These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("you," "your," "User") and Strategia-X ("we," "us," "our," "Company") governing your access to and use of the DeviceLab Offroad mobile application ("DeviceLab Offroad," "the App," "the Service"), including all features, content, and services provided through the App.
By downloading, installing, accessing, or using DeviceLab Offroad, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the App.

This document is a legally binding agreement. Please read it carefully in its entirety before using the App.
1. Acceptance of Terms
1.1 Agreement to Terms
By downloading DeviceLab Offroad from the Google Play Store, installing it on your device, or using any feature of the App, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.
If you are accessing the App on behalf of an organization or legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" refers to both you individually and that entity.
1.2 Electronic Agreement
Your use of the App constitutes an electronic signature and your agreement to these Terms. You consent to receive all communications, notices, and disclosures from us electronically, including through the App, Google Play Store, or via email if you choose to contact us.
1.3 Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this document and provide notice through the App or the Google Play Store listing. Your continued use of the App after any modification constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and uninstall it from your device.

2. Eligibility
2.1 Minimum Age Requirement
You must be at least 13 years of age to download, install, or use DeviceLab Offroad. The App is not directed at, and is not intended for use by, children under the age of 13. By using the App, you represent and warrant that you are at least 13 years old.
If you are under 13 years of age, you are not permitted to use the App under any circumstances. If we become aware that a user is under the age of 13, we will take appropriate steps in accordance with our obligations under the Children's Online Privacy Protection Act (COPPA) and applicable law.
2.2 GDPR Age of Digital Consent (Users in the EEA, UK, and Switzerland)
If you are located in a European Economic Area (EEA) member state, the United Kingdom, or Switzerland, and you are under the age of 16 (or such lower age as established by your country's implementation of GDPR Article 8), you must obtain verifiable parental or guardian consent before using the App, including before consenting to the processing of your personal data for advertising purposes. The specific age threshold varies by member state:
- Age 16: Netherlands, Germany, Austria, Luxembourg, Ireland, Cyprus, Slovakia
- Age 15: France, Czech Republic
- Age 14: Spain, Italy, Hungary, Lithuania, Estonia, Serbia, Austria (alternative)
- Age 13: Belgium, Denmark, Finland, Sweden, Malta
By consenting to personalized advertising in the Google UMP consent dialog, users under the applicable age threshold confirm they have obtained verifiable parental or guardian consent. We rely on Google's UMP platform to manage and record consent in compliance with GDPR Article 7.
2.3 Legal Capacity
You represent that you have the full legal capacity to enter into a binding agreement and that you are not barred from receiving services under applicable law, including export controls and sanctions regulations.
2.4 Geographic Restrictions
The App is made available worldwide through the Google Play Store, subject to Google's distribution policies. You are responsible for ensuring that your use of the App complies with all laws and regulations applicable in your jurisdiction.
3. Description of Service
3.1 Overview
DeviceLab Offroad is a professional-grade Android application designed for offroad enthusiasts, overlanders, hikers, and adventure seekers. Built with Kotlin and Jetpack Compose, the App combines advanced real-time navigation instruments with comprehensive device monitoring, diagnostics, and optimization tools — all processed locally on your device.
3.2 Navigation and Positioning Features
The App provides the following real-time navigation instruments powered by your device's GPS/GNSS hardware and sensor suite:
- GPS/GNSS Dashboard — Real-time display of latitude, longitude, altitude, speed, heading, accuracy metrics, and satellite constellation status (GPS, GLONASS, Galileo, BeiDou). All location data is processed in real-time only and is never stored, logged, tracked, or transmitted.
- Digital Compass — Magnetometer-based heading and bearing display with declination correction for accurate directional navigation.
- Altimeter — Barometric pressure-calibrated altitude readings with real-time elevation display.
- Inclinometer — Vehicle and terrain pitch and roll angles derived from the accelerometer for safe offroad maneuvering.
- G-Force Meter — Real-time gravitational force measurement across all axes for performance and safety monitoring during offroad activity.
3.3 Environmental Sensor Features
- Accelerometer Monitor — Linear acceleration and motion analysis across three axes.
- Gyroscope Monitor — Rotational velocity and orientation change measurements.
- Magnetometer Monitor — Magnetic field strength and compass calibration data.
- Barometric Pressure Monitor — Atmospheric pressure readings for weather awareness and altitude calibration.
- Ambient Light Meter — Luminescence measurements in lux for environment assessment.
- Proximity Sensor — Environmental proximity readings.
- Temperature Monitor — Ambient and device component temperature readings.
- Audio Oscilloscope — Real-time audio waveform visualization using the device microphone. No audio is recorded, stored, or transmitted under any circumstances.
- QR Code Scanner — Camera-based QR code and barcode scanning for real-time decoding. No photos, videos, or images are captured, stored, or transmitted.
3.4 Device Monitoring and Analytics Tools
- Live Monitor — Real-time CPU, RAM, battery, storage, and temperature dashboard with configurable refresh intervals.
- Floating Overlay — System stats overlay visible over other apps via Android's SYSTEM_ALERT_WINDOW permission.
- Home Screen Widgets — Configurable widgets displaying live device metrics on your Android home screen.
- Analytics Dashboard — Historical performance charts and trend analysis stored locally in the Room database.
- Screen Time Monitor — Foreground app usage tracking using the PACKAGE_USAGE_STATS permission.
- Network Monitor — Real-time network connection type, signal strength, and data usage statistics.
- Wi-Fi Spectrum Analyzer — Visualization of nearby Wi-Fi networks and channel utilization for connectivity optimization.
- Bluetooth Spectrum Scanner — Nearby Bluetooth device discovery and signal strength visualization.
- Speed Test — Internet connection download and upload speed measurement.
- Ping Diagnostics — Network latency measurement to configurable endpoints.
- App Manager — Installed application browser with size, permissions, and usage data.
3.5 Device Optimization Tools
- RAM Booster — Memory optimization to free available RAM.
- Cache Cleaner — System and application cache clearing utility.
- Storage Analysis — File type distribution and storage usage breakdown by category.
- Battery Saver — Power consumption management and optimization profiles.
- Wake Lock Detection — Identification of processes preventing the device from sleeping.
- Startup Optimization — Boot-time application management.
- Boot Analysis — Device startup time measurement and boot process analytics.
3.6 Hardware Diagnostics and Testing
- Display Test — Screen uniformity, color accuracy, and dead pixel detection.
- Touch Test — Multi-touch tracking and touch response diagnostics.
- Speaker Test — Audio output quality and speaker functionality verification.
- Sensor Test — Comprehensive sensor availability and accuracy verification.
- Vibration Test — Haptic motor functionality and pattern testing.
- Performance Benchmarks — CPU, memory, and storage benchmark suites with locally stored results.
3.7 Data Export
The App provides local data export functionality allowing you to save your performance history, benchmark results, and analytics data to your device's storage for personal analysis and backup. Exported data remains entirely on your device.
3.8 Advertising
The App is free to download and use and is supported by advertising delivered through Google AdMob. A consent dialog powered by the Google User Messaging Platform (UMP) is presented to users in applicable jurisdictions to manage advertising consent. See Section 7 for full details.
