These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("you," "your," "User") and Strategia-X ("we," "us," "our," "Company") governing your access to and use of the DeviceLab Tradesman mobile application ("DeviceLab Tradesman," "the App," "the Service"), including all features, measurement tools, device diagnostics, monitoring capabilities, and services provided through the App.
By downloading, installing, accessing, or using DeviceLab Tradesman, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the App.

IMPORTANT SAFETY NOTICE: The measurement tools in DeviceLab Tradesman (including but not limited to the digital protractor, inclinometer, decibel meter, compass, luminescence meter, and related sensor-based instruments) provide APPROXIMATE readings derived from your mobile device's built-in sensors. These readings are NOT equivalent to those produced by certified, calibrated professional instruments. You must NOT rely on these readings for any safety-critical, structural, electrical, regulatory, or professional decision-making without independent verification using properly calibrated instruments. See Section 12 for the full disclaimer.

1. Acceptance of Terms
1.1 Agreement to Terms
By downloading DeviceLab Tradesman from the Google Play Store, installing it on your device, launching it for the first time, or using any feature of the App, you expressly agree to be legally bound by these Terms, our Privacy Policy, and any additional guidelines, policies, or rules referenced herein, all of which are incorporated into this Agreement by reference.
If you do not agree to all of the Terms, you are not permitted to access or use the App. Your continued use of the App after any modification to these Terms constitutes binding acceptance of the revised Terms.
1.2 Capacity to Contract
You represent and warrant that you have the legal capacity to enter into this Agreement. If you are using the App on behalf of an organization, employer, or business entity, you represent and warrant that you are authorized to bind that entity to these Terms, and references to "you" in these Terms shall include that entity.
1.3 Electronic Agreement
You acknowledge that these Terms constitute an electronic agreement and that your acceptance is as legally binding as a handwritten signature. No physical signature is required. The act of installing, launching, or using the App constitutes your electronic signature and acceptance of this Agreement.
1.4 Supersession
These Terms supersede any prior agreements, understandings, representations, or warranties between you and Strategia-X relating to the App, whether oral or written.
2. Eligibility
2.1 Minimum Age — General
DeviceLab Tradesman is designed for professional tradesmen, contractors, construction workers, and skilled laborers. You must be at least 13 years of age to use the App. If you are under 13, you are not permitted to download, install, or use the App under any circumstances, and any such use is a material breach of these Terms.
2.2 Parental or Guardian Consent — Ages 13 to 15 (GDPR Article 8)
If you are at least 13 but under 16 years of age and are located in a Member State of the European Economic Area ("EEA"), the United Kingdom, or another jurisdiction that requires parental or guardian consent for digital services under applicable data protection law (including GDPR Article 8), you must obtain verifiable consent from a parent or legal guardian before using the App. By using the App, you represent either that you are 16 or older, or that your parent or legal guardian has reviewed and agreed to these Terms on your behalf and has provided the consent required by applicable law.
2.3 Professional Context and Age of Majority
Given that the App is intended for use in professional trade and construction environments that may involve physical hazards, power tools, or safety-sensitive tasks, we strongly recommend that the App be used by adults who have reached the age of majority in their jurisdiction. If you are a minor and intend to use the App in a professional or construction context, your parent or legal guardian should review these Terms and in particular the disclaimers in Section 12 before permitting such use.
2.4 Jurisdiction Compliance
You represent and warrant that your use of the App complies with all applicable local, state, national, and international laws and regulations. If access to or use of the App is prohibited by law in your jurisdiction, you are not authorized to use the App.
2.5 Google Play Store Requirements
Your eligibility to download and install the App is also subject to the Google Play Store Terms of Service. DeviceLab Tradesman is rated for audiences aged 13 and older on the Google Play Store in accordance with applicable content rating guidelines.
3. Description of Service
3.1 Overview
DeviceLab Tradesman is a comprehensive Android application built with Kotlin and Jetpack Compose. It is designed specifically for tradesmen, contractors, construction professionals, electricians, plumbers, carpenters, HVAC technicians, and other skilled workers. The App integrates two primary categories of tools: (a) professional-grade measurement instruments powered by the device's onboard sensors, and (b) an advanced suite of device monitoring, diagnostic, and optimization utilities.
3.2 Measurement Tools
The following sensor-based measurement instruments are provided within the App. Each tool utilizes your Android device's built-in hardware sensors and produces approximate, informational readings only. See Section 12 for the full measurement accuracy disclaimer.
- Digital Protractor (Camera-Based Angle Measurement) — Uses the device camera and computer vision analysis to measure and display angles. The camera feed is processed in real-time; no photos or videos are captured, stored, or transmitted.
- Digital Compass — Uses the device magnetometer to display magnetic heading, bearing, and cardinal direction. Location permission is used in real-time to facilitate accurate SSID-related functionality; location data is never stored.
- Digital Inclinometer (Pitch/Roll Leveling) — Uses the accelerometer and gyroscope to measure the device's pitch and roll angles relative to the horizontal plane for leveling and inclination tasks.
- Luminescence Meter — Uses the ambient light sensor to display light intensity readings in lux for assessing lighting conditions in workspaces.
- Decibel Meter — Uses the device microphone to display real-time sound pressure levels in decibels (dB). Microphone input is processed in real-time; no audio is recorded, stored, or transmitted.
- Accelerometer Monitor — Displays real-time linear acceleration data across three axes (X, Y, Z) using the device's accelerometer sensor.
- Gyroscope Monitor — Displays real-time rotational velocity and orientation changes using the device's gyroscope sensor.
- G-Force Meter — Calculates and displays the combined gravitational force vector acting on the device using accelerometer data.
- Component Temperature Monitor — Reads and displays internal hardware component temperature zones (CPU, battery, etc.) from the device's thermal management system where supported by the hardware.
- QR Code Scanner — Uses the device camera to scan and decode QR codes and barcodes in real-time. No images are stored or transmitted.
3.3 Device Monitoring and Management Tools
The App provides the following device performance, diagnostic, and management utilities, all of which operate locally on your device:
- Live Monitor — Real-time dashboard displaying CPU usage (per-core), RAM utilization, storage, battery level and health, thermal readings, and system uptime.
- Floating Overlay — A system-overlay widget (requiring SYSTEM_ALERT_WINDOW permission) that displays live performance metrics over other running applications.
- Home Screen Widgets — Configurable Android home screen widgets displaying real-time or recent device performance statistics.
- RAM Booster — Identifies and terminates background processes to free available system memory.
- Cache Cleaner — Identifies and provides options to clear cached application data to recover storage space.
- Storage Analysis — Analyzes storage usage by file type, category, and application. File metadata (size, type, date) is analyzed; no file contents are read.
- Duplicate File Detection — Identifies potentially duplicate files based on size and metadata for the purpose of storage reclamation.
- Battery Saver — Provides battery conservation recommendations and optimization actions based on current usage patterns.
- Battery Analyzer — Displays detailed battery health metrics, charge cycles, capacity, voltage, and temperature over time.
- Charging Analyzer — Monitors and displays charging rate, efficiency, and charging session statistics.
- Wake Lock Detection — Identifies processes and applications that are holding wake locks, preventing the device from entering sleep states.
- Startup Optimization and Boot Analysis — Displays applications configured to run at device startup and provides analysis of boot-time resource consumption.
- Thermal Monitor — Displays detailed thermal zone readings across CPU, battery, and other hardware components.
- Display Tester — Tests screen uniformity, dead pixels, color accuracy, and touch responsiveness.
