policy. This data collection is governed by Google's Privacy Policy and is outside of Strategia-X's direct control. Strategia-X does not receive, access, or process any of the data collected by Google AdMob.
14.4 Android Permissions and Data Access
The App requests the following Android permissions to deliver its functionality:
- PACKAGE_USAGE_STATS — Accesses app usage statistics. Requires explicit user grant in Android Settings. Used only to display app usage data within the App.
- QUERY_ALL_PACKAGES — Enumerates installed applications on Android 11+. Used for the App Manager, RAM Booster, Battery Analyzer, Storage Analyzer, Cache Cleaner, and Analytics Dashboard. All data is processed locally.
- READ_EXTERNAL_STORAGE — Accesses external storage on Android 12 and below for storage analysis, duplicate file detection, and photo compression.
- READ_MEDIA_IMAGES / READ_MEDIA_VIDEO / READ_MEDIA_AUDIO — Scoped media permissions on Android 13+ replacing READ_EXTERNAL_STORAGE for media file analysis.
- POST_NOTIFICATIONS — Required on Android 13+ to display monitoring threshold alerts and system notifications.
- INTERNET / ACCESS_NETWORK_STATE — Used exclusively to load Google AdMob advertisements and check network connectivity. No device monitoring data is transmitted.
14.5 Data Deletion
You may delete all locally stored App data at any time by navigating to Android Settings > Apps > DeviceLab Monitor > Storage > Clear Data. Uninstalling the App removes all locally stored data permanently. These actions are irreversible and cannot be undone.
15. GDPR Compliance (European Economic Area, United Kingdom & Switzerland)
15.1 Applicability
This Section 15 applies to users located in the European Economic Area (EEA), the United Kingdom (UK, under the UK GDPR as retained by the Data Protection Act 2018), and Switzerland (under the Swiss Federal Act on Data Protection, revised nFADP). References to "GDPR" in this Section include, where applicable, the UK GDPR and Swiss nFADP.
15.2 Data Controller
For the purposes of the GDPR, Strategia-X acts as the data controller in respect of any personal data processed in connection with the delivery of DeviceLab Monitor. However, because all device monitoring data is processed exclusively on your device and never transmitted to Strategia-X, Strategia-X does not hold, access, or process your device monitoring data. You are, in practical terms, the sole controller of your locally stored data.
Google LLC acts as an independent data controller for personal data collected through Google AdMob and the Google User Messaging Platform. Strategia-X and Google LLC are not joint controllers of this data.
15.3 Legal Bases for Processing (Article 6 GDPR)
To the extent any personal data is processed in connection with DeviceLab Monitor, the applicable legal bases under Article 6 of the GDPR are:
- Consent (Article 6(1)(a)) — For serving personalized advertisements through Google AdMob, where the Google User Messaging Platform (UMP) consent dialog is used to obtain your express, freely given, specific, informed, and unambiguous consent prior to any personalized ad data processing. Consent is obtained separately for each purpose where required.
- Legitimate Interests (Article 6(1)(f)) — For serving non-personalized advertisements to support the free availability of the App, where you have not provided consent for personalized advertising. Strategia-X's legitimate interest in maintaining a sustainable free application model is balanced against users' fundamental rights. For the local processing of device performance data on-device, this processing is entirely under your control and does not involve Strategia-X as a processor.
15.4 Consent Under Article 7 GDPR
Where processing is based on consent (Article 6(1)(a)), the following apply under Article 7:
- Freely Given — Consent to personalized advertising is not a condition for using DeviceLab Monitor. You may choose non-personalized ads and continue using all App features at no detriment.
- Specific and Informed — The UMP consent dialog clearly identifies the purposes for which consent is sought, the data to be processed, and the parties involved.
- Unambiguous — Consent is obtained through a clear affirmative action (opt-in selection in the consent dialog), not through pre-ticked boxes or inactivity.
- Right to Withdraw (Article 7(3)) — You may withdraw your consent at any time by accessing the consent settings within the App or through your Android device's advertising settings. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.