3.9 Service Availability
Because DeviceLab Offroad processes all navigation and device data locally on your device, the core functionality of the App does not require an internet connection (except for internet-dependent features such as the network speed test and ad delivery). We do not guarantee uninterrupted access to any feature. GPS accuracy depends on satellite availability, atmospheric conditions, and your device hardware.
4. Accounts and Registration
4.1 No Account Required
DeviceLab Offroad does not require you to create an account, register a profile, or provide any personal information to access or use the App. There is no login, sign-up, authentication, or user profile system of any kind.
4.2 No Personal Data Collection for Registration
Because no account system exists, we do not collect your name, email address, password, phone number, or any other identifying information for the purpose of account management. All App preferences, settings, and locally stored data are tied to the App installation on your device and managed entirely by Android's application data framework.
4.3 Device Identification
The App does not generate, assign, or transmit any unique user identifier. Your device's advertising identifier (GAID) may be accessed by Google AdMob for advertising purposes only, subject to your consent preferences. See Section 7 for details.
4.4 Data Portability and Deletion
Since all data is stored locally and no account exists, you have direct control over all App data at all times. You may export data using the built-in export feature, clear all data via Android Settings > Apps > DeviceLab Offroad > Storage > Clear Data, or permanently remove all data by uninstalling the App.
5. Subscriptions and Purchases
5.1 Free Application
DeviceLab Offroad is and remains a completely free application. There are no subscription fees, in-app purchases, premium tiers, feature unlocks, consumable items, paid content, or any other form of monetized transaction within the App.
5.2 No Payment Processing
The App does not process, collect, or store any payment information, credit card data, billing addresses, or financial information of any kind. No payment or billing relationship exists between you and Strategia-X.
5.3 Google Play Billing
As the App does not include any purchasable items, Google Play's billing system is not integrated into the App and no Google Play billing terms apply to your use of DeviceLab Offroad.
5.4 Future Changes
If we introduce optional premium features or in-app purchases in a future version of the App, we will update these Terms accordingly and provide advance notice through the App and the Google Play Store listing. Any such changes will be clearly disclosed before any purchase is offered.
6. Free Features
6.1 Complete Feature Access
All features described in Section 3 are available to all users at no cost. The following is a comprehensive summary of the features included in DeviceLab Offroad at no charge:

7. Advertising
7.1 Google AdMob
DeviceLab Offroad is a free application supported by advertising. Advertisements are delivered through Google AdMob, a third-party advertising network operated by Google LLC. By using the App, you acknowledge and agree that advertisements may be displayed within the App's interface.
7.2 Google User Messaging Platform (UMP) Consent
The App uses the Google User Messaging Platform (UMP) to present a consent dialog to users in jurisdictions where consent is required under applicable law, including the European Economic Area (EEA), the United Kingdom, Switzerland, and U.S. states with applicable privacy regulations. Through this dialog, you may:
- Accept personalized advertising — Ads are targeted based on your interests and behavior as determined by Google's advertising systems.
- Accept non-personalized advertising — Ads are contextually served without behavioral targeting. Certain device and contextual information may still be used for ad delivery.
- Manage or update your consent — Consent preferences can be updated at any time through the App's settings menu.
7.3 Data Collected by AdMob
Google AdMob may collect the following data to serve advertisements, subject to your consent preferences and Google's privacy policies:
- Device advertising identifier (Google Advertising ID / GAID)
- General geographic location (country or region level — not precise GPS coordinates from the App)
- Device model, operating system version, and screen resolution
- Ad impression, click, and interaction data
- IP address (used for general geolocation and fraud prevention)
Strategia-X does not receive, access, or process any AdMob-collected data. AdMob data is collected and controlled entirely by Google LLC. For full details, see Google's Privacy Policy and Google AdMob's data practices.
7.4 Opting Out of Personalized Advertising
You may opt out of personalized advertising at any time through the following methods:
- In-App Consent Manager — Access the consent dialog through the App's settings at any time to change your advertising preferences.
- Android Advertising Settings — Navigate to Android Settings > Google > Ads and enable "Opt out of Ads Personalization" (Android 12 and below) or delete your Advertising ID (Android 13 and above).
- Reset or Delete Advertising ID — You may reset or permanently delete your device's advertising ID in Android Settings, which will prevent interest-based ad targeting across all apps on your device.
- Network Advertising Initiative (NAI) — Visit optout.networkadvertising.org for additional opt-out options.
7.5 No Sale of Personal Data for Advertising
Strategia-X does not sell, trade, rent, or otherwise transfer your personal information to advertisers or data brokers. The App does not share your precise GPS location, sensor data, device performance data, or any personally identifying information with Google AdMob or any other advertiser. Ad delivery is managed entirely by Google through its own systems.
7.6 Advertising and Outdoor Safety
Advertisements are displayed in designated areas of the App's interface and are designed not to interfere with safety-critical navigation features. If you believe an advertisement is obscuring a navigation instrument or safety feature, please contact us immediately at [email protected].
8. User Content and Intellectual Property
8.1 User-Generated Content
DeviceLab Offroad does not include any social features, content sharing, community platforms, or mechanisms for you to submit or publish content to us or to other users. Any data generated by your use of the App (performance history, benchmark results, exported files) is stored locally on your device and remains entirely your own.
8.2 Exported Data Ownership
All data you export from the App belongs to you. You retain full ownership of any performance logs, benchmark results, and analytics data you choose to export. Strategia-X does not claim any ownership interest in data generated by your device's sensors or system.
8.3 App Intellectual Property
The App — including but not limited to its source code, compiled application binary, user interface design, graphics, icons, layout, feature architecture, navigation instruments, data visualization components, branding, trademarks, trade dress, and all related materials — is the exclusive intellectual property of Strategia-X and is protected by applicable copyright, trademark, trade secret, and other intellectual property laws in the United States and internationally.
"Strategia-X," "DeviceLab Offroad," the Strategia-X logo, and the DeviceLab Offroad app icon are trademarks or service marks of Strategia-X. You may not use these marks without express written authorization.
8.4 No Transfer of IP Rights
Nothing in these Terms transfers or assigns any intellectual property rights in the App or its content to you. Your rights are limited exclusively to the license granted in Section 9 below.
8.5 Feedback
If you provide feedback, bug reports, suggestions, or ideas regarding the App ("Feedback"), you grant Strategia-X a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, distribute, and otherwise exploit your Feedback for any purpose without restriction or compensation to you. Feedback does not create any confidentiality obligation on our part.
8.6 Third-Party Intellectual Property
The App incorporates open-source libraries and third-party SDKs that are subject to their respective licenses. Use of these libraries does not transfer any rights to you beyond what is provided under this Agreement and the applicable open-source licenses. Notable third-party components include Jetpack Compose, Room, Hilt, Material Design 3, Google AdMob SDK, and Google UMP SDK.
9. License Grant to You
9.1 Limited License
Subject to your compliance with these Terms, Strategia-X grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- Download and install one copy of the App on a compatible Android device that you own or control;
- Access and use the App for your personal, non-commercial purposes; and
- Use the App's features as intended and described in these Terms and the App's documentation.