- Touch Tester — Tests multi-touch accuracy and sensitivity across the display surface.
- Speaker Tester — Plays test tones to verify speaker functionality and audio output quality.
- Sensor Tester — Displays live readings from all sensors available on the device for diagnostic purposes.
- Vibration Tester — Tests vibration motor functionality and patterns.
- CPU Benchmark — Runs standardized computational benchmarks to measure CPU performance and stores scores locally.
- Memory Benchmark — Tests RAM read/write throughput and latency.
- Storage Benchmark — Tests internal storage sequential and random read/write performance.
- App Manager — Lists installed applications with metadata including size, version, and installation date, enabling management of installed packages.
- Permissions Analyzer — Displays and categorizes permissions held by each installed application.
- Process Monitor — Displays currently running processes and their system resource consumption.
- Screen Time — Tracks and displays per-application foreground usage time statistics using Android's UsageStatsManager.
- Network Monitor — Displays real-time network usage, connection type, signal strength, IP address information, and data consumption statistics.
- Wi-Fi Spectrum Analyzer — Scans and displays nearby Wi-Fi networks, their signal strengths, channels, and frequency band usage.
- Bluetooth Spectrum Scanner — Scans for nearby Bluetooth devices and displays signal strength and connection information.
- Speed Test — Measures current internet download and upload speeds and latency using a network connection.
- Data Export — Allows you to export your locally stored performance data to external storage for personal backup or analysis.
- Weekly Health Reports — Generates on-device weekly summaries of device performance trends, health metrics, and usage statistics.
- Analytics Dashboard — Visualizes historical performance data through charts and trend graphs derived from locally stored snapshots.
3.4 Technical Platform
The App requires Android 7.0 (API 24) or higher and is optimized for Android 15 (API 35). Certain features may require specific hardware capabilities (e.g., barometric pressure sensor, gyroscope, specific thermal zone support) that are not present on all Android devices. The App will gracefully disable features for which the required hardware is unavailable.
3.5 Service Evolution
We reserve the right to add, modify, suspend, or remove features, tools, and capabilities of the App at any time, with or without notice, in order to improve the service, address technical issues, or comply with applicable law. See Section 20 for the full policy on updates and modifications.
4. Accounts and Registration
4.1 No Account Required
DeviceLab Tradesman does not require you to create a user account, register with Strategia-X, or provide any personal identification information in order to download, install, or use any feature of the App. All functionality is available without registration of any kind.
4.2 No Authentication or Credentials
The App does not collect, store, or transmit usernames, passwords, email addresses, phone numbers, or any other authentication credentials. There is no login system, no user profile, and no account management portal associated with the App.
4.3 On-Device Identity
All user preferences, settings, locally stored data, and configuration are tied to the App's installation on your specific device. This data is stored in an encrypted local database and encrypted shared preferences on your device and is never synced to any account or cloud service. Uninstalling the App permanently removes all locally stored data.
4.4 Google Play Account
To download the App from the Google Play Store, you must have a valid Google account. Your Google account is managed entirely by Google LLC and is subject to Google's own Terms of Service and Privacy Policy. Strategia-X has no access to your Google account credentials or account data.
5. Subscriptions and Purchases
5.1 Free Application — No Purchases
DeviceLab Tradesman is provided free of charge. The App does not offer, and you cannot make, any in-app purchases, premium upgrades, subscription plans, consumable items, virtual currency, or any other form of paid transaction through the App.
5.2 No Billing Information
Because no purchases of any kind are available within the App, we do not collect, process, or store any payment card information, billing addresses, bank account details, or any other financial data. No payment processor is integrated into the App.
5.3 Revenue Model
The App is supported by advertising revenue generated through Google AdMob banner and interstitial advertisements. See Section 7 for a full description of how advertising works within the App and the choices available to you.
5.4 Future Changes
We reserve the right to introduce optional paid features, subscription tiers, or in-app purchases in future versions of the App. If we introduce any such features, we will update these Terms accordingly and provide notice as described in Section 24. Any paid features will be clearly disclosed before any purchase is required.
6. Free Features
6.1 Complete Feature Access
All features of DeviceLab Tradesman are available to all users at no cost. There are no locked features, paywalls, premium tiers, feature gating, trial periods, or feature expiration mechanisms of any kind. The full suite of measurement tools, device monitoring utilities, diagnostic instruments, optimization tools, and reporting capabilities described in Section 3 is accessible to every user immediately upon installation.
6.2 Availability and Limitations
Access to specific features is subject to the hardware capabilities of your Android device. Features requiring sensors not present on your device (e.g., barometric pressure sensor, specific thermal probes) will be gracefully unavailable. Similarly, features requiring specific Android permissions that you choose not to grant will be unavailable until those permissions are granted. The unavailability of a feature due to hardware or permission constraints does not constitute a breach of these Terms.
6.3 Advertisement-Supported Service
The free provision of all features is supported by contextual and personalized advertisements served by Google AdMob. By using the App, you acknowledge and agree that advertisements are a component of the free service experience. You may choose non-personalized ads through the consent dialog or device settings as described in Section 7, but advertisement display itself is an inherent part of the free App experience.
6.4 No Guaranteed Uptime or Continuity
While we strive to maintain the App and its features in full working order, we do not guarantee that any specific feature will be continuously available, uninterrupted, or error-free. We reserve the right to modify, suspend, or discontinue any feature as described in Section 20.
7. Advertising
7.1 Google AdMob
DeviceLab Tradesman displays advertisements powered by Google AdMob, a third-party advertising platform operated by Google LLC. The App serves both banner advertisements (displayed within the App interface) and interstitial advertisements (full-screen ads displayed at natural transition points within the App experience).
7.2 Google User Messaging Platform (UMP) and Consent
The App integrates the Google User Messaging Platform (UMP) SDK to collect your informed consent for personalized advertising in compliance with the EU General Data Protection Regulation (GDPR), the IAB Europe Transparency and Consent Framework (TCF), the California Consumer Privacy Act (CCPA), and other applicable privacy regulations. When you first launch the App (or when required by regulation), a consent dialog will be presented to you explaining the types of data used for advertising and requesting your choice regarding personalization.
7.3 Personalized vs. Non-Personalized Advertising
You have the right to choose how advertisements are served to you:
- Personalized Advertising — If you consent, AdMob may use your advertising identifier, general device information, and interaction data to serve advertisements tailored to your inferred interests.
- Non-Personalized Advertising — If you decline consent or withdraw it, advertisements will be served based on contextual signals (such as app category) rather than your personal profile. Some data collection by Google may still occur for fraud prevention, frequency capping, and regulatory compliance purposes.
7.4 Withdrawing or Updating Consent
You may withdraw or update your advertising consent at any time through the following methods:
- In-App Consent Dialog — Revisit your advertising preferences through the App's settings menu (where available).
- Android Ad Settings — Navigate to Android Settings > Google > Ads and enable "Opt out of Ads Personalization" or reset your advertising ID.
- Google Privacy Controls — Visit adssettings.google.com to manage your Google ad personalization preferences.
7.5 Data Collected by AdMob
Strategia-X does not directly collect advertising data. Google AdMob independently may collect the following categories of information as governed by Google's Privacy Policy:
- Device advertising identifier (Google Advertising ID / GAID)
- Device model, manufacturer, operating system version, and screen resolution
- General location at the country or region level (not precise GPS coordinates)
- IP address (used for general geolocation and fraud prevention)
- Ad impression, click, and interaction events
We do not sell, share, or provide any device data, sensor data, or measurement data to Google AdMob or any other advertising partner. The data that AdMob collects is governed exclusively by Google's own privacy policies and terms.