15.5 Transparency and Information Rights (Articles 12, 13, 14 GDPR)
In accordance with GDPR Articles 12, 13, and 14, we provide this document and our Privacy Policy to transparently communicate all relevant information about data processing. This information is provided in a concise, transparent, intelligible, and easily accessible form, using clear and plain language.
15.6 Your GDPR Rights (Articles 15–22 GDPR)
If you are located in the EEA, UK, or Switzerland, you have the following rights under the GDPR:
- Right of Access (Article 15) — Request confirmation of whether we process personal data concerning you and, if so, a copy of that data. Note: Strategia-X does not hold or process your device monitoring data on our servers, so we have no such data to provide. For AdMob data, access must be requested directly from Google.
- Right to Rectification (Article 16) — Request correction of inaccurate or incomplete personal data. Contact us at [email protected] with subject "GDPR Rectification Request."
- Right to Erasure / Right to be Forgotten (Article 17) — Request deletion of your personal data. You can delete all locally stored App data immediately by clearing App storage in Android Settings. For AdMob data, manage through Google's privacy controls. Strategia-X holds no personal data on our servers to delete.
- Right to Restriction of Processing (Article 18) — Request that we restrict processing of your personal data in specified circumstances. You may restrict ad data processing by withdrawing your UMP consent or by disabling personalized ads in your device settings.
- Right to Data Portability (Article 20) — Receive personal data you have provided in a structured, commonly used, machine-readable format. As Strategia-X holds no personal data about you on our servers, portability is exercised by your direct access to all App data stored locally on your device.
- Right to Object (Article 21) — Object to processing based on legitimate interests. You may object to advertising data processing by opting out of personalized ads through your device settings or the UMP consent dialog.
- Rights Related to Automated Decision-Making (Article 22) — You have the right not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects. DeviceLab Monitor does not engage in such automated decision-making with respect to you.
- Right to Lodge a Complaint (Article 77) — If you believe that processing of your personal data infringes the GDPR, you have the right to lodge a complaint with your local Data Protection Authority (DPA) in your EEA Member State of habitual residence, place of work, or place of the alleged infringement. In the UK, complaints may be lodged with the Information Commissioner's Office (ICO) at ico.org.uk.
15.7 Data Protection by Design and by Default (Article 25 GDPR)
Strategia-X has implemented data protection by design and by default throughout DeviceLab Monitor's architecture. Key measures include:
- All device monitoring data is processed exclusively on-device and never transmitted to external servers, implementing privacy by design at the architectural level.
- The App does not require account registration, does not collect names, email addresses, or other identifying information, minimizing personal data collection by default.
- Android permission requests are limited to those strictly necessary for disclosed functionality (principle of least privilege and data minimization).
- Personalized advertising is opt-in by default (where consent is required), with non-personalized advertising serving as the default for users who do not provide consent.
15.8 International Data Transfers (Articles 44–49 GDPR)
Strategia-X does not transfer your personal data internationally, as we do not hold your personal data on our servers. Data collected by Google AdMob and the Google User Messaging Platform may be transferred to and processed in the United States and other countries outside the EEA, UK, or Switzerland. These international transfers by Google are governed by Standard Contractual Clauses (SCCs) approved by the European Commission under Article 46 GDPR, and by other appropriate transfer mechanisms, as described in Google's data transfer frameworks.
15.9 How to Exercise Your GDPR Rights
To exercise your GDPR rights with respect to any data held by Strategia-X, contact us at: [email protected] with "GDPR Data Request" in the subject line. We will respond within 30 days of receiving your request. For complex requests, this period may be extended by up to 60 additional days, in which case we will notify you within the initial 30-day period. To exercise rights regarding Google AdMob data, use Google's account and privacy controls.
16. CCPA/CPRA Compliance (California Residents)
16.1 Applicability
This Section 16 applies to residents of the State of California and is provided pursuant to the California Consumer Privacy Act (CCPA), California Civil Code §§ 1798.100–1798.199, as amended by the California Privacy Rights Act of 2020 (CPRA), which became fully operative on January 1, 2023.
16.2 Categories of Personal Information Collected
Strategia-X itself does not collect personal information from California residents, as defined by the CCPA/CPRA, through DeviceLab Monitor. Our third-party advertising partner, Google AdMob, may collect the following categories of personal information as set forth in Cal. Civ. Code § 1798.140:
- Identifiers (§ 1798.140(v)(1)(A)) — Android Advertising ID (AAID), IP address. These are collected by Google AdMob.