9.2 License Restrictions
This license does not permit you to:
- Copy, reproduce, distribute, publish, or transmit the App or any portion of its code to any third party;
- Modify, adapt, translate, or create derivative works based on the App;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent permitted by applicable law notwithstanding this restriction;
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices in or on the App;
- Sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App or your rights to use it;
- Use the App to build a competing product or service;
- Use the App on any device or platform other than a compatible Android device; or
- Circumvent, disable, or interfere with any security, access control, or other protective features of the App.
9.3 Google Play Terms
Your download and installation of the App from the Google Play Store is additionally governed by the Google Play Terms of Service. In the event of any conflict between these Terms and Google Play's terms regarding the App itself, these Terms shall govern to the extent permitted by Google Play's policies.
9.4 License Termination
This license is effective until terminated. It will terminate automatically without notice if you breach any provision of these Terms. Upon termination, you must cease all use of the App and uninstall it from your device.
10. Acceptable Use
10.1 Permitted Uses
You may use DeviceLab Offroad for its intended purposes, including but not limited to: personal offroad navigation and trail assessment, vehicle angle and terrain monitoring, device diagnostics and performance optimization, environmental sensor readings, network analysis, and personal data export. You agree to use the App responsibly, lawfully, and in accordance with these Terms.
10.2 Outdoor Activity Safety — Critical Notice
DeviceLab Offroad is a supplementary navigation and sensor tool. It is NOT a replacement for professional navigation equipment, topographic maps, dedicated GPS devices, or proper outdoor safety preparation.
By using the App's navigation features, you acknowledge and agree to all of the following:
- GPS is supplementary only. GPS readings displayed by the App are approximate and may be affected by satellite availability, atmospheric interference, device hardware limitations, terrain (canyons, dense tree canopy, overhangs), and other environmental factors. You must not rely on the App as your sole means of navigation in any outdoor, offroad, remote, or wilderness environment.
- Carry proper navigation equipment. You should always carry and know how to use traditional navigation tools including topographic maps, a dedicated compass, and a purpose-built GPS device when engaging in offroad driving, hiking, overlanding, or other wilderness activities.
- Altimeter readings are estimates. Barometric altitude readings are subject to atmospheric pressure changes. Do not rely on altimeter data for critical altitude decisions in aviation or mountaineering contexts.
- Inclinometer use requires judgment. Vehicle pitch and roll angle readings are provided for informational purposes. Safe vehicle operation on inclined terrain depends on vehicle design, load, tire traction, surface conditions, and driver skill. The App does not replace the judgment of a trained offroad driver.
- Connectivity cannot be guaranteed. GPS, sensor, and network features depend on device hardware, battery level, and environmental conditions. Device failure, battery depletion, or loss of GPS signal can occur at any time. You must have alternative navigation resources when exploring remote areas.
- You assume all risk. Outdoor and offroad activities involve inherent and significant risks of injury, death, property damage, and other losses. Your use of the App does not mitigate these risks. Strategia-X is not responsible for any outcome arising from your use of the App in conjunction with outdoor activities.
- Emergency situations. The App is not a substitute for emergency services. Always notify others of your intended route and carry appropriate emergency signaling equipment when venturing into remote areas. Know how to access emergency services in your jurisdiction without relying on the App.
10.3 Responsible Device Use
You agree to:
- Use the App only in a manner that is safe for yourself and others. Do not use the App while operating a vehicle or in any situation where divided attention creates a safety risk, unless the App is safely mounted and operated by a passenger.
- Comply with all applicable traffic laws, offroad regulations, land access rules, and wilderness use policies when using the App during outdoor activities.
- Respect all applicable laws and regulations regarding drone operations, land access, and environmental protection when using location-based features.
- Use device optimization features (RAM booster, cache cleaner, etc.) responsibly and at your own risk. Some optimization actions may close background applications or affect system behavior.
- Use the App's network and Bluetooth features only on networks and devices you are authorized to access or test.
11. Prohibited Conduct
11.1 Prohibited Activities
You agree that you will not, under any circumstances:
- Reverse engineer or circumvent the App. Decompile, disassemble, reverse engineer, or attempt to derive the source code, algorithms, trade secrets, or underlying structure of the App or any component thereof, except as expressly permitted by applicable law.
- Tamper with the App. Modify, patch, hack, or interfere with the App or its operation, including attempting to bypass any security, advertising, or permission controls.
- Use the App for unauthorized network testing. Use the Wi-Fi spectrum analyzer, Bluetooth scanner, speed test, ping, or any network feature to probe, scan, attack, or test systems or networks without explicit authorization from the network or system owner.
- Use the App to facilitate harm. Use any feature of the App — including sensor readings, network analysis, or device information — to facilitate illegal surveillance, stalking, harassment, or any activity that violates the rights of others.
- Scrape or extract App data. Use automated means, bots, or scripts to extract, scrape, or systematically access data generated by or displayed within the App.
- Misrepresent App output. Deliberately misrepresent or falsify sensor readings, GPS coordinates, benchmark results, or other App outputs for fraudulent purposes.
- Violate applicable laws. Use the App in violation of any applicable local, state, national, or international law or regulation, including but not limited to laws governing data privacy, electronic surveillance, computer fraud, export control, and anti-terrorism.
- Infringe intellectual property. Copy, reproduce, redistribute, or exploit the App or any portion of it in violation of the intellectual property rights of Strategia-X or any third party.
- Distribute modified versions. Distribute, publish, or make available any modified, repackaged, or cracked version of the App through any channel.
- Use as critical life-safety infrastructure. Use the App as the sole or primary navigation, communication, or monitoring system in life-safety contexts, including emergency response, aviation, maritime navigation, or medical monitoring. The App is not certified or designed for such applications.
11.2 Enforcement
Violation of this section may result in immediate termination of your license to use the App, legal action, and/or referral to appropriate law enforcement authorities. Strategia-X reserves the right to take any action necessary to protect its rights and the safety of its users.
12. Disclaimers and Limitation of Liability
12.1 Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT. STRATEGIA-X DOES NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION OR ERROR, PRODUCE ACCURATE RESULTS, OR BE FREE FROM DEFECTS, VIRUSES, OR OTHER HARMFUL COMPONENTS.
12.2 GPS and Navigation Accuracy Disclaimer
GPS/GNSS POSITIONING DATA PROVIDED BY THE APP IS APPROXIMATE AND IS SUBJECT TO SIGNIFICANT POTENTIAL INACCURACIES. GPS ACCURACY VARIES BASED ON SATELLITE AVAILABILITY, ATMOSPHERIC CONDITIONS, DEVICE HARDWARE QUALITY, PHYSICAL OBSTRUCTIONS (CANYONS, DENSE FOLIAGE, STRUCTURES), AND OTHER FACTORS OUTSIDE STRATEGIA-X'S CONTROL.