7.6 Third-Party Advertiser Terms
Clicking on advertisements within the App may direct you to third-party websites, applications, or services operated by advertisers. Strategia-X is not responsible for the content, privacy practices, or terms of service of any third-party advertiser or destination. Your interactions with advertisements and advertiser content are governed by the terms and policies of those third parties.
7.7 No Sale of Personal Information
Strategia-X does not sell your personal information to any third party, including advertisers. AdMob's data practices are governed by Google's own terms and policies, not by Strategia-X's commercial arrangements.
8. User Content and Intellectual Property
8.1 No User-Generated Content Submission
DeviceLab Tradesman does not provide any mechanism for users to upload, submit, publish, share, post, or transmit content to Strategia-X's servers, to other users, or to any third-party platform through the App. There is no community feature, messaging system, content sharing functionality, or user-facing content repository.
8.2 Locally Generated Data
Data generated through your use of the App — including measurement readings, performance snapshots, benchmark results, analytics data, and exported files — belongs to you and is stored exclusively on your device. Strategia-X has no access to this data and makes no claim of ownership over it. You are solely responsible for any data you choose to export, share, or transmit externally using the App's data export functionality or otherwise.
8.3 Feedback and Suggestions
If you choose to submit feedback, bug reports, feature requests, or other suggestions to Strategia-X through email or any other channel, you grant us a worldwide, royalty-free, irrevocable, perpetual, sublicensable license to use, reproduce, modify, adapt, publish, and incorporate that feedback into our products and services without any obligation to compensate you or attribute the feedback to you. You represent that any such feedback does not contain confidential information or information belonging to a third party.
8.4 Strategia-X Intellectual Property
The App, its source code (written in Kotlin using Jetpack Compose), interface designs, graphics, icons, logos, brand elements, feature names, documentation, algorithms, and all other components of DeviceLab Tradesman are the exclusive intellectual property of Strategia-X and are protected by copyright, trademark, trade secret, patent, and other applicable intellectual property laws. The Strategia-X name and logo are trademarks of Strategia-X.
You may not reproduce, copy, modify, distribute, transmit, display, publish, create derivative works from, or exploit any portion of the App or its intellectual property without the express prior written consent of Strategia-X, except as expressly permitted by these Terms or applicable law.
8.5 Third-Party Intellectual Property
The App may incorporate open-source libraries and third-party components, each of which is subject to its own license terms. Open-source components used in the App include Jetpack Compose, Room, SQLCipher, AndroidX Security, Jetpack DataStore, Hilt, Kotlin Coroutines, Material Design 3, WorkManager, and MPAndroidChart, among others. Use of these components is governed by their respective open-source licenses, which are separate from and do not expand the rights granted to you under these Terms.
9. License Grant to You
9.1 Limited License
Subject to your compliance with these Terms, Strategia-X grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited license to:
- Download and install one copy of the App on an Android device that you own or lawfully control;
- Access and use the App solely for your own personal and professional trade-related purposes in accordance with these Terms; and
- Access and use the documentation and any other materials made available by Strategia-X in connection with the App.
9.2 Restrictions
This license does not permit you to:
- Copy, reproduce, redistribute, or resell the App or any portion thereof;
- Modify, adapt, translate, or create derivative works based on the App or any portion of its source code;
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent expressly permitted by applicable law;
- Remove, obscure, or alter any copyright notices, trademarks, proprietary legends, or other intellectual property notices contained in the App;
- Sublicense, sell, rent, lease, transfer, assign, or otherwise commercially exploit the App or your rights under these Terms;
- Use the App to develop a competing application, product, or service;
- Use automated tools, scripts, bots, or crawlers to access, scrape, or extract data from the App; or
- Use the App in any manner that violates applicable laws or these Terms.
9.3 Google Play Store Distribution
Your use of the App is also governed by the Google Play Store Terms of Service. In the event of any conflict between Google Play's Terms of Service and these Terms, these Terms shall govern the relationship between you and Strategia-X, and Google Play's Terms shall govern the relationship between you and Google LLC.
9.4 Reservation of Rights
All rights not expressly granted to you in these Terms are reserved by Strategia-X. No implied licenses are granted. Strategia-X retains all right, title, and interest in and to the App, including all intellectual property rights therein.
9.5 License Termination
This license is effective until terminated. It will terminate automatically, without notice from Strategia-X, if you fail to comply with any provision of these Terms. Upon termination, you must immediately cease all use of the App and uninstall it from all devices.
10. Acceptable Use
10.1 Permitted Uses
You may use DeviceLab Tradesman for lawful personal and professional purposes, including:
- Using the measurement tools (digital protractor, compass, inclinometer, luminescence meter, decibel meter, accelerometer, gyroscope, G-force meter, component temperature monitor) as informational aids to assist in trade and construction work, subject to the limitations and disclaimers set forth in Section 12;
- Scanning QR codes and barcodes for reference purposes;
- Monitoring and optimizing the performance of your Android device;
- Running hardware diagnostic tests on your personal or professionally-assigned device;
- Exporting and analyzing your own locally generated performance data; and
- Using the App's networking tools to assess the performance and environment of networks you are authorized to access.
10.2 Measurement Tool Usage Expectations
The measurement instruments within the App are powered by your mobile device's consumer-grade built-in sensors. By using any measurement tool, you acknowledge and agree to the following:
- Approximate Readings Only — All readings produced by the App's measurement tools are approximate values derived from consumer hardware sensors. These values may differ materially from readings produced by professionally calibrated instruments of the same type.
- Cross-Verification Required — For any task where measurement accuracy is important, readings from the App must be independently cross-verified using certified, calibrated professional instruments before being acted upon.
- Environmental Interference — Sensor readings may be affected by magnetic interference, vibration, device case thickness, device orientation, ambient conditions, hardware variation between manufacturers, and software processing inconsistencies. These factors are outside the control of Strategia-X.
- No Regulatory Compliance — Readings from the App are not certified by any standards body (e.g., NIST, ISO, CE, OSHA) and cannot be used to satisfy regulatory, legal, or contractual measurement requirements.
- Informational Supplement Only — The App's measurement tools are intended to serve as convenient informational supplements to — not replacements for — dedicated professional measuring instruments, levels, protractors, sound level meters, light meters, and similar tools.
10.3 Network and Bluetooth Tool Usage
You may only use the Wi-Fi Spectrum Analyzer, Bluetooth Spectrum Scanner, and Network Monitor features on networks and devices that you own, administer, or have explicit authorization to access and analyze. Using these tools to scan, probe, or analyze networks or devices without authorization may violate the Computer Fraud and Abuse Act (CFAA), the Electronic Communications Privacy Act (ECPA), and equivalent laws in other jurisdictions. Strategia-X is not responsible for any unlawful use of these features.
10.4 Device Management Features
Features such as the RAM Booster, Cache Cleaner, Startup Optimization, and App Manager modify system state or terminate processes on your device. You accept full responsibility for the consequences of using these features, including the potential loss of unsaved data in terminated applications, unintended changes to device behavior, and any negative effects on device functionality. Use these features on devices you own or are explicitly authorized to manage.
10.5 Compliance with Laws
You agree to use the App in full compliance with all applicable local, state, national, and international laws, regulations, and ordinances, including without limitation workplace safety regulations, occupational health laws, building codes, data protection laws, and telecommunications regulations.