- Internet or Other Electronic Network Activity Information (§ 1798.140(v)(1)(F)) — Ad impression data, ad click data, app version, and ad interaction history. Collected by Google AdMob.
- Geolocation Data (§ 1798.140(v)(1)(G)) — Approximate location inferred from IP address (city/region level only; no precise GPS coordinates). Collected by Google AdMob.
- Inferences (§ 1798.140(v)(1)(K)) — Google AdMob may draw inferences from the above to create profiles for ad targeting purposes.
Device performance monitoring data generated and stored locally on your device does not constitute "personal information" under the CCPA/CPRA as it is not disclosed to or accessible by Strategia-X or any third party. All locally stored data is processed solely on your device.
16.3 Purposes for Collection
To the extent personal information categories are collected (by Google AdMob), the purpose is to serve advertisements within the App. Strategia-X does not use AdMob-collected data for any other purpose.
16.4 Sale and Sharing of Personal Information
Strategia-X does not sell your personal information as defined under the CCPA (§ 1798.140(ad)). We do not exchange your personal information for monetary or other valuable consideration with third parties.
Regarding "sharing" for cross-context behavioral advertising under the CPRA (§ 1798.140(ah)): Google AdMob's use of device identifiers and ad interaction data for personalized advertising may constitute "sharing" under the CPRA. You may opt out of such sharing by:
- Choosing non-personalized ads through the Google UMP consent dialog presented within the App.
- Disabling personalized ads in your device's Google Ads settings (Settings > Google > Ads > Opt out of Ads Personalization).
- Resetting or deleting your Android Advertising ID in your device's Google Ads settings.
- Using Google's Ad Settings at adssettings.google.com.
16.5 Your CCPA/CPRA Rights (§§ 1798.100–1798.199.100)
As a California resident, you have the following rights under the CCPA/CPRA:
- Right to Know (§ 1798.100) — You have the right to request that we disclose the categories and specific pieces of personal information collected about you, the categories of sources, the business or commercial purpose for collecting or selling the information, and the categories of third parties with whom the information is shared. This document and our Privacy Policy provide this disclosure.
- Right to Delete (§ 1798.105) — You have the right to request deletion of personal information we have collected about you. Because Strategia-X does not hold your personal information on our servers, all locally stored App data can be deleted immediately through Android Settings > Apps > DeviceLab Monitor > Storage > Clear Data. For AdMob-collected data, submit deletion requests directly to Google.
- Right to Correct (§ 1798.106) — You have the right to request correction of inaccurate personal information. Contact us at [email protected].
- Right to Opt-Out of Sale or Sharing (§ 1798.120) — You have the right to opt out of the sale or sharing of your personal information. We do not sell personal information. To opt out of sharing for cross-context behavioral advertising, use the methods described in Section 16.4.
- Right to Limit Use of Sensitive Personal Information (§ 1798.121) — You have the right to direct us to limit the use and disclosure of sensitive personal information to that necessary to perform the services requested. DeviceLab Monitor does not collect sensitive personal information as defined under the CPRA (§ 1798.140(ae)).
- Right to Non-Discrimination (§ 1798.125) — We will not discriminate against you for exercising any of your CCPA/CPRA rights. You will not be denied goods or services, charged different prices, or provided a different level or quality of the App as a result of exercising your rights.
- Right to Appeal — If we deny your privacy rights request, you have the right to appeal our decision by contacting [email protected] with "CCPA Privacy Appeal" in the subject line.
16.6 How to Submit a CCPA/CPRA Request
To submit a verifiable consumer request, email [email protected] with subject line "CCPA Privacy Request." Your request must include: (a) your request type (Know, Delete, Correct, Opt-Out); (b) sufficient information to allow us to reasonably verify that you are the California resident about whom we collected personal information. We will respond to verifiable consumer requests within 45 days as required by § 1798.130. We may extend this period by an additional 45 days when reasonably necessary, with prior notice. You may designate an authorized agent to make a request on your behalf in accordance with § 1798.135.