DEVICELAB OFFROAD IS NOT A SUBSTITUTE FOR PROFESSIONAL NAVIGATION EQUIPMENT, DEDICATED GPS RECEIVERS, TOPOGRAPHIC MAPS, OR TRAINED NAVIGATION EXPERTISE. 12.3 Sensor Data Disclaimer
Sensor readings displayed by the App (including but not limited to altitude, pitch, roll, G-force, compass heading, temperature, barometric pressure, and ambient light) are derived from consumer-grade smartphone sensors and are intended for informational and recreational purposes only. These readings are not certified, calibrated for professional use, or suitable for use in any safety-critical, engineering, scientific, legal, aviation, maritime, medical, or regulatory context.
12.4 Outdoor and Offroad Activity Risk Acknowledgment
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT OFFROAD DRIVING, OVERLANDING, HIKING, CLIMBING, AND OTHER OUTDOOR ADVENTURE ACTIVITIES INVOLVE INHERENT RISKS OF SERIOUS BODILY INJURY, DEATH, PROPERTY DAMAGE, VEHICLE DAMAGE, AND OTHER HARM. YOUR USE OF THE APP IN CONNECTION WITH ANY OUTDOOR ACTIVITY IS ENTIRELY AT YOUR OWN RISK. STRATEGIA-X IS NOT RESPONSIBLE FOR ANY INJURY, DEATH, LOSS, OR DAMAGE RESULTING FROM YOUR PARTICIPATION IN OUTDOOR ACTIVITIES, REGARDLESS OF WHETHER YOU USED THE APP IN CONNECTION WITH THOSE ACTIVITIES.
12.5 Device Optimization Disclaimer
Device optimization features (including RAM boosting, cache cleaning, storage analysis, battery saving, startup optimization, and wake lock detection) are provided for informational and performance management purposes. Strategia-X makes no warranty that these features will improve device performance or battery life, and is not responsible for any unintended consequences of using these tools, including data loss, application termination, or device instability.
12.6 Network and Connectivity Features Disclaimer
Network analysis features (Wi-Fi spectrum analyzer, Bluetooth scanner, speed test, ping diagnostics) are provided for informational purposes only. Network speed test and ping results are point-in-time estimates subject to significant variation. Strategia-X makes no warranty that these features will accurately reflect your network conditions at all times.
12.7 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STRATEGIA-X, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF LIFE, PERSONAL INJURY, PROPERTY DAMAGE, VEHICLE DAMAGE, LOST PROFITS, LOSS OF DATA, LOSS OF GOODWILL, COST OF SUBSTITUTE GOODS OR SERVICES, OR ANY OTHER INTANGIBLE LOSS, ARISING OUT OF OR IN CONNECTION WITH:
- Your use of or inability to use the App;
- Reliance on GPS, navigation, sensor, or any other data provided by the App;
- Use of the App during or in connection with any outdoor activity, including offroad driving, hiking, overlanding, or wilderness exploration;
- Any inaccuracy in GPS coordinates, altitude, compass heading, inclinometer readings, or any other sensor measurement;
- Any unauthorized access to or alteration of your device or data;
- Any failure of GPS signal, sensor hardware, device battery, or network connectivity while using the App;
- Any conduct or content of third parties, including Google AdMob;
- Any bugs, viruses, or other harmful code transmitted through the App; or
- Any other matter relating to the App.
IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, STRATEGIA-X'S LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. IN NO EVENT SHALL STRATEGIA-X'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO STRATEGIA-X IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) TEN U.S. DOLLARS (USD $10.00).
12.8 Basis of the Bargain
The disclaimers, exclusions, and limitations of liability set forth in this Section 12 form an essential basis of the agreement between you and Strategia-X. The App is provided free of charge, and these limitations reflect a fair allocation of risk and responsibility. Strategia-X would not be able to provide the App without these protections.
13. Indemnification
13.1 Your Indemnification Obligations
You agree to defend, indemnify, and hold harmless Strategia-X and its officers, directors, employees, agents, licensors, partners, and successors from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
- Your use of or inability to use the App;
- Your violation of these Terms or any applicable law or regulation;
- Your violation of the rights of any third party, including intellectual property rights, privacy rights, or property rights;
- Any outdoor, offroad, or adventure activity you engage in while using or after using the App;
- Your reliance on any navigation, GPS, sensor, or device data provided by the App in connection with any activity;
- Your use of the App's network analysis features on systems or networks without appropriate authorization; or
- Any content, data, or information you transmit or make available through the App.
13.2 Indemnification Procedure
Strategia-X reserves the right to assume exclusive control and defense of any matter subject to indemnification by you, at your expense. You agree to cooperate reasonably with Strategia-X's defense of any such claim. You may not settle any claim that imposes any obligation, restriction, or liability on Strategia-X without our prior written consent.
14. Privacy and Data Protection
14.1 Privacy Policy
Your privacy is critically important to us. Our Privacy Policy is incorporated into these Terms by reference and governs our collection, use, and protection of information in connection with the App. By using the App, you agree to the data practices described in our Privacy Policy.
14.2 Location Data — Real-Time Only, Never Stored
DeviceLab Offroad accesses your device's GPS/GNSS hardware to provide real-time navigation features. YOUR LOCATION DATA IS PROCESSED ENTIRELY ON YOUR DEVICE IN REAL-TIME. STRATEGIA-X DOES NOT STORE, LOG, TRACK, TRANSMIT, OR RETAIN ANY GPS COORDINATES, LOCATION HISTORY, TRAVEL ROUTES, OR POSITIONAL DATA OF ANY KIND.
When you close the App or navigate away from a location feature, no location data is retained in any database, file, or memory. The App holds only instantaneous location data necessary to render the current display. Location permissions are used solely to provide the navigation instruments you have chosen to use and may be revoked at any time in Android Settings without affecting non-location features.
14.3 Microphone — Real-Time Audio Oscilloscope Only, Never Recorded
The RECORD_AUDIO permission is used exclusively for the Audio Oscilloscope feature, which visualizes sound waveforms in real-time on-screen. NO AUDIO IS RECORDED, CAPTURED, STORED, BUFFERED BEYOND THE CURRENT DISPLAY FRAME, OR TRANSMITTED UNDER ANY CIRCUMSTANCES.
When the Audio Oscilloscope is not active, the microphone is not accessed. You may revoke microphone permission at any time in Android Settings to disable the oscilloscope feature. This will not affect any other feature of the App.
14.4 Camera — QR Code Scanning Only, No Images Stored
The CAMERA permission is used exclusively for the QR Code Scanner feature, which decodes QR codes and barcodes in real-time using the camera viewfinder. NO PHOTOS, VIDEOS, SCREENSHOTS, OR CAMERA FRAMES ARE CAPTURED, STORED, OR TRANSMITTED UNDER ANY CIRCUMSTANCES.
Camera data is processed in real-time solely to detect and decode QR code patterns and is discarded immediately after decoding. You may revoke camera permission at any time in Android Settings to disable the QR scanner. This will not affect any other feature of the App.