11. Prohibited Conduct
11.1 Prohibited Activities
You agree that you will not, and will not permit others to:
- Use the App for any unlawful purpose or in violation of any local, state, national, or international law or regulation;
- Attempt to gain unauthorized access to any system, network, device, data, or account using any feature of the App;
- Use the Wi-Fi Spectrum Analyzer, Bluetooth Spectrum Scanner, or any networking feature to access, monitor, or interfere with networks or devices you are not authorized to access;
- Use the App to infringe upon the intellectual property rights, privacy rights, or other rights of any third party;
- Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code, algorithms, or trade secrets of the App;
- Distribute, sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App or any feature thereof;
- Modify, adapt, translate, or create derivative works based on the App;
- Use automated scripts, bots, crawlers, or other automated means to access, extract data from, or interact with the App;
- Interfere with, disrupt, or circumvent any security feature, rate limiting, or access control mechanism of the App;
- Use readings from the App's measurement tools to make, certify, or present claims about measurement accuracy in any regulatory, legal, insurance, or contractual context;
- Use or represent that any reading from the App meets the accuracy or reliability standards of a certified, calibrated professional instrument;
- Use the App in any manner that could damage, disable, overburden, or impair the App or the servers or networks used to deliver advertisements;
- Use the App to collect information about other individuals without their knowledge or consent;
- Use the Decibel Meter, microphone access, or any audio functionality to eavesdrop on, record, monitor, or intercept private communications of others without their consent;
- Use the Camera, protractor, or QR scanning features to photograph, record, or surveil individuals without their consent; or
- Impersonate Strategia-X, any Strategia-X employee, or any other person or entity.
11.2 Consequences of Prohibited Conduct
Violation of any provision of this Section 11 constitutes a material breach of these Terms and will result in the immediate termination of your license to use the App. Strategia-X reserves all rights and remedies available at law and in equity, including the right to seek injunctive relief and to report unlawful conduct to appropriate law enforcement authorities.
12. Disclaimers and Limitation of Liability
12.1 CRITICAL MEASUREMENT ACCURACY DISCLAIMER

THE MEASUREMENT TOOLS PROVIDED IN DEVICELAB TRADESMAN — INCLUDING THE DIGITAL PROTRACTOR, DIGITAL COMPASS, DIGITAL INCLINOMETER, DECIBEL METER, LUMINESCENCE METER, ACCELEROMETER, GYROSCOPE, G-FORCE METER, AND COMPONENT TEMPERATURE MONITOR — ARE POWERED BY THE BUILT-IN CONSUMER-GRADE SENSORS OF YOUR ANDROID MOBILE DEVICE. THESE TOOLS PRODUCE APPROXIMATE, INDICATIVE READINGS ONLY.
These sensor-based tools:
- Are NOT calibrated professional instruments and have NOT been tested, certified, or validated by any national or international standards body (including NIST, ISO, OSHA, CE, or any other authority);
- Do NOT provide measurement accuracy, repeatability, or traceability equivalent to certified, calibrated professional instruments of the same type;
- Are subject to significant error from magnetic interference (compass), vibration (inclinometer), ambient noise (decibel meter), light contamination (luminescence meter), device orientation, device case thickness, hardware manufacturing tolerances, and environmental conditions;
- Must NOT be relied upon for any safety-critical decision, including but not limited to: structural integrity assessments, load-bearing calculations, plumb and level determinations for permanent installations, electrical safety measurements, acoustic hazard assessments (e.g., OSHA noise exposure limits), fire code compliance, building code compliance, HVAC system design, or any other decision that affects personal safety or public safety; and
- Must NOT be used as the sole or primary basis for any professional, regulatory, contractual, or legal measurement requirement.
YOU ASSUME ALL RISK AND SOLE RESPONSIBILITY FOR ANY DECISIONS MADE, ACTIONS TAKEN, OR WORK PERFORMED IN RELIANCE ON MEASUREMENTS OR READINGS PRODUCED BY THE APP. STRATEGIA-X EXPRESSLY DISCLAIMS ALL LIABILITY FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGE, ECONOMIC LOSS, REGULATORY VIOLATION, OR ANY OTHER HARM ARISING FROM RELIANCE ON THE APP'S MEASUREMENT TOOLS.
The appropriate use of the App's measurement tools is as a convenient field reference aid to complement — never to replace — properly calibrated professional instruments, licensed professional judgment, applicable codes and standards, and sound engineering or trade practice.
12.2 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL OF ITS FEATURES, CONTENT, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS, IMPLIED, OR STATUTORY. STRATEGIA-X EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION:
- Any implied warranty of merchantability;
- Any implied warranty of fitness for a particular purpose;
- Any implied warranty of title or non-infringement;
- Any warranty that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components;
- Any warranty regarding the accuracy, reliability, completeness, or timeliness of any measurement, reading, data, result, or information produced by the App; and
- Any warranty that the App will meet your specific requirements, whether personal or professional.
Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the foregoing disclaimers apply to the maximum extent permitted by law.
12.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STRATEGIA-X, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR:
- Any indirect, incidental, special, consequential, punitive, or exemplary damages;
- Loss of profits, revenue, data, business, goodwill, or anticipated savings;
- Personal injury, death, or bodily harm arising from your use of or reliance on any measurement or reading produced by the App;
- Property damage arising from your use of or reliance on any measurement or reading produced by the App;
- Regulatory fines, penalties, or legal costs arising from reliance on the App's measurement tools for compliance purposes;
- Damage to your device resulting from App features that modify system state (e.g., RAM Booster, Cache Cleaner, Startup Optimization); or
- Any unauthorized access to or alteration of your data, even if Strategia-X has been advised of the possibility of such damages.
IN JURISDICTIONS WHERE EXCLUSION OF CONSEQUENTIAL OR INCIDENTAL DAMAGES IS NOT PERMITTED, STRATEGIA-X'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. BECAUSE THE APP IS PROVIDED FREE OF CHARGE, TO THE EXTENT STRATEGIA-X HAS ANY LIABILITY THAT CANNOT BE EXCLUDED, SUCH LIABILITY SHALL BE LIMITED TO ONE U.S. DOLLAR ($1.00).
12.4 Essential Basis of the Bargain
You acknowledge that the disclaimers and limitations in this Section 12 reflect a reasonable allocation of risk, form an essential basis of the bargain between you and Strategia-X, and that Strategia-X would not have provided the App free of charge without these limitations. The App would not be commercially feasible to provide without these protections.
12.5 Device Optimization Feature Risk
Features including the RAM Booster, Cache Cleaner, Startup Optimization, and similar system-modifying tools operate on your device's live system state. While we design these features to operate safely and only within the capabilities exposed by the Android operating system, Strategia-X is not responsible for any unintended consequences of their use, including loss of unsaved data, application crashes, changes to device behavior, or degradation of device performance.
13. Indemnification
13.1 Your Indemnification Obligation
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Strategia-X and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or relating to:
- Your use of or access to the App, including any measurement readings, data, or results you act upon;
- Your reliance on any measurement, reading, data, or output produced by any measurement tool in the App, including the digital protractor, inclinometer, decibel meter, compass, luminescence meter, accelerometer, gyroscope, G-force meter, or component temperature monitor;
- Any decision, professional recommendation, work product, construction activity, or trade action you take or cause others to take based on readings from the App;
- Your violation of any provision of these Terms;
- Your violation of any applicable law, regulation, ordinance, code, or third-party right in connection with your use of the App;
- Your use of the App's networking, Bluetooth, or Wi-Fi scanning features to access networks or devices you are not authorized to access; or
- Any feedback, suggestion, or content you submit to Strategia-X.