16.7 Financial Incentives
Strategia-X does not offer any financial incentives, price differences, or service differences in exchange for the collection or retention of your personal information. The App is provided free to all users equally.

In addition to the CCPA/CPRA addressed in Section 16, Strategia-X recognizes and seeks to comply with the following enacted state consumer privacy laws to the extent applicable based on user residency, processing volume thresholds, and other statutory criteria:

17.2 Common Rights Under State Privacy Laws
Depending on the state in which you reside, you may have some or all of the following rights with respect to your personal data:
- Right to Access — Confirm whether we process personal data about you and obtain a copy of that data.
- Right to Correct — Request correction of inaccurate personal data we hold about you.
- Right to Delete — Request deletion of personal data we have collected about you.
- Right to Data Portability — Obtain a portable copy of your personal data in a readily usable format.
- Right to Opt-Out of Targeted Advertising — Opt out of the processing of your personal data for the purposes of targeted (interest-based) advertising.
- Right to Opt-Out of Sale of Personal Data — Opt out of the sale of your personal data to third parties. Strategia-X does not sell personal data.
- Right to Opt-Out of Profiling — Opt out of profiling in furtherance of decisions that produce legal or similarly significant effects. DeviceLab Monitor does not engage in such profiling.
- Right to Appeal — Appeal our decision if we decline to act on a privacy rights request.
- Right to Non-Discrimination — Not be discriminated against for exercising privacy rights.
17.3 CalOPPA Compliance
In accordance with the California Online Privacy Protection Act (CalOPPA), Cal. Bus. & Prof. Code §§ 22575–22579:
- Users can download and use DeviceLab Monitor without providing personal information or creating an account.
- Our Privacy Policy is accessible from within the App and linked from the Google Play Store listing. The link includes the word "Privacy" and can be easily found.
- Users will be notified of material Privacy Policy changes through an update to the Policy's "Last updated" date and, for significant changes, through an in-App notice or Google Play Store update.
- Users can change their ad personalization preferences at any time through their device's advertising settings or the in-App UMP consent controls.
Do Not Track (DNT): DeviceLab Monitor does not track users across third-party websites or online services and therefore does not respond to browser-level DNT signals. Google AdMob may respond to DNT signals and other privacy settings — refer to Google's privacy controls for details.
17.4 COPPA Compliance
In compliance with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506:
- DeviceLab Monitor is not directed at children under the age of 13 and is not marketed to children.
- We do not knowingly collect, use, or disclose personal information from children under 13.
- Because the App does not require account registration and does not collect personal information directly from users of any age, there is no mechanism through which a child under 13 would knowingly provide personal information to Strategia-X through the App.
- Advertisements displayed through Google AdMob are served in compliance with Google's policies governing child-directed content and mixed-audience apps.
- If we become aware that personal information has been inadvertently collected from a child under 13, we will take prompt steps to delete such information. Contact us immediately at [email protected] if you believe a child under 13 has provided personal information through the App.
- Parents and guardians are encouraged to use Android's parental controls and Google Family Link to manage their child's use of applications and advertising settings.
17.5 How to Exercise State Privacy Rights
To exercise any privacy right under the state laws listed in Section 17.1, or to submit an appeal of a denied request, contact us at: [email protected] with the subject line "State Privacy Request — [Your State]." Include your state of residence, the specific right you are exercising, and sufficient identifying information. We will respond within the timeframe required by the applicable state law. For appeal requests, use subject line "Privacy Rights Appeal — [Your State]."
Because DeviceLab Monitor stores all monitoring data locally on your device and Strategia-X does not hold personal data on our servers, many privacy rights (access, portability, deletion) are exercisable directly by you through your device's settings without needing to contact us.
18. International Users
18.1 Global Availability
DeviceLab Monitor is available globally through the Google Play Store, subject to geographic restrictions applied by Google Play. Strategia-X makes no representation that the App is appropriate or available for use in any particular location. If you access the App from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
18.2 Cross-Border Data Processing
Because DeviceLab Monitor processes all device monitoring data locally on your device and does not transmit it to Strategia-X's servers, no cross-border transfer of your monitoring data occurs. Google AdMob may transfer advertising-related data internationally as described in Section 15.8. Such transfers are governed by Google's privacy policies and applicable data transfer mechanisms.