14.5 Locally Stored Data
The following data is stored locally on your device using Android's Room database and Jetpack DataStore and is never transmitted to Strategia-X's servers or any third party:
- Device performance history (CPU, RAM, battery, storage snapshots)
- Device health metrics and trend data
- App usage statistics (screen time records)
- Benchmark results
- User preferences, dashboard layouts, and automation rules
- Achievement and optimization milestone progress
- Network statistics (stored locally for historical reference)
14.6 Data You Control
You have full control over all data stored by the App. You may:
- View all stored data within the App's interface;
- Export data using the built-in export feature;
- Clear all stored data via Android Settings > Apps > DeviceLab Offroad > Storage > Clear Data; and
- Permanently delete all data by uninstalling the App.
14.7 Advertising Data
Google AdMob's data collection is separate from and independent of Strategia-X's data practices. AdMob may collect advertising identifiers and device information as described in Section 7. Your advertising consent preferences are managed through the Google UMP consent dialog.
15. GDPR Compliance
15.1 Applicability
This section applies to users in the European Economic Area (EEA), the United Kingdom, and Switzerland whose personal data is subject to the General Data Protection Regulation (Regulation (EU) 2016/679) ("GDPR"), the UK GDPR (as retained in UK law by the European Union (Withdrawal) Act 2018), and the Swiss Federal Act on Data Protection (nFADP).
15.2 Data Controller Status
With respect to data processed locally on your device (sensor data, performance history, device diagnostics), Strategia-X does not act as a data controller or data processor under GDPR because this data never leaves your device and we have no access to it. You maintain exclusive, direct control over this data.
With respect to data collected by Google AdMob and Google Play Services, Google LLC acts as an independent data controller and, in some contexts, as a data processor. The legal basis for Google's processing is your freely given, specific, informed, and unambiguous consent provided through the Google UMP consent dialog (GDPR Article 6(1)(a) and Article 7).
15.3 Legal Bases for Processing (Article 6)
To the extent Strategia-X processes any personal data, the applicable legal bases are:
- Article 6(1)(a) — Consent: Processing of advertising-related data through Google AdMob, where consent is obtained via the UMP consent dialog. You may withdraw consent at any time without affecting the lawfulness of processing prior to withdrawal.
- Article 6(1)(b) — Performance of a Contract: Processing necessary to provide the App's features and functionality to you as described in these Terms.
- Article 6(1)(f) — Legitimate Interests: Processing necessary for our legitimate interests in improving app security, diagnosing technical issues, and ensuring App functionality, where these interests are not overridden by your fundamental rights and freedoms.
15.4 Special Category Data — Precise Location (Article 9)
Precise geolocation data may constitute special category data or sensitive personal data under certain interpretations of GDPR and related guidance. DeviceLab Offroad accesses precise GPS/GNSS location data pursuant to the following:
- Location data is processed solely on your device in real-time to provide the navigation features you have explicitly requested;
- No location data is stored, transmitted, or processed by Strategia-X at any time;
- You have provided explicit consent to location access through Android's runtime permission system before any location data is accessed; and
- You may revoke location permission at any time, which immediately and permanently stops all location processing.
Because Strategia-X does not receive, store, or process your location data, we do not act as a controller or processor of this data under GDPR. However, we have implemented this "real-time only, never stored" architecture precisely to respect the sensitive nature of precise location data and to protect your rights under Article 9 and related provisions.
15.5 Consent Management (Articles 7 and 8)
Consent for personalized advertising is obtained through the Google User Messaging Platform (UMP) in compliance with GDPR Articles 7 and 8. Consent is:
- Freely given — refusing personalized ads does not restrict access to the App;
- Specific — obtained for defined advertising purposes;
- Informed — the consent dialog explains what data is collected and why;
- Unambiguous — obtained through an affirmative action, not pre-ticked boxes; and
- Withdrawable — you may update your consent at any time through the App's settings.
For users under the applicable age of digital consent in their member state (Article 8), parental consent is required as described in Section 2.2.
15.6 Transparency and Information (Articles 12–14)
We provide clear, concise, and accessible information about our data practices through:
- This Terms of Service document;
- Our Privacy Policy at strategia-x.com/offroad-app-privacy;
- The UMP consent dialog displayed prior to any advertising data processing;
- The Google Play Store Data Safety section; and
- Our contact channels for privacy inquiries.
15.7 Your GDPR Rights (Articles 15–22)
To the extent Strategia-X processes your personal data, you have the following rights under GDPR:
- Right of Access (Article 15) — The right to obtain confirmation of whether and what personal data we process about you.
- Right to Rectification (Article 16) — The right to correction of inaccurate personal data.
- Right to Erasure (Article 17) — The right to deletion of your personal data ("right to be forgotten"). For locally stored data, exercise this right directly by clearing App data or uninstalling. For AdMob data, contact Google directly.
- Right to Restriction of Processing (Article 18) — The right to restrict how we process your data in certain circumstances.
- Right to Data Portability (Article 20) — The right to receive your personal data in a structured, commonly used, machine-readable format. Use the App's export feature to exercise this right for locally stored data.
- Right to Object (Article 21) — The right to object to processing based on legitimate interests. You may object to personalized advertising by updating your UMP consent preferences.
- Rights Related to Automated Decision-Making (Article 22) — The App does not engage in automated decision-making or profiling that produces legal or similarly significant effects on you.
To exercise any of these rights, contact us at [email protected]. We will respond within 30 days. For complex requests, we may extend this by a further 60 days with notice.
15.8 Privacy by Design and Default (Article 25)
Strategia-X has implemented data protection principles by design and by default in the architecture of DeviceLab Offroad:
- Data minimization — Only sensor data necessary for the specific feature requested is accessed, and only in real-time.
- Purpose limitation — Each permission is used for a single, clearly defined purpose.
- Storage limitation — Real-time sensor data (GPS, microphone, camera) is not stored beyond the current display frame.
- Confidentiality — All locally stored data is protected by Android's application sandbox and encrypted storage where available.
- No account by default — The App requires no registration or personal data disclosure to function.
15.9 International Data Transfers (Articles 44–49)
Strategia-X does not transfer your personal data internationally because no personal data is transmitted from your device to our servers. Third-party services (Google AdMob, Google Play Services) may transfer data to servers located in the United States or other countries. Google's international data transfers are governed by Standard Contractual Clauses, adequacy decisions, and other GDPR-compliant transfer mechanisms as described in Google's privacy policies.
15.10 Right to Lodge a Complaint (Article 77)
Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority — in particular, the supervisory authority in the EU member state of your habitual residence, place of work, or place of the alleged infringement — if you consider that our processing of your personal data infringes GDPR. You may also contact us first at [email protected] and we will work to resolve your concern promptly.

16. CCPA/CPRA Compliance
16.1 Applicability
This section applies to residents of California and supplements the other provisions of these Terms in accordance with the California Consumer Privacy Act of 2018 (Cal. Civ. Code §§ 1798.100–1798.199) as amended by the California Privacy Rights Act of 2020 ("CCPA/CPRA"). The California Privacy Protection Agency (CPPA) is the primary enforcement authority for these rights.
16.2 Categories of Personal Information Collected (§ 1798.100, § 1798.110)
In the preceding 12 months, Strategia-X (through the App) has collected or may have collected the following categories of personal information:
- Device/hardware identifiers — Device advertising ID (GAID), collected by Google AdMob (not by Strategia-X directly).