13.2 Indemnification Procedure
Strategia-X reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate fully with Strategia-X's defense of any such claim. You will not settle any claim without Strategia-X's prior written consent.
14. Privacy and Data Protection
14.1 Privacy Policy
Your use of DeviceLab Tradesman is governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes in detail how we and our third-party partners collect, use, store, protect, and process information in connection with the App. By using the App, you agree to the data practices described in the Privacy Policy.
14.2 Local-First Data Architecture
DeviceLab Tradesman is built on a fundamentally local-first data architecture. All device performance data, health metrics, sensor readings, analytics data, user preferences, benchmark results, and automation configurations are stored exclusively on your device. Strategia-X does not operate any server that receives, stores, or processes your device data.
14.3 Encrypted Database Storage
All persistent device performance data stored by the App is secured using SQLCipher, an open-source extension of SQLite that provides transparent 256-bit AES encryption of the entire database file at rest. The database is stored within the App's private, sandboxed storage directory on your device. Encryption keys are managed through the Android Keystore system and are not accessible to any external party, including Strategia-X.
14.4 Encrypted Shared Preferences
Sensitive user settings and configuration data are stored using Android's EncryptedSharedPreferences, provided by the AndroidX Security library, which encrypts both preference keys and values using the Android Keystore system. This provides an additional layer of protection for settings and preferences beyond the app sandbox.
14.5 Backup Disabled
The App explicitly declares allowBackup="false" in its Android manifest, preventing Android's auto-backup system from copying App data to Google Drive or any other cloud service. This ensures that encrypted database contents and sensitive settings cannot be extracted through Android's backup mechanism.
14.6 Code Obfuscation
Release builds of the App are processed through ProGuard/R8 code shrinking and obfuscation, protecting the App's business logic, security implementations, and algorithms from reverse engineering.
14.7 Network Security Configuration
The App uses a custom Android Network Security Configuration that enforces encrypted HTTPS connections for all network communications. Cleartext (HTTP) traffic is not permitted for any App component, ensuring that all communications with advertising servers are encrypted in transit.
14.8 Real-Time Sensor Data — Camera and Microphone
Camera access is used exclusively for the Digital Protractor (angle measurement) and QR Code Scanner. The camera feed is processed entirely in real-time on the device. No photographs, video frames, image files, or visual recordings of any kind are captured, stored, or transmitted by the App under any circumstances.
Microphone access is used exclusively for the Decibel Meter (real-time sound level display). Audio input is processed in real-time to compute instantaneous sound pressure level readings. No audio data, audio recordings, voice data, or any form of audio capture is stored, buffered beyond the measurement window, or transmitted by the App under any circumstances.
14.9 Location Data
Location permissions (ACCESS_FINE_LOCATION and ACCESS_COARSE_LOCATION) are used exclusively in real-time for: (a) displaying Wi-Fi SSID names in the Network Monitor and Wi-Fi Spectrum Analyzer features (required by Android 9+ for Wi-Fi SSID access), and (b) supporting the Digital Compass. Location data is consumed in real-time only and is never stored in any form, never included in any data export, and never transmitted to Strategia-X or any third party (other than as may be used by Google AdMob for general regional ad targeting, which uses IP-level geolocation, not GPS coordinates).
14.10 No Personal Identifiers Collected
Strategia-X does not collect any personal identifiers through the App, including names, email addresses, phone numbers, postal addresses, government identification numbers, biometric data, social media profiles, or any other information that could directly identify you as an individual. The App does not require or request any such information.
14.11 User Control Over Data
You have complete control over all data stored by the App:
- Clear App Data — Navigate to Android Settings > Apps > DeviceLab Tradesman > Storage > Clear Data to delete all locally stored data immediately.
- Uninstall — Uninstalling the App permanently and irreversibly removes all locally stored data from your device.
- Revoke Permissions — Revoke any permission at any time via Settings > Apps > DeviceLab Tradesman > Permissions. Revoking a permission disables the related features but does not affect unrelated functionality.
- Export Data — Use the App's Data Export feature to save your performance data locally before deletion.
15. GDPR Compliance
15.1 Scope
This Section applies to users located in the European Economic Area (EEA), the United Kingdom, and Switzerland, and to any processing of personal data subject to Regulation (EU) 2016/679 (General Data Protection Regulation, "GDPR"), the UK GDPR, or the Swiss Federal Act on Data Protection (FADP). References to the GDPR in this Section also encompass the UK GDPR and FADP where applicable.
15.2 Role of Strategia-X and Data Minimization by Design
With respect to all device performance data, sensor readings, measurement data, user preferences, and analytics data stored locally on your device, Strategia-X does not act as a data controller or data processor as those terms are defined in Article 4 GDPR. This data never reaches Strategia-X's systems and Strategia-X has no access to it. All such processing occurs entirely within your device under your exclusive control.
For data collected by Google AdMob and Google Play Services (including advertising identifiers and associated device information collected with your consent), Google LLC acts as an independent data controller or data processor, as the case may be. Strategia-X configures AdMob to request consent through the Google UMP SDK before collecting or using data for personalized advertising.
15.3 Legal Basis for Processing (Article 6 GDPR)
To the extent any personal data is processed in connection with the App:
- Consent (Article 6(1)(a)) — Personalized advertising by Google AdMob is processed on the basis of your freely given, specific, informed, and unambiguous consent obtained through the Google UMP consent dialog (Article 7 GDPR).
- Legitimate Interests (Article 6(1)(f)) — Non-personalized advertising (which may involve minimal data processing for fraud prevention and frequency capping) may be processed on the basis of Google's legitimate interests where consent for personalized advertising has not been provided, subject to your interests and rights.
15.4 Special Category Data (Article 9 GDPR)
The App does not intentionally collect or process any special categories of personal data as defined in Article 9(1) GDPR, including health data, biometric data, genetic data, data revealing racial or ethnic origin, political opinions, religious beliefs, or data concerning sex life or sexual orientation. Location data accessed for Wi-Fi SSID and compass purposes is processed in real-time only and is never stored or transmitted.
15.5 Data Subject Rights (Articles 12–22 GDPR)
To the extent Strategia-X processes any personal data (which is minimal given the local-first architecture), you have the following rights under the GDPR:
- Right of Access (Article 15) — You may request confirmation of whether and what personal data we hold about you.
- Right to Rectification (Article 16) — You may request correction of inaccurate personal data we hold about you.
- Right to Erasure (Article 17) — You may request deletion of personal data we hold about you where a ground for erasure applies.
- Right to Restriction of Processing (Article 18) — You may request that we restrict processing of your personal data in certain circumstances.
- Right to Data Portability (Article 20) — Where processing is based on consent and carried out by automated means, you may request your personal data in a structured, machine-readable format.
- Right to Object (Article 21) — You may object to processing based on legitimate interests. With respect to advertising, you may withdraw consent through the UMP consent dialog or device settings.
- Right to Withdraw Consent (Article 7(3)) — You may withdraw consent for personalized advertising at any time without affecting the lawfulness of prior processing.
For locally stored data (device performance metrics, sensor history, etc.), you exercise these rights directly on your device by clearing App data or uninstalling the App, as Strategia-X has no access to this data. For advertising data held by Google, please contact Google directly through their privacy controls. To exercise rights against Strategia-X regarding any data we may hold, contact us at [email protected].