18.3 Compliance with Local Laws
You are responsible for complying with all laws and regulations applicable to your use of DeviceLab Monitor in your jurisdiction, including privacy laws, data protection laws, consumer protection laws, and any laws governing software applications or system monitoring tools. This includes, without limitation:
- Brazil — Lei Geral de Proteção de Dados (LGPD), Lei No. 13.709/2018. Brazilian residents may have rights to access, correct, delete, anonymize, port, and object to processing of their personal data under the LGPD.
- Canada — Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation (e.g., Quebec's Law 25). Canadian residents may have rights to access and correct their personal information.
- Australia — Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Australian residents may have rights to access and correct personal information.
- Japan — Act on the Protection of Personal Information (APPI). Japanese residents may have rights regarding the handling of their personal information.

18.4 Governing Language
These Terms are provided in the English language. Users accessing the App from non-English-speaking jurisdictions should be aware that any translations of these Terms are provided for convenience only and that the English version controls in the event of any inconsistency.
19. Third-Party Services
19.1 Google Play Store
DeviceLab Monitor is distributed through the Google Play Store, operated by Google LLC. Your download, installation, and use of the App is subject to Google Play's Terms of Service. Strategia-X is not responsible for issues arising from Google Play's distribution infrastructure, including download failures, update delivery delays, or Play Store availability interruptions.
19.2 Google AdMob
Advertisement serving within DeviceLab Monitor is provided by Google AdMob, a service of Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). AdMob displays banner and interstitial advertisements within the App. AdMob may collect device identifiers, IP addresses, ad interaction data, and other information as described in Section 7. Strategia-X does not control the content, selection, or data practices of Google AdMob advertisements. For information about Google AdMob's data practices, please review Google's Privacy Policy and Google AdMob's help documentation.
19.3 Google User Messaging Platform (UMP)
We use the Google User Messaging Platform (UMP) to present advertising consent dialogs to users in jurisdictions that require consent for personalized advertising, including users in the EEA and UK under GDPR, and in accordance with Google's EU User Consent Policy and CCPA requirements. UMP collects and stores your consent preferences locally on your device and communicates those preferences to Google AdMob to govern personalized vs. non-personalized ad serving. UMP's operation is governed by Google's Privacy Policy.
19.4 Libraries That Do Not Collect Data
The following third-party libraries are integrated into DeviceLab Monitor to provide core application functionality. These libraries do not collect, transmit, or share user data:
- Jetpack Compose — Google's modern declarative UI toolkit for building native Android interfaces.
- Room Persistence Library — Jetpack's SQLite database abstraction layer. All data stored in the Room database remains exclusively on your device.
- Jetpack DataStore — Type-safe, coroutine-based local storage for user preferences and settings.
- Hilt (Dagger) — Android dependency injection framework. Does not handle or transmit user data.
- Kotlin Coroutines — Asynchronous programming framework for structured concurrency.
- Material Design 3 — Google's UI component library implementing Material You design system.
- WorkManager — Jetpack library for scheduling and managing deferrable background monitoring tasks. All background tasks run locally.
19.5 Third-Party Links in Advertisements
Advertisements displayed within DeviceLab Monitor by Google AdMob may contain links to third-party websites or applications. Strategia-X does not control, endorse, review, or assume any responsibility for third-party websites, their content, their products or services, or their privacy practices. Accessing any third-party link from within the App is at your own risk. We encourage you to review the privacy policies and terms of service of any third-party sites you visit.
19.6 No Affiliation
The mention of Google, Google AdMob, Google User Messaging Platform, Google Play, or any other third-party service in these Terms or within the App does not constitute an endorsement, sponsorship, or affiliation between Strategia-X and those parties. All third-party trademarks and service marks are the property of their respective owners.
20. Updates and Modifications
20.1 App Updates
Strategia-X may release updates, patches, bug fixes, new features, or other modifications to DeviceLab Monitor from time to time through the Google Play Store. These updates may be required to continue using certain features of the App. You agree that we may automatically update the App on your device if you have automatic app updates enabled in Google Play Settings.