- Precise geolocation data — GPS coordinates accessed in real-time for navigation features. This data is processed solely on your device and is never transmitted to Strategia-X. Google AdMob may access approximate location (country/ region level) for advertising purposes.
- Internet or network activity information — Ad impression and interaction data collected by Google AdMob. IP address used by AdMob for fraud prevention and regional ad targeting.
- Commercial information — None collected. The App is free with no purchases.
- Biometric data — None collected.
- Audio, visual, or electronic data — Real-time audio waveform data for the oscilloscope; real-time camera feed for QR scanning. Neither is recorded, stored, or transmitted.
16.3 Sensitive Personal Information Under CPRA (§ 1798.121)
Under the CPRA, precise geolocation data (location within a radius of 1,850 feet or less) is classified as sensitive personal information. DeviceLab Offroad accesses precise GPS location data for navigation features. Strategia-X limits its use of this sensitive information to the following purposes:
- Providing real-time navigation display features specifically requested by you;
- No purpose beyond what is reasonably necessary for the navigation features; and
- The information is not stored, transmitted, sold, shared, or used for advertising targeting.
You have the right to limit our use and disclosure of sensitive personal information to uses that are necessary to perform the services you request (§ 1798.121). Given that we already use precise location data only for this limited purpose and do not store or transmit it, your right to limit is effectively exercised by our default data practices. You may also revoke location permission at any time in Android Settings.
16.4 Your CCPA/CPRA Rights
- Right to Know (§ 1798.110, § 1798.115) — You have the right to know what personal information we have collected about you, the categories of sources, the business purposes for collection, and the categories of third parties with whom we share it. This document and our Privacy Policy provide those disclosures.
- Right to Delete (§ 1798.105) — You have the right to request deletion of personal information we have collected. For locally stored App data, delete it directly through Android Settings or by uninstalling the App. For AdMob data, submit a deletion request to Google directly.
- Right to Correct (§ 1798.106) — You have the right to request correction of inaccurate personal information maintained by us. Contact us at [email protected].
- Right to Opt-Out of Sale or Sharing (§ 1798.120) — Strategia-X does not sell your personal information. We do not share your personal information with third parties for cross-context behavioral advertising. Google AdMob's practices may constitute "sharing" under CPRA; manage this through the UMP consent dialog or Android advertising settings.
- Right to Limit Use of Sensitive Personal Information (§ 1798.121) — As described in Section 16.3, precise location data is used only to provide real-time navigation features. This right is satisfied by our default practices.
- Right to Non-Discrimination (§ 1798.125) — Strategia-X will not discriminate against you for exercising your CCPA/CPRA rights. We will not deny you services, charge different prices, or provide a lower quality of service because you exercised your privacy rights.
16.5 Exercising Your Rights
To exercise your CCPA/CPRA rights, submit a verifiable consumer request to us at:

We will respond to verifiable consumer requests within 45 calendar days. If we require more time, we will inform you of the reason and extension period in writing. We may request information reasonably necessary to verify your identity before processing your request.
16.6 CalOPPA Compliance
In compliance with the California Online Privacy Protection Act (CalOPPA), we disclose that: the App does not track your location across third-party websites or applications; we do not respond to browser "Do Not Track" signals (the App does not operate in a browser context); and we do not allow third parties to collect personally identifiable information about users' online activities across websites through the App, except as described for Google AdMob.
17. Additional U.S. State Privacy Laws
17.1 Overview
In addition to California (CCPA/CPRA), numerous U.S. states have enacted or are enforcing comprehensive consumer privacy laws. The following rights and disclosures apply to residents of states with enacted comprehensive privacy laws. In each case, you may exercise your rights by contacting us at [email protected]. Because the App stores all device data locally and does not transmit personal information to our servers, many of these rights can be exercised directly on your device.
17.2 Virginia — Consumer Data Protection Act (VCDPA, Va. Code § 59.1-575 et seq.)
Virginia residents have rights to access, correct, delete, and obtain a copy of personal data we process, and to opt out of targeted advertising, sale of personal data, and profiling for decisions with legal or similarly significant effects. We do not sell your personal data. Targeted advertising consent is managed through the Google UMP consent dialog. You may appeal our response to a privacy request by contacting us at the address in Section 25.
17.3 Colorado — Colorado Privacy Act (CPA, C.R.S. § 6-1-1301 et seq.)
Colorado residents have the right to opt out of the processing of personal data for targeted advertising, sale, or profiling. You also have rights of access, correction, deletion, and portability. We process personal data under GDPR-equivalent principles including purpose limitation and data minimization. Opt-out rights for targeted advertising are managed through your UMP consent preferences.
17.4 Connecticut — Connecticut Data Privacy Act (CTDPA, Conn. Gen. Stat. § 42-515 et seq.)
Connecticut residents have the right to access, correct, delete, and obtain a copy of personal data, and to opt out of targeted advertising, sale of personal data, and profiling. We do not sell personal data. Consent for targeted advertising is managed through the Google UMP dialog. Requests may be appealed to our contact address within a reasonable period.
17.5 Utah — Utah Consumer Privacy Act (UCPA, Utah Code § 13-61-101 et seq.)
Utah residents have the right to confirm whether we process personal data, access their personal data, request deletion, obtain a portable copy, and opt out of targeted advertising and sale of personal data. The App's local-first architecture means most personal data is controlled entirely by you on your device.
17.6 Iowa — Iowa Consumer Data Protection Act (ICDPA, Iowa Code § 715D)
Iowa residents have rights of access, deletion, portability, and opt-out from targeted advertising and sale of personal data. We do not sell personal data. Locally stored App data may be deleted by clearing App storage or uninstalling.
17.7 Indiana — Indiana Consumer Data Protection Act (INCDPA, IC 24-15)
Indiana residents have rights of access, correction, deletion, portability, and opt-out from targeted advertising, sale of personal data, and profiling for significant decisions. We do not engage in profiling for decisions with legal effects. Opt-out for targeted advertising is available through the UMP consent dialog.
17.8 Tennessee — Tennessee Information Protection Act (TIPA, Tenn. Code § 47-18-3201 et seq.)
Tennessee residents have the right to access, correct, delete, and receive a copy of personal data, and to opt out of targeted advertising, sale of personal data, and profiling. We apply privacy-by-design principles as described in this document. Personal data deletion may be performed directly on your device.
17.9 Montana — Montana Consumer Data Privacy Act (MCDPA, Mont. Code § 30-14-3501 et seq.)
Montana residents have rights of access, correction, deletion, portability, and opt-out from targeted advertising and sale. We do not sell personal data. Consent preferences for personalized advertising are managed through the Google UMP dialog.
17.10 Texas — Texas Data Privacy and Security Act (TDPSA, Tex. Bus. & Com. Code § 541)
Texas residents have the right to access, correct, delete, and obtain a copy of personal data, and to opt out of targeted advertising, sale of personal data, and profiling for significant decisions. We do not sell personal data or engage in profiling for significant decisions. Sensitive data (including precise geolocation) is processed only with your consent, provided through Android's runtime permission system.