15.6 Data Protection by Design and Default (Article 25 GDPR)
DeviceLab Tradesman is designed with data protection principles embedded at the architectural level, as required by Article 25 GDPR:
- Data Minimization — The App collects only the data necessary for each specific feature, processes sensor data in real-time without persistent storage, and does not collect personal identifiers.
- Purpose Limitation — Each permission and data access is used solely for the specific disclosed purpose. Camera data is used only for protractor/QR features; microphone data is used only for the decibel meter.
- Storage Limitation — Real-time sensor data (camera, microphone, location, accelerometer, gyroscope) is not persistently stored. Historical data that is stored is encrypted.
- Integrity and Confidentiality (Article 32) — Data stored at rest is protected by SQLCipher AES-256 database encryption and EncryptedSharedPreferences. Data in transit is protected by custom HTTPS Network Security Configuration. Code obfuscation via ProGuard/R8 protects against unauthorized access to security logic. Android's application sandbox provides process isolation.
15.7 International Data Transfers (Articles 44–49 GDPR)
Since all device data is processed locally on your device, no international data transfers of your personal information occur through Strategia-X's own systems. Data processed by Google AdMob and Google Play Services may be transferred to countries outside the EEA. Google relies on Standard Contractual Clauses (SCCs), adequacy decisions, and other appropriate safeguards as described in Google's Privacy Policy for such transfers.
15.8 Right to Lodge a Complaint (Article 77 GDPR)
If you believe that processing of your personal data infringes the GDPR, you have the right to lodge a complaint with the competent supervisory authority in the EU Member State of your habitual residence, place of work, or place of the alleged infringement. UK users may contact the Information Commissioner's Office (ICO) at ico.org.uk. Swiss users may contact the Federal Data Protection and Information Commissioner (FDPIC) at edoeb.admin.ch.
15.9 Data Protection Officer
Strategia-X does not currently designate a formal Data Protection Officer (DPO). Privacy inquiries and requests to exercise GDPR rights should be directed to [email protected] with "GDPR Request" in the subject line. We will respond to verifiable requests within 30 days as required by Article 12 GDPR, with the possibility of a 60-day extension for complex requests.
16. CCPA/CPRA Compliance
16.1 Scope
This Section applies to consumers who are residents of the State of California and whose use of the App is subject to the California Consumer Privacy Act of 2018 (CCPA), Cal. Civ. Code §§ 1798.100–1798.199, as amended by the California Privacy Rights Act of 2020 (CPRA), which became fully effective January 1, 2023.
16.2 Categories of Personal Information Collected
Under the CCPA/CPRA, "personal information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. In connection with the App, Strategia-X itself collects no personal information. However, the following categories may be processed:
- Device Identifiers (Category F — Internet or Other Electronic Network Activity Information) — Google AdMob collects your Google Advertising ID (GAID) and device information for advertising purposes. This falls under CCPA Category F and potentially Category B (Personal Identifiers).
- Geolocation Data (Category G) — General location at the country/region level may be inferred by Google AdMob from IP addresses. Precise geolocation accessed by the App for Wi-Fi SSID and compass features is processed locally in real-time and is not transmitted to or collected by Strategia-X.
- Device Performance Data (Category K — Inferences) — Stored locally on your device only; not collected by Strategia-X. Your device generates inferences about device health which are stored in the encrypted local database.
16.3 Purposes for Collection
AdMob-collected personal information is used for: serving contextual or personalized advertisements, measuring ad performance, fraud prevention, and frequency capping. Locally stored data is used exclusively for the on-device purposes described in Sections 3 and 14. Strategia-X does not use personal information for any other purpose.
16.4 California Consumer Rights
As a California resident, you have the following rights under CCPA/CPRA (Cal. Civ. Code §§ 1798.100–1798.199.100):
- Right to Know (§ 1798.100, § 1798.110, § 1798.115) — You have the right to know the categories and specific pieces of personal information collected about you, the categories of sources from which it is collected, the purposes for which it is used, and the categories of third parties with whom it is shared. This document provides that disclosure.
- Right to Delete (§ 1798.105) — You may delete all locally stored data by clearing App data in Android Settings or uninstalling the App. For AdMob data, submit a deletion request to Google.
- Right to Correct (§ 1798.106) — You may request correction of inaccurate personal information we maintain about you.
- Right to Opt-Out of Sale or Sharing (§ 1798.120, § 1798.135) — Strategia-X does not sell your personal information within the meaning of the CCPA. For AdMob's sharing of your advertising identifier for cross-context behavioral advertising, opt out via the Google UMP consent dialog or Android ad settings (Settings > Google > Ads).
- Right to Limit Use of Sensitive Personal Information (§ 1798.121) — Precise geolocation data (a sensitive personal information category under CPRA) accessed by the App for Wi-Fi SSID and compass features is used only for those specific, disclosed purposes in real-time and is never stored or shared. No further limitation of use is necessary.
- Right to Non-Discrimination (§ 1798.125) — We will not deny you the App's services, charge different prices, or provide a different level of quality because you exercise any of your CCPA/CPRA rights.
16.5 Submitting a Request
To submit a verifiable consumer request under the CCPA/CPRA, email us at [email protected] with "CCPA Privacy Request" in the subject line. We will respond within 45 days of receiving a verifiable request, with the possibility of a 45-day extension (for a maximum of 90 days) upon notice to you, as permitted by § 1798.130.
You may designate an authorized agent to submit a request on your behalf in accordance with § 1798.130. We may require verification of your identity or the agent's authorization before processing the request.
16.6 No Sale of Personal Information — Notice at Collection
Strategia-X does not sell your personal information to any third party. This constitutes our notice at collection pursuant to CPRA regulations. We do not engage in cross-context behavioral advertising using your personal information directly. Google AdMob's practices are governed by Google's own CCPA compliance framework.
16.7 CalOPPA Compliance
In compliance with the California Online Privacy Protection Act (CalOPPA), California Business and Professions Code §§ 22575–22579, this document serves as the App's privacy disclosure. We do not respond to "Do Not Track" signals from browsers, as the App does not operate as a browser-based service. We do not allow third parties to collect personal information about individual users across websites over time, other than through Google AdMob's advertising practices as disclosed herein.
17. Additional U.S. State Privacy Laws
17.1 Overview
In addition to California's CCPA/CPRA addressed in Section 16, a growing number of U.S. states have enacted comprehensive consumer data privacy laws. This Section describes how DeviceLab Tradesman's privacy practices align with the applicable provisions of each enacted state law. Because the App is primarily local-first and collects minimal personal information through Strategia-X directly, many obligations under these laws are substantially satisfied by the App's design architecture.
17.2 Virginia — Consumer Data Protection Act (VCDPA)
Va. Code Ann. §§ 59.1-571 et seq. Virginia residents have the right to access, correct, delete, and obtain a portable copy of their personal data, and to opt out of targeted advertising and the sale of personal data. Strategia-X does not sell personal data and does not engage in targeted advertising directly. Google AdMob's practices as configured through UMP consent comply with VCDPA opt-out requirements. You may exercise your rights by contacting us at [email protected]. We will respond within 45 days, extendable by an additional 45 days upon notice.