20.2 Impact of Updates
App updates may:
- Add new features or monitoring capabilities
- Modify, discontinue, or remove existing features
- Change the visual design, user interface, or navigation structure
- Modify the permissions requested by the App
- Change advertising behavior, ad frequency, or ad formats
- Update the App's minimum or target Android API level
- Affect the App's compatibility with specific devices or Android versions
We are not liable for any changes to features resulting from App updates. We will endeavor to maintain backward compatibility with locally stored data across updates.
20.3 Discontinuation
We reserve the right to discontinue DeviceLab Monitor or any of its features at any time, with or without notice. If we discontinue the App, all locally stored data will remain on your device until you uninstall the App or clear its data. We will not be liable for any losses arising from the discontinuation of the App.
20.4 Modifications to Third-Party Services
Changes made by Google to AdMob, the User Messaging Platform, Google Play, or any other third-party service used by the App may affect the App's functionality. Strategia-X is not responsible for the consequences of changes made by third-party service providers.
21. Termination
21.1 Your Right to Terminate
You may stop using DeviceLab Monitor and terminate this Agreement at any time by uninstalling the App from your device. There are no subscriptions or recurring charges associated with the App, so uninstalling it immediately ends any ongoing use. Uninstalling the App will permanently delete all locally stored data associated with it, including performance history, analytics records, and benchmark results.
21.2 Our Right to Terminate or Suspend
Strategia-X reserves the right to suspend or terminate your access to DeviceLab Monitor, in whole or in part, at any time and for any reason, including but not limited to:
- Your violation of any provision of these Terms
- Conduct that Strategia-X determines, in its sole and reasonable discretion, is harmful to other users, to Strategia-X, or to third parties
- Legal or regulatory requirements compelling suspension or termination
- Discontinuation of the App as described in Section 20.3
- Removal of the App from the Google Play Store for any reason
21.3 Effect of Termination
Upon termination of these Terms for any reason:
- The license granted to you under Section 9 is immediately and automatically revoked.
- You must immediately cease all use of DeviceLab Monitor and uninstall it from all devices.
- Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 8, 9.2, 12, 13, 15, 16, 17, 22, and 23.
21.4 No Liability for Termination
Strategia-X shall not be liable to you or to any third party for any consequences arising from the termination or suspension of your access to DeviceLab Monitor, including any loss of locally stored monitoring data, analytics, or benchmark records.
22. Governing Law and Dispute Resolution
22.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without giving effect to any choice of law or conflict of law rules, provisions, or principles that would cause the application of the laws of any other jurisdiction.
22.2 Informal Dispute Resolution
Before initiating any formal dispute resolution proceeding, you agree to first contact Strategia-X at [email protected] with subject line "Dispute Resolution" and provide a written description of the dispute, the relief sought, and your contact information. You agree to negotiate in good faith for at least 30 days following submission of your written notice. Most disputes can and should be resolved without formal proceedings.
22.3 Binding Arbitration
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or DeviceLab Monitor (including claims regarding the formation, validity, enforceability, revocability, scope, or breach of these Terms) shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by these Terms. The arbitration shall be conducted in English.
- Arbitration shall take place in the State of Delaware, United States, or, at your election, via telephone, video conference, or document submission for disputes involving claims of $10,000 or less.
- The arbitrator's decision shall be final and binding on both parties.
- Judgment on the arbitration award may be entered in any court of competent jurisdiction.
- Each party shall bear its own costs and attorneys' fees, unless the arbitrator determines that a claim or defense was frivolous or brought in bad faith.
22.4 Class Action Waiver
YOU AND STRATEGIA-X AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
22.5 Small Claims Court Exception
Either party may bring an individual action in small claims court for disputes that qualify within the jurisdictional limits of such court, provided the action remains in that court and is not removed or appealed to a court of general jurisdiction.
22.6 Intellectual Property Exception
Notwithstanding the arbitration agreement in Section 22.3, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidential information, or trade secrets.