17.11 Oregon — Oregon Consumer Privacy Act (OCPA, ORS § 646A.570 et seq.)
Oregon residents have rights of access, correction, deletion, portability, and opt-out from targeted advertising, sale, and profiling. Sensitive personal data — including precise geolocation — requires your consent before processing, which is obtained through Android's location permission dialog. We apply privacy-by-design principles to all sensitive data categories.
17.12 Delaware — Delaware Personal Data Privacy Act (DPDPA, Del. Code tit. 6, § 12D)
Delaware residents have rights of access, correction, deletion, portability, and opt-out from targeted advertising, sale, and profiling. The App does not engage in profiling for automated decisions with legal or significant effects. Sensitive data is handled with consent as described throughout this document.
17.13 New Hampshire — New Hampshire Privacy Act (NHDPA, RSA 507-H)
New Hampshire residents have the right to access, correct, delete, and obtain a copy of personal data, and to opt out of targeted advertising, sale, and profiling. We do not sell personal data. Opt-out for personalized advertising is available through the UMP consent dialog and Android advertising settings.
17.14 New Jersey — New Jersey Data Privacy Act (NJDPA, N.J.S.A. § 56:8-166.1 et seq.)
New Jersey residents have rights of access, correction, deletion, portability, and opt-out from targeted advertising, sale of personal data, and certain forms of profiling. Sensitive personal data — including precise geolocation — is processed only pursuant to your explicit consent. We do not sell personal data.
17.15 Nebraska — Nebraska Data Privacy Act (NDPA, Neb. Rev. Stat. § 87-401 et seq.)
Nebraska residents have the right to access, correct, delete, and obtain a copy of personal data, and to opt out of targeted advertising, sale, and profiling for significant decisions. Sensitive personal data is processed only with consent provided through Android's permission system. We apply data minimization principles throughout the App.
17.16 Maryland — Maryland Online Data Privacy Act (MODPA, Md. Code, Com. Law § 14-4601 et seq.)
Maryland residents have rights of access, correction, deletion, portability, and opt-out from targeted advertising, sale of personal data, and profiling. Maryland's MODPA includes strong provisions regarding sensitive data minimization — we collect no more sensitive personal data (including precise geolocation) than is strictly necessary to provide the specific feature you have requested.
17.17 Minnesota — Minnesota Consumer Data Privacy Act (MCDPA / MPDPA)
Minnesota residents have rights of access, correction, deletion, portability, and opt-out from targeted advertising, sale, and profiling. Minnesota's law includes the right to question and appeal certain automated decisions. The App does not engage in automated decision-making that produces legal effects. Sensitive data is handled with consent as described throughout this document.
17.18 COPPA Compliance
The App is not directed at children under the age of 13, and Strategia-X does not knowingly collect personal information from children under 13 in violation of the Children's Online Privacy Protection Act (15 U.S.C. § 6501 et seq., "COPPA") or the COPPA Rule (16 C.F.R. Part 312). The App does not require account creation, does not collect children's personal information, and does not include social features through which children may share personal information. If we discover that a user is under 13, we will take immediate steps to comply with COPPA requirements.
Advertising served through Google AdMob is subject to Google's child safety policies. Strategia-X has configured its AdMob implementation in accordance with Google's requirements for apps that may be used by minors.

Because the App operates on a local-first architecture and stores no personal data on our servers, many requests (deletion, portability) can be fulfilled immediately and directly by you through your device's settings, as described in Section 14.6.
18. International Users
18.1 Global Availability
DeviceLab Offroad is available globally through the Google Play Store, subject to Google Play's distribution policies and country-specific restrictions. Strategia-X is based in the United States and these Terms are governed by U.S. law as specified in Section 22.
18.2 Compliance with Local Laws
You are responsible for ensuring that your use of the App complies with all laws and regulations applicable in your jurisdiction, including but not limited to:
- Brazil — LGPD: The Lei Geral de Proteção de Dados Pessoais (Law No. 13,709/2018) grants Brazilian residents rights similar to those described in our GDPR section, including access, correction, deletion, portability, opt-out of processing, and the right to revoke consent. - Canada — PIPEDA / Law 25: Canadian residents are protected by the Personal Information Protection and Electronic Documents Act (PIPEDA) and, in Quebec, by Law 25 (Act respecting the protection of personal information in the private sector). You have the right to access and challenge the accuracy of personal information we hold about you and to file a complaint with the Office of the Privacy Commissioner of Canada at priv.gc.ca.
- Australia — Privacy Act: Australian residents are protected by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Contact us to exercise your rights or to lodge a complaint with the Office of the Australian Information Commissioner at oaic.gov.au.
- Other jurisdictions: Users in other countries should consult their local data protection laws. Our local-first data architecture, which stores no personal data on our servers, is designed to respect privacy principles universally.
18.3 Data Localization
Because DeviceLab Offroad stores all device data locally on your device, no data localization requirements are triggered by our App's architecture. The only cross-border data flows are those managed by Google AdMob and Google Play Services, governed by Google's applicable data transfer mechanisms.
18.4 Export Controls
The App is subject to U.S. export control laws and regulations. You may not use, export, or re-export the App in violation of U.S. export laws or the import laws of any other country. By using the App, you represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
19. Third-Party Services
19.1 Google AdMob
DeviceLab Offroad uses Google AdMob (Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) to display advertising. AdMob operates under its own terms of service and privacy policy. Strategia-X does not control AdMob's data collection or use practices. For information on how Google uses data from apps that use its services, see policies.google.com/technologies/partner-sites.
19.2 Google User Messaging Platform (UMP)
The App uses Google's User Messaging Platform (UMP) to present advertising consent dialogs in compliance with GDPR, CCPA/CPRA, and other applicable privacy regulations. The UMP SDK collects and stores your consent preferences on your device. Consent records may be shared with Google to ensure compliant ad delivery. For details, see Google's UMP documentation.
19.3 Google Play Services
The App relies on Google Play Services for core Android functionality, including location services (GPS/GNSS positioning for navigation features), app updates, security, and integration with the Android platform. Google Play Services is governed by Google's Privacy Policy and Google Play Terms of Service. Google Play Services may process location data to provide GPS positioning. Strategia-X does not receive or control this data.
19.4 Open-Source Libraries
The App incorporates open-source libraries including Jetpack Compose, Room, Hilt (Dagger), Jetpack DataStore, WorkManager, Kotlin Coroutines, and Material Design 3. These libraries are used for on-device functionality only and do not collect or transmit user data. Each library is used in accordance with its applicable open-source license.
19.5 Third-Party Links
The App may display QR code content that links to third-party websites or applications. Strategia-X has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party website or application that you access through a decoded QR code or any other App feature. We encourage you to review the privacy policies of any third-party services you choose to access.
19.6 No Endorsement
Reference to any third-party services, products, or organizations in the App or in these Terms does not constitute an endorsement, sponsorship, or recommendation by Strategia-X. Strategia-X is not responsible for the availability, accuracy, or content of third-party resources.