17.3 Colorado — Colorado Privacy Act (CPA)
C.R.S. §§ 6-1-1301 et seq. Colorado residents have the right to access, correct, delete, and obtain a copy of personal data, and to opt out of targeted advertising, sale of personal data, and profiling. Strategia-X does not sell or profile Colorado consumers' personal data. We honor opt-out requests for personalized advertising via the UMP consent mechanism and device settings. Universal opt-out signals as required by CPA regulations are honored where technically feasible. Contact us at [email protected] to exercise rights. Response within 45 days.
17.4 Connecticut — Connecticut Data Privacy Act (CTDPA)
Conn. Gen. Stat. §§ 42-515 et seq. Connecticut residents have the right to access, correct, delete, and port personal data, and to opt out of targeted advertising, sale, and profiling that produces legal or similarly significant effects. Strategia-X does not sell personal data or conduct profiling. Opt-out for personalized advertising is available through the UMP consent dialog. Contact us at [email protected]. 17.5 Utah — Utah Consumer Privacy Act (UCPA)

17.11 Oregon — Oregon Consumer Privacy Act (OCPA)
Or. Rev. Stat. §§ 646A.570 et seq. Oregon residents have the right to access, correct, delete, and port personal data, and to opt out of targeted advertising, sale, and profiling. The OCPA applies to sensitive data including precise geolocation. The App accesses precise location only in real-time for compass and Wi-Fi SSID functionality and never stores or transmits it. 17.17 Minnesota — Minnesota Consumer Data Privacy Act (MCDPA / MPDPA)
Minn. Stat. §§ 325O.01 et seq. Minnesota residents have the right to access, correct, delete, and port personal data, to obtain a list of third parties to whom personal data has been disclosed, and to opt out of targeted advertising, sale, and profiling that produces legal or similarly significant effects. 17.18 COPPA — Children's Online Privacy Protection Act
15 U.S.C. §§ 6501–6506. DeviceLab Tradesman is not directed to children under the age of 13 and we do not knowingly collect personal information from children under 13. The App does not require or facilitate the collection of personal information from any user, child or adult. The App does not provide features that would attract children under 13 as a primary audience (the App is designed for professional tradesmen and construction workers). If we discover that we have inadvertently collected personal information from a child under 13, we will promptly delete such information. Parents or guardians who believe their child under 13 has used the App and that personal information may have been collected should contact us immediately at [email protected].
Advertisements served through Google AdMob are subject to Google's child-directed treatment policies. We do not designate the App as child-directed for AdMob purposes, which results in standard (non-child-directed) ad serving.
17.19 Exercise of Rights Under State Laws
To exercise any right under any applicable U.S. state privacy law, contact us at [email protected] and include:
- Your name and state of residence;
- The specific right you wish to exercise;
- The law under which you are asserting that right; and
- Sufficient information for us to verify your identity and the nature of your request.
Given that Strategia-X collects no personal information directly through the App, many state privacy rights are effectively exercised by you directly on your device (clearing App data, uninstalling, revoking permissions). For advertising data held by Google, exercise your rights through Google's privacy controls. We will not discriminate against you for exercising any privacy right under applicable law.
18. International Users
18.1 Global Availability
DeviceLab Tradesman is available globally through the Google Play Store. We make no representation that the App is appropriate or available for use in all locations. Users who access the App from outside the United States do so on their own initiative and are responsible for compliance with all applicable local laws and regulations.
18.2 Brazil — Lei Geral de Proteção de Dados (LGPD)
Brazilian residents are protected by the Lei Geral de Proteção de Dados Pessoais (LGPD), Law No. 13,709/2018, enforced by the Autoridade Nacional de Proteção de Dados (ANPD). Given the App's local-first architecture, Strategia-X does not act as a controller or operator under the LGPD for locally stored data. For advertising data processed by Google AdMob with your consent, Google acts as an independent controller. Brazilian residents have the rights provided under LGPD Article 18, including access, correction, deletion, portability, and objection. To exercise rights, contact [email protected].
18.3 Canada — PIPEDA and Provincial Laws
Canadian users are protected by the Personal Information Protection and Electronic Documents Act (PIPEDA), S.C. 2000, c. 5, and applicable provincial privacy laws (including Alberta's PIPA, British Columbia's PIPA, and Quebec's Law 25). The App collects no personal information directly through Strategia-X. AdMob's advertising practices are subject to CASL (Canada's Anti-Spam Legislation) compliance by Google. 18.4 Australia — Privacy Act 1988
Australian users are protected by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). As Strategia-X does not collect personal information directly through the App, few APP obligations are directly triggered. AdMob advertising is subject to Google's compliance with applicable Australian privacy law. Australian users may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au with complaints.
18.5 Governing Law for Non-U.S. Users
Notwithstanding Section 18's acknowledgment of international privacy rights, these Terms are governed by the laws of the State of Delaware, United States of America, as specified in Section 22. Nothing in Section 18 should be interpreted to alter the governing law or dispute resolution provisions of Section 22.
18.6 Export Controls
You represent that you are not located in a jurisdiction subject to a U.S. government embargo and that you are not listed on any U.S. government list of prohibited or restricted parties. You agree to comply with all applicable export control and sanctions laws when using the App.
19. Third-Party Services
19.1 Google AdMob
The App integrates Google AdMob (operated by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) to serve banner and interstitial advertisements. AdMob operates as an independent third party with its own terms of service and privacy policy. Strategia-X does not control AdMob's data collection, use, or disclosure practices, which are governed exclusively by Google's Privacy Policy and Google AdMob Terms of Service. Strategia-X is not liable for AdMob's data handling practices.
19.2 Google User Messaging Platform (UMP)
The App uses the Google User Messaging Platform SDK to display consent dialogs and manage advertising consent in compliance with GDPR, CCPA, and other applicable privacy laws. UMP is operated by Google LLC and is governed by Google's Terms of Service. The consent signals collected through UMP are passed to Google AdMob to determine the appropriate ad serving mode (personalized or non-personalized).
19.3 Google Play Services
The App uses Google Play Services (operated by Google LLC) for core Android functionality, including security updates, app integrity checking, and integration with the Google Play billing and distribution framework. Google Play Services may collect device information as described in Google's Privacy Policy. Strategia-X does not control Google Play Services' data collection.
19.4 Open-Source Libraries
The App incorporates open-source libraries including Jetpack Compose, Room, SQLCipher, AndroidX Security (EncryptedSharedPreferences), Jetpack DataStore, Hilt, Kotlin Coroutines, Material Design 3, WorkManager, and MPAndroidChart. These libraries operate entirely on-device, do not transmit data to any third party, and are subject to their respective open-source licenses. Their use does not create any data sharing relationship between you and the library authors.
19.5 Network Speed Test
The App's Speed Test feature connects to third-party speed test servers to measure internet connection performance. Speed test sessions require a temporary internet connection to a remote server. The IP address of your device may be visible to the speed test server for the duration of the test. No personally identifiable information is transmitted by the App during speed testing beyond your device's IP address.
19.6 Links to Third-Party Services
The App or advertisements displayed within the App may contain links to third-party websites, applications, or services. Strategia-X is not responsible for the privacy practices, terms of service, content, security, or availability of any third-party service. The inclusion of a link to a third-party service does not constitute an endorsement, sponsorship, or recommendation by Strategia-X. You access third-party services at your own risk, subject to those services' own terms and policies.
19.7 No Endorsement of Third-Party Advertisers
The display of any advertisement within the App does not constitute Strategia-X's endorsement of the advertised product, service, company, or any claim made in the advertisement. Strategia-X is not responsible for the accuracy, quality, legality, or safety of any product or service advertised through AdMob.