22.7 European Union and EEA Residents
If you are a resident of the European Union or European Economic Area and these Terms are governed by EU law, you may have the right to bring claims before the courts of your country of residence and may be entitled to submit disputes to the European Commission's Online Dispute Resolution (ODR) platform, accessible at ec.europa.eu/consumers/odr. EU consumer mandatory law provisions that cannot be derogated from by agreement apply regardless of the choice of governing law.
22.8 Time Limitation
Any claim or cause of action arising out of or related to your use of DeviceLab Monitor or these Terms must be filed within one (1) year after the cause of action accrued, or it shall be forever barred. This limitation applies regardless of any statute of limitations that would otherwise apply under applicable law.
23. Severability
23.1 Severability of Provisions
If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, void, unenforceable, or contrary to applicable law, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent and purpose as closely as possible. The modified provision, or if modification is not possible, its deletion, shall not affect the validity or enforceability of any other provision of these Terms.
23.2 Remaining Provisions
All remaining provisions of these Terms shall continue in full force and effect and shall be construed to give maximum effect to the intent of the parties as reflected in these Terms. The invalidity or unenforceability of any provision shall not affect the Agreement as a whole.
23.3 Waiver
The failure of Strategia-X to enforce any right or provision of these Terms shall not constitute a present or future waiver of such right or provision, nor shall it limit Strategia-X's right to enforce such right or provision at a later time. Any waiver of any right or provision must be in writing and signed by an authorized representative of Strategia-X to be effective.
23.4 General Provisions
- Entire Agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and Strategia-X regarding DeviceLab Monitor and supersede all prior and contemporaneous agreements, understandings, negotiations, and communications, whether written or oral, between you and Strategia-X relating to the App.
- Assignment — You may not assign, delegate, or transfer these Terms, your rights under these Terms, or your license to use the App to any third party without Strategia-X's prior written consent. Strategia-X may freely assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets. These Terms bind and inure to the benefit of the parties and their respective permitted successors and assigns.
- Force Majeure — Strategia-X shall not be liable for any delay or failure to perform any obligation under these Terms arising from causes beyond Strategia-X's reasonable control, including but not limited to: natural disasters, acts of God, epidemics or pandemics, war, terrorism, civil unrest, government actions or regulations, power outages, internet infrastructure failures, cyberattacks, third-party service outages (including Google Play and Google AdMob), or any other event of force majeure.
- No Third-Party Beneficiaries — These Terms do not and are not intended to confer any rights or remedies upon any third party. Google LLC is not a party to these Terms and has no obligations, liabilities, or rights under these Terms.
- Relationship of Parties — Nothing in these Terms creates, or shall be construed as creating, any partnership, joint venture, agency relationship, employment relationship, or franchise relationship between you and Strategia-X.
- Headings — Section headings in these Terms are included for convenience only and do not affect the meaning or interpretation of any provision.
- Electronic Communications — By using DeviceLab Monitor, you acknowledge and agree that these Terms, our Privacy Policy, and any notices or disclosures delivered electronically (through the App, the Google Play Store, or our website) satisfy any legal requirement that such communications be in writing.
- Notices — We may provide notices to you through in-App messages, dialogs, banners, the Google Play Store listing, or on our website. Notices to Strategia-X must be submitted using the contact information in Section 25.
24. Changes to These Terms
24.1 Right to Modify
Strategia-X reserves the right to modify, revise, update, or replace any provision of these Terms at any time, in our sole discretion. We may make changes for any reason, including to reflect changes in applicable law or regulation, changes in the App's features or business model, changes in our advertising practices, or for other operational reasons.
24.2 Notification of Changes
When we make changes to these Terms, we will update the "Last updated" date shown at the top of this document. For material changes that significantly affect your rights or obligations, we will endeavor to provide notice through one or more of the following methods:
- A prominent notice or dialog displayed within the App at launch
- An update to the Terms accessible through the App's legal or settings section
- An update to the Google Play Store listing description or "What's New" section
- A notice on our website at www.strategia-x.com
24.3 Acceptance of Changes
Your continued download, installation, or use of DeviceLab Monitor after the effective date of any changes to these Terms constitutes your acceptance of and agreement to be bound by the revised Terms. If you do not agree with the changes, you must stop using the App and uninstall it from your device before the changes take effect. We encourage you to review these Terms periodically.