20. Updates and Modifications
20.1 App Updates
Strategia-X may release updates, patches, and new versions of DeviceLab Offroad through the Google Play Store from time to time. These updates may add new features, modify existing features, fix bugs, improve performance, or address security vulnerabilities. By enabling automatic updates on your device or manually installing an update, you agree that any update is subject to these Terms (or the updated Terms in effect at the time of the update).
20.2 Mandatory Updates
Certain updates may be required to continue using the App, particularly updates that address critical security vulnerabilities or changes to Google Play's policy requirements. If you choose not to install a required update, certain features of the App may become unavailable or the App may cease to function properly.
20.3 Feature Changes
We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice. Strategia-X shall not be liable to you or any third party for any modification, suspension, or discontinuation of any feature. We will endeavor to provide advance notice of significant feature changes through the App's changelog and the Google Play Store listing.
20.4 Platform Requirements
As Android evolves, the minimum device and operating system requirements for DeviceLab Offroad may change. The App currently requires Android 7.0 (API 24) or later. Future updates may require a higher minimum Android version. We recommend keeping your device's Android version current to ensure continued full compatibility.
20.5 Permissions Changes
Updates may introduce new permission requests required to support new features. Android will prompt you to grant any new permissions before the relevant features become accessible. You are never required to grant permissions that you are not comfortable with; the corresponding features will simply be unavailable without the required permission.
21. Termination
21.1 Termination by You
You may terminate your use of the App and these Terms at any time by uninstalling DeviceLab Offroad from your device. Uninstalling the App will permanently delete all locally stored data associated with the App. There are no penalties, fees, or ongoing obligations upon termination by you.
21.2 Termination by Strategia-X
Strategia-X may terminate or suspend your license to use the App, or discontinue the App entirely, at any time in its sole discretion, with or without notice, for reasons including but not limited to:
- Your material breach of these Terms;
- Conduct that we reasonably believe poses a threat to the security, integrity, or reputation of the App or Strategia-X;
- Requirements of applicable law or governmental order;
- Business or strategic decisions to discontinue the App; or
- Extended periods of non-compliance with Google Play policies.
21.3 Effect of Termination
Upon termination of these Terms for any reason:
- All rights and licenses granted to you under these Terms immediately terminate;
- You must cease all use of the App and uninstall it from your device;
- All locally stored App data will be deleted upon uninstallation; and
- Sections 8 (Intellectual Property), 12 (Disclaimers and Limitation of Liability), 13 (Indemnification), 22 (Governing Law), and any other provisions that by their nature should survive, shall survive termination.
21.4 App Discontinuation
If Strategia-X elects to discontinue DeviceLab Offroad, we will endeavor to provide reasonable advance notice through the App or the Google Play Store listing. Upon removal of the App from the Google Play Store, your existing installation may continue to function, but no further updates will be provided, and we assume no responsibility for continued operation on future Android versions.
22. Governing Law and Dispute Resolution
22.1 Governing Law
These Terms and any dispute arising out of or related to them or your use of the App shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions or choice of law rules that would cause the application of the laws of any other jurisdiction.
22.2 Informal Dispute Resolution
Before initiating any formal legal proceeding, you agree to contact Strategia-X at [email protected] and attempt to resolve any dispute informally. We will make good-faith efforts to resolve your concern within 30 days of receiving notice. This informal resolution period is a prerequisite to any formal proceeding.
22.3 Arbitration Agreement
If informal resolution fails, you and Strategia-X agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the App (including disputes regarding the interpretation, breach, termination, validity, or enforceability of these Terms) shall be resolved by binding arbitration on an individual basis under the Commercial Arbitration Rules of the American Arbitration Association ("AAA"), except where prohibited by applicable law. The arbitration shall be conducted in English, in the State of Delaware, and the arbitrator's decision shall be final and binding.
22.4 Class Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
If a court or arbitrator determines that this class action waiver is unenforceable with respect to any particular claim, then that claim must be severed from arbitration and may proceed in court, but all other claims shall remain subject to arbitration.
22.5 Exceptions to Arbitration
Notwithstanding the arbitration agreement, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration. Claims of intellectual property infringement may also be brought in court.
22.6 Jurisdiction for Court Proceedings
For any dispute not subject to arbitration, or for purposes of enforcing an arbitration award, you and Strategia-X consent to the exclusive personal jurisdiction and venue of the federal and state courts located in the State of Delaware, and you waive any objection to such jurisdiction or venue on the basis of inconvenient forum or otherwise.
22.7 Applicable Consumer Protection Laws
Nothing in this Section 22 limits your rights under any applicable mandatory consumer protection laws in your jurisdiction. Residents of the EEA, UK, and other jurisdictions with mandatory consumer protection provisions may have additional rights that cannot be waived by contract.
22.8 Statute of Limitations
Any cause of action or claim you may have arising out of or relating to these Terms or the App must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action or claim is permanently barred, to the maximum extent permitted by applicable law.
23. Severability
23.1 Severability of Provisions
If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, unenforceable, or void for any reason, that provision will be deemed severed from these Terms. The remainder of the Terms will continue in full force and effect and be construed in a manner that most closely reflects the original intent of the severed provision to the extent permissible by law.
23.2 Partial Invalidity
If any part of a provision is found to be invalid or unenforceable, only that part shall be severed, and the remainder of the provision shall remain in effect to the fullest extent possible.
23.3 No Waiver
Strategia-X's failure to enforce any provision of these Terms at any time shall not be construed as a waiver of that provision or of our right to enforce such provision at a later time. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
23.4 Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or policies published by Strategia-X in connection with the App, constitute the entire agreement between you and Strategia-X with respect to the App and supersede all prior and contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written, between the parties regarding the subject matter hereof.
23.5 No Third-Party Beneficiaries
These Terms are for the sole benefit of you and Strategia-X and their respective successors and permitted assigns. Nothing in these Terms, express or implied, is intended to or shall create any third-party beneficiary rights in any other person or entity.
23.6 Assignment
You may not assign or transfer any of your rights or obligations under these Terms without Strategia-X's prior written consent. Strategia-X may freely assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law, and you consent to such assignment.
24. Changes to These Terms
24.1 Right to Update
Strategia-X reserves the right to update, revise, or modify these Terms at any time to reflect changes in:
- Applicable laws and regulations (including new privacy laws in additional jurisdictions);
- App features, functionality, or business model;
- Google Play policy requirements;
- Our data practices or third-party service providers; or
- Feedback from our user community.
24.2 Notice of Material Changes
When we make material changes to these Terms, we will provide notice through one or more of the following methods:
- An in-app notification or banner within DeviceLab Offroad;
- An update to the Google Play Store listing description or "What's New" section;
- A notice posted on our website at www.strategia-x.com; or
- Email notification if you have contacted us and provided an email address.
24.3 Effective Date
Updated Terms become effective upon the "Last updated" date stated at the top of the document. Your continued use of the App after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App and uninstall it from your device before the effective date.
24.4 Review Obligation
We encourage you to periodically review these Terms to stay informed of any changes. The most current version of the Terms will always be accessible at www.strategia-x.com and linked from the App's settings.