20. Updates and Modifications
20.1 App Updates
Strategia-X may release updates to DeviceLab Tradesman from time to time through the Google Play Store. Updates may add new features, modify existing features, remove features, fix bugs, improve security, address compatibility with new versions of the Android operating system, or comply with applicable legal requirements. By enabling automatic updates on your device or by manually installing an update, you agree that any updated version of the App is governed by the then-current version of these Terms.
20.2 Feature Modifications
Strategia-X reserves the right to modify, suspend, or discontinue any feature, tool, function, or capability of the App at any time and for any reason, including without limitation to improve the App, address technical issues, respond to changes in the Android platform or hardware ecosystem, comply with applicable law, or manage the viability of the free service. We will make reasonable efforts to provide advance notice of material feature changes through the App, the Google Play Store listing, or our website, but are not obligated to do so in all circumstances.
20.3 Advertising Changes
The types, frequency, placement, and nature of advertisements displayed in the App may change at any time. Strategia-X reserves the right to introduce new ad formats, modify ad placement, or change advertising partners without prior notice.
20.4 Compatibility
We will use reasonable efforts to maintain compatibility with the minimum supported Android version (Android 7.0 / API 24). However, as new Android versions are released and Google Play policies evolve, the minimum supported Android version may be raised in future updates. If your device does not support the minimum required Android version, you may no longer be able to install or use updated versions of the App.
21. Termination
21.1 Termination by You
You may terminate this Agreement at any time by uninstalling DeviceLab Tradesman from your Android device. Uninstalling the App removes all locally stored data and immediately terminates all rights granted to you under these Terms.
21.2 Termination by Strategia-X
Because the App does not require account registration and operates locally without a server-side relationship between Strategia-X and you, Strategia-X's primary mechanism for terminating your license is the publication of updated versions of the App that require acceptance of revised Terms, or the removal of the App from the Google Play Store. Strategia-X may remove the App from distribution at any time and for any reason.
If you violate these Terms in a manner that comes to Strategia-X's attention, Strategia-X may report such violations to Google for enforcement action under Google Play policies, pursue legal remedies, or take any other action available at law or in equity.
21.3 Effect of Termination
Upon termination of this Agreement for any reason:
- All rights and licenses granted to you under these Terms immediately and automatically cease;
- You must immediately cease all use of the App and uninstall it from all devices; and
- All data stored locally on your device by the App will be deleted upon uninstallation.
21.4 Survival
The following sections shall survive the termination or expiration of this Agreement for any reason: Section 8 (User Content and Intellectual Property), Section 12 (Disclaimers and Limitation of Liability), Section 13 (Indemnification), Section 22 (Governing Law and Dispute Resolution), Section 23 (Severability), and any other provisions that by their nature are intended to survive termination.
22. Governing Law and Dispute Resolution
22.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of laws principles or provisions that would cause the laws of another jurisdiction to apply.
22.2 Informal Resolution
Before initiating any formal legal proceeding, you agree to contact Strategia-X at [email protected] and describe your dispute in sufficient detail to allow us to understand and attempt to resolve it informally. You agree to engage in good-faith negotiation for a period of at least thirty (30) days before pursuing arbitration or litigation. This informal resolution requirement shall not apply to emergency applications for injunctive or other equitable relief.
22.3 Binding Arbitration
Except for disputes that qualify for small claims court, and except for claims for injunctive or other equitable relief to protect intellectual property rights or confidential information, any dispute, controversy, or claim arising out of or relating to these Terms, including their formation, interpretation, breach, or termination, shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules or Commercial Arbitration Rules, as applicable, by a single arbitrator. The arbitration shall be conducted in the English language. The seat of arbitration shall be Wilmington, Delaware, USA, unless you and Strategia-X agree otherwise. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
22.4 Class Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND STRATEGIA-X AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and Strategia-X agree otherwise, the arbitrator may not consolidate more than one person's claims with your claims, and may not otherwise preside over any form of a representative or class proceeding.
22.5 Exceptions to Arbitration
Notwithstanding the arbitration provision in Section 22.3, either party may seek emergency injunctive or other equitable relief from any court of competent jurisdiction to prevent irreparable harm, including without limitation to protect intellectual property rights, trade secrets, or confidential information. Such an application for emergency relief shall not constitute a waiver of the obligation to arbitrate other disputes.
22.6 Small Claims Court
Either party may elect to resolve a dispute in a small claims court of competent jurisdiction provided that the dispute meets the jurisdictional requirements of that court. Either party may exercise this option by notifying the other prior to commencing arbitration.
22.7 Jurisdiction for Non-Arbitrable Claims
For any dispute that is not subject to arbitration under these Terms, you and Strategia-X irrevocably consent to the exclusive jurisdiction and venue of the state and federal courts located in Wilmington, Delaware, USA, and each party waives any objection to jurisdiction or venue in those courts.
22.8 Time Limitation on Claims
Any claim or cause of action arising out of or related to these Terms or your use of the App must be filed within one (1) year after the claim arises, regardless of any statute of limitations to the contrary. Failure to file a claim within this period shall permanently bar the claim.
23. Severability
23.1 Severability
If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, unenforceable, or contrary to public policy for any reason, that provision shall be enforced to the maximum extent permitted by applicable law, and the remaining provisions of these Terms shall continue in full force and effect.
23.2 Reform
Where a provision is found to be unenforceable, the parties agree that the court or arbitrator should modify that provision to the minimum extent necessary to make it enforceable while preserving as much of the original intent as possible. If modification is not possible, the unenforceable provision shall be severed from these Terms, and the remaining Terms shall continue as if the severed provision had never been included.
23.3 Class Action Waiver Severability
If the class action waiver in Section 22.4 is found to be unenforceable in a particular instance, then the arbitration agreement in Section 22.3 shall not apply to that dispute, and the dispute shall be resolved through litigation in a court of competent jurisdiction as provided in Section 22.7. In no event shall a court permit class arbitration.
23.4 No Waiver
Strategia-X's failure to enforce any right or provision of these Terms in a particular instance shall not constitute a waiver of that right or provision in other instances or of any other right or provision. No waiver shall be effective unless made in writing and signed by an authorized representative of Strategia-X.
24. Changes to These Terms
24.1 Right to Modify
Strategia-X reserves the right to modify, update, or replace these Terms at any time in its sole discretion. Reasons for changes may include, but are not limited to: changes to applicable law or regulatory requirements, changes to the App's features or functionality, changes to our advertising partnerships, court decisions affecting our legal obligations, or to clarify existing provisions.
24.2 Notice of Material Changes
When we make material changes to these Terms — meaning changes that substantively affect your rights or obligations — we will provide notice through one or more of the following channels:
- An in-app notification displayed within the App;
- An update to the "What's New" section of the App's Google Play Store listing;
- A notice posted on our website at www.strategia-x.com; or
- Any other reasonable communication method we deem appropriate.
24.3 Effective Date
Unless a longer notice period is required by applicable law, updated Terms will become effective upon posting at the URL where the current Terms are published. The "Last Updated" date at the top of this document reflects the effective date of the most recent revision.
24.4 Acceptance of Revised Terms
Your continued use of the App after the effective date of any revision to these Terms constitutes your binding acceptance of the revised Terms. If you do not agree to any revised Terms, you must stop using the App and uninstall it from your device prior to the effective date of the changes.
24.5 Version History
We recommend reviewing these Terms periodically. The most current version of these Terms is always available at www.strategia-x.com/tos-devicelab-tradesman. Prior versions of the Terms may be available upon request.
